{"identifier":"/us/usc/t12/s5581","title":12,"num":"\u00a7\u202f5581.","heading":"Transfer of consumer financial protection functions","text":"\u00a7\u202f5581.\nTransfer of consumer financial protection functions\n(a)\nDefined terms\nFor purposes of this part\u2014\n(1) the term \u201cconsumer financial protection functions\u201d means\u2014\n(A) all authority to prescribe rules or issue orders or guidelines pursuant to any Federal consumer financial law, including performing appropriate functions to promulgate and review such rules, orders, and guidelines; and\n(B) the examination authority described in subsection (c)(1), with respect to a person described in\nsection 5515(a) of this title\n(2) the terms \u201ctransferor agency\u201d and \u201ctransferor agencies\u201d mean, respectively\u2014\n(A) the Board of Governors (and any Federal reserve bank, as the context requires), the Federal Deposit Insurance Corporation, the Federal Trade Commission, the National Credit Union Administration, the Office of the Comptroller of the Currency, the Office of Thrift Supervision, and the Department of Housing and Urban Development, and the heads of those agencies; and\n(B) the agencies listed in subparagraph (A), collectively.\n(b)\nIn general\nExcept as provided in subsection (c), consumer financial protection functions are transferred as follows:\n(1)\nBoard of Governors\n(A)\nTransfer of functions\nAll consumer financial protection functions of the Board of Governors are transferred to the Bureau.\n(B)\nBoard of Governors authority\nThe Bureau shall have all powers and duties that were vested in the Board of Governors, relating to consumer financial protection functions, on the day before the designated transfer date.\n(2)\nComptroller of the Currency\n(A)\nTransfer of functions\nAll consumer financial protection functions of the Comptroller of the Currency are transferred to the Bureau.\n(B)\nComptroller authority\nThe Bureau shall have all powers and duties that were vested in the Comptroller of the Currency, relating to consumer financial protection functions, on the day before the designated transfer date.\n(3)\nDirector of the Office of Thrift Supervision\n(A)\nTransfer of functions\nAll consumer financial protection functions of the Director of the Office of Thrift Supervision are transferred to the Bureau.\n(B)\nDirector authority\nThe Bureau shall have all powers and duties that were vested in the Director of the Office of Thrift Supervision, relating to consumer financial protection functions, on the day before the designated transfer date.\n(4)\nFederal Deposit Insurance Corporation\n(A)\nTransfer of functions\nAll consumer financial protection functions of the Federal Deposit Insurance Corporation are transferred to the Bureau.\n(B)\nCorporation authority\nThe Bureau shall have all powers and duties that were vested in the Federal Deposit Insurance Corporation, relating to consumer financial protection functions, on the day before the designated transfer date.\n(5)\nFederal Trade Commission\n(A)\nTransfer of functions\nThe authority of the Federal Trade Commission under an enumerated consumer law to prescribe rules, issue guidelines, or conduct a study or issue a report mandated under such law shall be transferred to the Bureau on the designated transfer date. Nothing in this title\n1\n1 See References in Text note below.\n(B)\nBureau authority\n(i)\nIn general\nThe Bureau shall have all powers and duties under the enumerated consumer laws to prescribe rules, issue guidelines, or to conduct studies or issue reports mandated by such laws, that were vested in the Federal Trade Commission on the day before the designated transfer date.\n(ii)\nFederal Trade Commission Act\nSubject to part B, the Bureau may enforce a rule prescribed under the Federal Trade Commission Act [\n15 U.S.C. 41\nsection 5531 of this title\n(C)\nAuthority of the Federal Trade Commission\n(i)\nIn general\nNo provision of this title\n1\nsection 5515(a)(1) of this title\n(ii)\nCommission authority relating to rules prescribed by the Bureau\nSubject to part B, the Federal Trade Commission shall have authority to enforce under the Federal Trade Commission Act (\n15 U.S.C. 41\n1\n15 U.S.C. 57a\n(D)\nCoordination\nTo avoid duplication of or conflict between rules prescribed by the Bureau under\nsection 5531 of this title\n15 U.S.C. 57a(a)(1)(B)\n(E)\nDeference\nNo provision of this title\n(i) Federal Trade Commission in making determinations regarding the meaning or interpretation of any provision of the Federal Trade Commission Act, or of any other Federal law for which the Commission has authority to prescribe rules; or\n(ii) Bureau in making determinations regarding the meaning or interpretation of any provision of a Federal consumer financial law (other than any law described in clause (i)).\n(6)\nNational Credit Union Administration\n(A)\nTransfer of functions\nAll consumer financial protection functions of the National Credit Union Administration are transferred to the Bureau.\n(B)\nNational Credit Union Administration authority\nThe Bureau shall have all powers and duties that were vested in the National Credit Union Administration, relating to consumer financial protection functions, on the day before the designated transfer date.\n(7)\nDepartment of Housing and Urban Development\n(A)\nTransfer of functions\nAll consumer protection functions of the Secretary of the Department of Housing and Urban Development relating to the Real Estate Settlement Procedures Act of 1974 (\n12 U.S.C. 2601\n12 U.S.C. 5102\n15 U.S.C. 1701\n(B)\nAuthority of the Department of Housing and Urban Development\nThe Bureau shall have all powers and duties that were vested in the Secretary of the Department of Housing and Urban Development relating to the Real Estate Settlement Procedures Act of 1974 (\n12 U.S.C. 2601\n12 U.S.C. 5101\n15 U.S.C. 1701\n(c)\nAuthorities of the prudential regulators\n(1)\nExamination\nA transferor agency that is a prudential regulator shall have\u2014\n(A) authority to require reports from and conduct examinations for compliance with Federal consumer financial laws with respect to a person described in\nsection 5515(a) of this title\nsection 5515(c) of this title\n(B) exclusive authority (relative to the Bureau) to require reports from and conduct examinations for compliance with Federal consumer financial laws with respect to a person described in\nsection 5516(a) of this title\nsection 5516 of this title\n(2)\nEnforcement\n(A)\nLimitation\nThe authority of a transferor agency that is a prudential regulator to enforce compliance with Federal consumer financial laws with respect to a person described in\nsection 5515(a) of this title\n2\n2 So in original.
