{"identifier":"/us/usc/t16/s2103d","title":16,"num":"\u00a7\u202f2103d.","heading":"Community forest and open space conservation program","text":"\u00a7\u202f2103d.\nCommunity forest and open space conservation program\n(a)\nDefinitions\nIn this section:\n(1)\nEligible entity\nThe term \u201celigible entity\u201d means a local governmental entity, Indian tribe, or nonprofit organization that owns or acquires a parcel under the program.\n(2)\nIndian tribe\nThe term \u201cIndian tribe\u201d has the meaning given the term in\nsection 5304 of title 25\n(3)\nLocal governmental entity\nThe term \u201clocal governmental entity\u201d includes any municipal government, county government, or other local government body with jurisdiction over local land use decisions.\n(4)\nNonprofit organization\nThe term \u201cnonprofit organization\u201d means any organization that\u2014\n(A) is described in\nsection 170(h)(3) of title 26\n(B) operates in accordance with 1 or more of the purposes specified in\nsection 170(h)(4)(A) of title 26\n(5)\nProgram\nThe term \u201cProgram\u201d means the community forest and open space conservation program established under subsection (b).\n(6)\nSecretary\nThe term \u201cSecretary\u201d means the Secretary of Agriculture, acting through the Chief of the Forest Service.\n(b)\nEstablishment\nThe Secretary shall establish a program, to be known as the \u201ccommunity forest and open space conservation program\u201d.\n(c)\nGrant program\n(1)\nIn general\nThe Secretary may award grants to eligible entities to acquire private forest land,\n(A) are threatened by conversion to nonforest uses; and\n(B) provide public benefits to communities, including\u2014\n(i) economic benefits through sustainable forest management;\n(ii) environmental benefits, including clean water and wildlife habitat;\n(iii) benefits from forest-based educational programs, including vocational education programs in forestry;\n(iv) benefits from serving as models of effective forest stewardship for private landowners; and\n(v) recreational benefits, including hunting and fishing.\n(2)\nFederal cost share\nAn eligible entity may receive a grant under the Program in an amount equal to not more than 50 percent of the cost of acquiring 1 or more parcels, as determined by the Secretary.\n(3)\nNon-Federal share\nAs a condition of receipt of the grant, an eligible entity that receives a grant under the Program shall provide, in cash, donation, or in kind, a non-Federal matching share in an amount that is at least equal to the amount of the grant received.\n(4)\nAppraisal of parcels\nTo determine the non-Federal share of the cost of a parcel of privately-owned forest land under paragraph (2), an eligible entity shall require appraisals of the land that comply with the Uniform Appraisal Standards for Federal Land Acquisitions developed by the Interagency Land Acquisition Conference.\n(5)\nApplication\nAn eligible entity that seeks to receive a grant under the Program shall submit to the State forester or equivalent official (or in the case of an Indian tribe, an equivalent official of the Indian tribe) an application that includes\u2014\n(A) a description of the land to be acquired;\n(B) a forest plan that provides\u2014\n(i) a description of community benefits to be achieved from the acquisition of the private forest land;
