{"identifier":"/us/usc/t12/s1701x\u20132","title":12,"num":"\u00a7\u202f1701x\u20132.","heading":"Legal assistance for foreclosure-related issues","text":"\u00a7\u202f1701x\u20132.\nLegal assistance for foreclosure-related issues\n(a)\nEstablishment\nThe Secretary of Housing and Urban Development (hereafter in this section referred to as the \u201cSecretary\u201d) shall establish a program for making grants for providing a full range of foreclosure legal assistance to low- and moderate-income homeowners and tenants related to home ownership preservation, home foreclosure prevention, and tenancy associated with home foreclosure.\n(b)\nCompetitive allocation\nThe Secretary shall allocate amounts made available for grants under this section to State and local legal organizations on the basis of a competitive process. For purposes of this subsection \u201cState and local legal organizations\u201d are those State and local organizations whose primary business or mission is to provide legal assistance.\n(c)\nPriority to certain areas\nIn allocating amounts in accordance with subsection (b), the Secretary shall give priority consideration to State and local legal organizations that are operating in the 125 metropolitan statistical areas (as that term is defined by the Director of the Office of Management and Budget) with the highest home foreclosure rates.\n(d)\nLegal assistance\n(1)\nIn general\nAny State or local legal organization that receives financial assistance pursuant to this section may use such amounts only to assist\u2014\n(A) homeowners of owner-occupied homes with mortgages in default, in danger of default, or subject to or at risk of foreclosure; and\n(B) tenants at risk of or subject to eviction as a result of foreclosure of the property in which such tenant resides.\n(2)\nCommence use within 90 days\nAny State or local legal organization that receives financial assistance pursuant to this section shall begin using any financial assistance received under this section within 90 days after receipt of the assistance.\n(3)\nProhibition on class actions\nNo funds provided to a State or local legal organization under this section may be used to support any class action litigation.\n(4)\nLimitation on legal assistance\nLegal assistance funded with amounts provided under this section shall be limited to mortgage-related default, eviction, or foreclosure proceedings, without regard to whether such foreclosure is judicial or nonjudicial.\n(5)\nEffective date\nNotwithstanding any other provision of this Act, this subsection shall take effect on\nJuly 21, 2010\n(e)\nLimitation on distribution of assistance\n(1)\nIn general\nNone of the amounts made available under this section shall be distributed to\u2014\n(A) any organization which has been convicted for a violation under Federal law relating to an election for Federal office; or\n(B) any organization which employs applicable individuals.\n(2)\nDefinition of applicable individuals\nIn this subsection, the term \u201capplicable individual\u201d means an individual who\u2014\n(A) is\u2014\n(i) employed by the organization in a permanent or temporary capacity;\n(ii) contracted or retained by the organization; or\n(iii) acting on behalf of, or with the express or apparent authority of, the organization; and\n(B) has been convicted for a violation under Federal law relating to an election for Federal office.\n(f)\nAuthorization of appropriations\nThere are authorized to be appropriated to the Secretary $35,000,000 for each of fiscal years 2011 through 2012 for grants under this section.","url":"https://projectusc.org/usc/t12/s1701x\u20132.html","content":[{"t":"sec","id":"/us/usc/t12/s1701x\u20132","children":[{"t":"num","text":"\u00a7\u202f1701x\u20132."},{"t":"heading","text":"Legal assistance for foreclosure-related issues"},{"t":"subsec","id":"/us/usc/t12/s1701x\u20132/a","children":[{"t":"num","text":"(a)"},{"t":"heading","text":"Establishment"},{"t":"content","children":[{"t":"p","text":"The Secretary of Housing and Urban Development (hereafter in this section referred to as the \u201cSecretary\u201d) shall establish a program for making grants for providing a full range of foreclosure legal assistance to low- and moderate-income homeowners and tenants related to home ownership preservation, home foreclosure prevention, and tenancy associated with home foreclosure.","tail":"\n"}],"tail":"\n"}],"tail":"\n"},{"t":"subsec","id":"/us/usc/t12/s1701x\u20132/b","children":[{"t":"num","text":"(b)"},{"t":"heading","text":"Competitive allocation"},{"t":"content","children":[{"t":"p","text":"The Secretary shall allocate amounts made available for grants under this section to State and local legal organizations on the basis of a competitive process.
