{"identifier":"/us/usc/t15/s2697","title":15,"num":"\u00a7\u202f2697.","heading":"Formaldehyde standards","text":"\u00a7\u202f2697.\nFormaldehyde standards\n(a)\nDefinitions\nIn this section:\n(1)\nFinished good\n(A)\nIn general\nThe term \u201cfinished good\u201d means any good or product (other than a panel) containing\u2014\n(i) hardwood plywood;\n(ii) particleboard; or\n(iii) medium-density fiberboard.\n(B)\nExclusions\nThe term \u201cfinished good\u201d does not include\u2014\n(i) any component part or other part used in the assembly of a finished good; or\n(ii) any finished good that has previously been sold or supplied to an individual or entity that purchased or acquired the finished good in good faith for purposes other than resale, such as\u2014\n(I) an antique; or\n(II) secondhand furniture.\n(2)\nHardboard\nThe term \u201chardboard\u201d has such meaning as the Administrator shall establish, by regulation, pursuant to subsection (d).\n(3)\nHardwood plywood\n(A)\nIn general\nThe term \u201chardwood plywood\u201d means a hardwood or decorative panel that is\u2014\n(i) intended for interior use; and\n(ii) composed of (as determined under the standard numbered ANSI/HPVA HP\u20131\u20132009) an assembly of layers or plies of veneer, joined by an adhesive with\u2014\n(I) lumber core;\n(II) particleboard core;\n(III) medium-density fiberboard core;\n(IV) hardboard core; or\n(V) any other special core or special back material.\n(B)\nExclusions\nThe term \u201chardwood plywood\u201d does not include\u2014\n(i) military-specified plywood;\n(ii) curved plywood; or\n(iii) any other product specified in\u2014\n(I) the standard entitled \u201cVoluntary Product Standard\u2014Structural Plywood\u201d and numbered PS 1\u201307; or\n(II) the standard entitled \u201cVoluntary Product Standard\u2014Performance Standard for Wood-Based Structural-Use Panels\u201d and numbered PS 2\u201304.\n(C)\nLaminated products\n(i)\nRulemaking\n(I)\nIn general\nThe Administrator shall conduct a rulemaking process pursuant to subsection (d) that uses all available and relevant information from State authorities, industry, and other available sources of such information, and analyzes that information to determine, at the discretion of the Administrator, whether the definition of the term \u201chardwood plywood\u201d should exempt engineered veneer or any laminated product.\n(II)\nModification\nThe Administrator may modify any aspect of the definition contained in clause (ii) before including that definition in the regulations promulgated pursuant to subclause (I).\n(ii)\nLaminated product\nThe term \u201claminated product\u201d means a product\u2014\n(I) in which a wood veneer is affixed to\u2014\n(aa) a particleboard platform;\n(bb) a medium-density fiberboard platform; or\n(cc) a veneer-core platform; and\n(II) that is\u2014\n(aa) a component part;\n(bb) used in the construction or assembly of a finished good; and\n(cc) produced by the manufacturer or fabricator of the finished good in which the product is incorporated.\n(4)\nManufactured home\nThe term \u201cmanufactured home\u201d has the meaning given the term in section 3280.2 of title 24, Code of Federal Regulations (as in effect on the date of promulgation of regulations pursuant to subsection (d)).\n(5)\nMedium-density fiberboard\nThe term \u201cmedium-density fiberboard\u201d means a panel composed of cellulosic fibers made by dry forming and pressing a resinated fiber mat (as determined under the standard numbered ANSI A208.2\u20132009).\n(6)\nModular home\nThe term \u201cmodular home\u201d means a home that is constructed in a factory in 1 or more modules\u2014\n(A) each of which meet applicable State and local building codes of the area in which the home will be located; and\n(B) that are transported to the home building site, installed on foundations, and completed.\n(7)\nNo-added formaldehyde-based resin\n(A)\nIn general\n(i) The term \u201cno-added formaldehyde-based resin\u201d means a resin formulated with no added formaldehyde as part of the resin cross-linking structure in a composite wood product that meets the emission standards in subparagraph (C) as measured by\u2014\n(I) one test conducted pursuant to test method ASTM E\u20131333\u201396 (2002) or, subject to clause (ii), ASTM D\u20136007\u201302; and\n(II) 3 months of routine quality control tests pursuant to ASTM D\u20136007\u201302 or ASTM D\u20135582 or such other routine quality control test methods as may be established by the Administrator through rulemaking.\n(ii) Test results obtained under clause (i)(I) or (II) by any test method other than ASTM E\u20131333\u201396 (2002) must include a showing of equivalence by means established by the Administrator through rulemaking.\n(B)\nInclusions\nThe term \u201cno-added formaldehyde-based resin\u201d may include any resin made from\u2014\n(i) soy;\n(ii) polyvinyl acetate; or\n(iii) methylene diisocyanate.\n(C)\nEmission standards\nThe following are the emission standards for composite wood products made with no-added formaldehyde-based resins under this paragraph:\n(i) No higher than 0.04 parts per million of formaldehyde for 90 percent of the 3 months of routine quality control testing data required under subparagraph (A)(ii).\n(ii) No test result higher than 0.05 parts per million of formaldehyde for hardwood plywood and 0.06 parts per million for particleboard, medium-density fiberboard, and thin medium-density fiberboard.\n(8)\nParticleboard\n(A)\nIn general\nThe term \u201cparticleboard\u201d means a panel composed of cellulosic material in the form of discrete particles (as distinguished from fibers, flakes, or strands) that are pressed together with resin (as determined under the standard numbered ANSI A208.1\u20132009).\n(B)\nExclusions\nThe term \u201cparticleboard\u201d does not include any product specified in the standard entitled \u201cVoluntary Product Standard\u2014Performance Standard for Wood-Based Structural-Use Panels\u201d and numbered PS 2\u201304.\n(9)\nRecreational vehicle\nThe term \u201crecreational vehicle\u201d has the meaning given the term in section 3282.8 of title 24, Code of Federal Regulations (as in effect on the date of promulgation of regulations pursuant to subsection (d)).\n(10)\nUltra low-emitting formaldehyde resin\n(A)\nIn general\n(i) The term \u201cultra low-emitting formaldehyde resin\u201d means a resin in a composite wood product that meets the emission standards in subparagraph (C) as measured by\u2014\n(I) 2 quarterly tests conducted pursuant to test method ASTM E\u20131333\u201396 (2002) or, subject to clause (ii), ASTM D\u20136007\u201302; and\n(II) 6 months of routine quality control tests pursuant to ASTM D\u20136007\u201302 or ASTM D\u20135582 or such other routine quality control test methods as may be established by the Administrator through rulemaking.\n(ii) Test results obtained under clause (i)(I) or (II) by any test method other than ASTM E\u20131333\u201396 (2002) must include a showing of equivalence by means established by the Administrator through rulemaking.\n(B)\nInclusions\nThe term \u201cultra low-emitting formaldehyde resin\u201d may include\u2014\n(i) melamine-urea-formaldehyde resin;\n(ii) phenol formaldehyde resin; and\n(iii) resorcinol formaldehyde resin.\n(C)\nEmission standards\n(i) The Administrator may, pursuant to regulations issued under subsection (d), reduce the testing requirements for a manufacturer only if its product made with ultra low-emitting formaldehyde resin meets the following emission standards:\n(I) For hardwood plywood, no higher than 0.05 parts per million of formaldehyde.\n(II) For medium-density fiberboard\u2014\n(aa) no higher than 0.06 parts per million of formaldehyde for 90 percent of 6 months of routine quality control testing data required under subparagraph (A)(ii); and\n(bb) no test result higher than 0.09 parts per million of formaldehyde.\n(III) For particleboard\u2014\n(aa) no higher than 0.05 parts per million of formaldehyde for 90 percent of 6 months of routine quality control testing data required under subparagraph (A)(ii); and\n(bb) no test result higher than 0.08 parts per million of formaldehyde.\n(IV) For thin medium-density fiberboard\u2014\n(aa) no higher than 0.08 parts per million of formaldehyde for 90 percent of 6 months of routine quality control testing data required under subparagraph (A)(ii); and\n(bb) no test result higher than 0.11 parts per million of formaldehyde.\n(ii) The Administrator may not, pursuant to regulations issued under subsection (d), exempt a manufacturer from third party certification requirements unless its product made with ultra low-emitting formaldehyde resin meets the following emission standards:\n(I) No higher than 0.04 parts per million of formaldehyde for 90 percent of 6 months of routine quality control testing data required under subparagraph (A)(ii).\n(II) No test result higher than 0.05 parts per million of formaldehyde for hardwood plywood and 0.06 parts per million for particleboard, medium-density fiberboard, and thin medium-density fiberboard.\n(b)\nRequirement\n(1)\nIn general\nExcept as provided in an applicable sell-through regulation promulgated pursuant to subsection (d), effective beginning on the date that is 180 days after the date of promulgation of those regulations, the emission standards described in paragraph (2), shall apply to hardwood plywood, medium-density fiberboard, and particleboard sold, supplied, offered for sale, or manufactured in the United States.\n(2)\nEmission standards\nThe emission standards referred to in paragraph (1), based on test method ASTM E\u20131333\u201396 (2002), are as follows:\n(A) For hardwood plywood with a veneer core, 0.05 parts per million of formaldehyde.\n(B) For hardwood plywood with a composite core\u2014\n(i) 0.08 parts per million of formaldehyde for any period after the effective date described in paragraph (1) and before\nJuly 1, 2012\n(ii) 0.05 parts per million of formaldehyde, effective on the later of the effective date described in paragraph (1) or\nJuly 1, 2012\n(C) For medium-density fiberboard\u2014\n(i) 0.21 parts per million of formaldehyde for any period after the effective date described in paragraph (1) and before\nJuly 1, 2011\n(ii) 0.11 parts per million of formaldehyde, effective on the later of the effective date described in paragraph (1) or\nJuly 1, 2011\n(D) For thin medium-density fiberboard\u2014\n(i) 0.21 parts per million of formaldehyde for any period after the effective date described in paragraph (1) and before\nJuly 1, 2012\n(ii) 0.13 parts per million of formaldehyde, effective on the later of the effective date described in paragraph (1) or\nJuly 1, 2012\n(E) For particleboard\u2014\n(i) 0.18 parts per million of formaldehyde for any period after the effective date described in paragraph (1) and before\nJuly 1, 2011\n(ii) 0.09 parts per million of formaldehyde, effective on the later of the effective date described in paragraph (1) or\nJuly 1, 2011\n(3)\nCompliance with emission standards\n(A) Compliance with the emission standards described in paragraph (2) shall be measured by\u2014\n(i) quarterly tests shall be\n1\n1 So in original.\n(ii) quality control tests shall be\n1\n(B) Test results obtained under subparagraph (A)(i) or (ii) by any test method other than ASTM E\u20131333\u201396 (2002) must include a showing of equivalence by means established by the Administrator through rulemaking.\n(C) Except where otherwise specified, the Administrator shall establish through rulemaking the number and frequency of tests required to demonstrate compliance with the emission standards.\n(4)\nApplicability\nThe formaldehyde emission standard referred to in paragraph (1) shall apply regardless of whether an applicable hardwood plywood, medium-density fiberboard, or particleboard is\u2014\n(A) in the form of an unfinished panel; or\n(B) incorporated into a finished good.\n(c)\nExemptions\nThe formaldehyde emission standard referred to in subsection (b)(1) shall not apply to\u2014\n(1) hardboard;\n(2) structural plywood, as specified in the standard entitled \u201cVoluntary Product Standard\u2014Structural Plywood\u201d and numbered PS 1\u201307;\n(3) structural panels, as specified in the standard entitled \u201cVoluntary Product Standard\u2014Performance Standard for Wood-Based Structural-Use Panels\u201d and numbered PS 2\u201304;\n(4) structural composite lumber, as specified in the standard entitled \u201cStandard Specification for Evaluation of Structural Composite Lumber Products\u201d and numbered ASTM D 5456\u201306;\n(5) oriented strand board;\n(6) glued laminated lumber, as specified in the standard entitled \u201cStructural Glued Laminated Timber\u201d and numbered ANSI A190.1\u20132002;\n(7) prefabricated wood I-joists, as specified in the standard entitled \u201cStandard Specification for Establishing and Monitoring Structural Capacities of Prefabricated Wood I-Joists\u201d and numbered ASTM D 5055\u201305;\n(8) finger-jointed lumber;\n(9) wood packaging (including pallets, crates, spools, and dunnage);\n(10) composite wood products used inside a new\u2014\n(A) vehicle (other than a recreational vehicle) constructed entirely from new parts that has never been\u2014\n(i) the subject of a retail sale; or\n(ii) registered with the appropriate State agency or authority responsible for motor vehicles or with any foreign state, province, or country;\n(B) rail car;\n(C) boat;\n(D) aerospace craft; or\n(E) aircraft;\n(11) windows that contain composite wood products, if the window product contains less than 5 percent by volume of hardwood plywood, particleboard, or medium-density fiberboard, combined, in relation to the total volume of the finished window product; or\n(12) exterior doors and garage doors that contain composite wood products, if\u2014\n(A) the doors are made from composite wood products manufactured with no-added formaldehyde-based resins or ultra low-emitting formaldehyde resins; or\n(B) the doors contain less than 3 percent by volume of hardwood plywood, particleboard, or medium-density fiberboard, combined, in relation to the total volume of the finished exterior door or garage door.\n(d)\nRegulations\n(1)\nIn general\nNot later than\nJanuary 1, 2013\n(2)\nInclusions\nThe regulations promulgated pursuant to paragraph (1) shall include provisions relating to\u2014\n(A) labeling;\n(B) chain of custody requirements;\n(C) sell-through provisions;\n(D) ultra low-emitting formaldehyde resins;\n(E) no-added formaldehyde-based resins;\n(F) finished goods;\n(G) third-party testing and certification;\n(H) auditing and reporting of third-party certifiers;\n(I) recordkeeping;\n(J) enforcement;\n(K) laminated products; and\n(L) exceptions from the requirements of regulations promulgated pursuant to this subsection for products and components containing de minimis amounts of composite wood products.\nThe Administrator shall not provide under subparagraph (L) exceptions to the formaldehyde emission standard requirements in subsection (b).\n(3)\nSell-through provisions\n(A)\nIn general\nSell-through provisions established by the Administrator under this subsection, with respect to composite wood products and finished goods containing regulated composite wood products (including recreational vehicles, manufactured homes, and modular homes), shall\u2014\n(i) be based on a designated date of manufacture (which shall be no earlier than the date 180 days following the promulgation of the regulations pursuant to this subsection) of the composite wood product or finished good, rather than date of sale of the composite wood product or finished good; and\n(ii) provide that any inventory of composite wood products or finished goods containing regulated composite wood products, manufactured before the designated date of manufacture of the composite wood products or finished goods, shall not be subject to the formaldehyde emission standard requirements under subsection (b)(1).\n(B)\nImplementing regulations\nThe regulations promulgated under this subsection shall\u2014\n(i) prohibit the stockpiling of inventory to be sold after the designated date of manufacture;
