{"identifier":"/us/usc/t15/s2642","title":15,"num":"\u00a7\u202f2642.","heading":"Definitions","text":"\u00a7\u202f2642.\nDefinitions\nFor purposes of this subchapter\u2014\n(1)\nAccredited asbestos contractor\nThe term \u201caccredited asbestos contractor\u201d means a person accredited pursuant to the provisions of\nsection 2646 of this title\n(2)\nAdministrator\nThe term \u201cAdministrator\u201d means the Administrator of the Environmental Protection Agency.\n(3)\nAsbestos\nThe term \u201casbestos\u201d means asbestiform varieties of\u2014\n(A) chrysotile (serpentine),\n(B) crocidolite (riebeckite),\n(C) amosite (cummingtonite-grunerite),\n(D) anthophyllite,\n(E) tremolite, or\n(F) actinolite.\n(4)\nAsbestos-containing material\nThe term \u201casbestos-containing material\u201d means any material which contains more than 1 percent asbestos by weight.\n(5)\nEPA guidance document\nThe term \u201cGuidance for Controlling Asbestos-Containing Material in Buildings\u201d, means the Environmental Protection Agency document with such title as in effect on\nMarch 31, 1986\n(6)\nFriable asbestos-containing material\nThe term \u201cfriable asbestos-containing material\u201d means any asbestos-containing material applied on ceilings, walls, structural members, piping, duct work, or any other part of a building which when dry may be crumbled, pulverized, or reduced to powder by hand pressure. The term includes non-friable asbestos-containing material after such previously non-friable material becomes damaged to the extent that when dry it may be crumbled, pulverized, or reduced to powder by hand pressure.\n(7)\nLocal educational agency\nThe term \u201clocal educational agency\u201d means\u2014\n(A) any local educational agency as defined in\nsection 7801 of title 20\n(B) the owner of any private, nonprofit elementary or secondary school building, and\n(C) the governing authority of any school operated under the defense dependents\u2019 education system provided for under the Defense Dependents\u2019 Education Act of 1978 (\n20 U.S.C. 921\n(8)\nMost current guidance document\nThe term \u201cmost current guidance document\u201d means the Environmental Protection Agency\u2019s \u201cGuidance for Controlling Asbestos-Containing Material in Buildings\u201d as modified by the Environmental Protection Agency after\nMarch 31, 1986\n(9)\nNon-profit elementary or secondary school\nThe term \u201cnon-profit elementary or secondary school\u201d means any elementary school or secondary school (as defined in\nsection 7801 of title 20\n(10)\nPublic and commercial building\nThe term \u201cpublic and commercial building\u201d means any building which is not a school building, except that the term does not include any residential apartment building of fewer than 10 units.\n(11)\nResponse action\nThe term \u201cresponse action\u201d means methods that protect human health and the environment from asbestos-containing material.
