{"identifier":"/us/usc/t16/s4003","title":16,"num":"\u00a7\u202f4003.","heading":"Definitions","text":"\u00a7\u202f4003.\nDefinitions\nAs used in this chapter, the term\u2014\n(1) \u201cconsumer education\u201d means actions undertaken to inform consumers on matters related to the consumption of fish and fish products;\n(2) \u201ccouncil\u201d means a seafood promotional council established under\nsection 4009 of this title\n(3) \u201cfish\u201d means finfish, mollusks, crustaceans, and all other forms of aquatic animal life used for human consumption; the term does not include marine mammals and seabirds;\n(4) \u201cFund\u201d means the Fisheries Promotional Fund established in\nsection 4008 of this title\n(5) \u201charvester\u201d means any individual who is in the business of catching or growing fish for purposes of sale;\n(6) \u201cimporter\u201d means any person in the business of importing fish or fish products into the United States from another country for commercial purposes or who acts as an agent, broker, or consignee for any person or nation that produces, processes or markets fish or fish products outside of the United States for sale or other commercial purpose in the United States;\n(7) \u201cmarketer\u201d means any person who is in the business of selling fish or fish products in the wholesale, retail, or restaurant trade, but whose primary business function is not the processing or packaging of fish or fish products in preparation for sale;\n(8) \u201cmarketing and promotion\u201d means an activity aimed at encouraging the consumption of fish or fish products or expanding or maintaining commercial markets for fish or fish products;\n(9) \u201cmember\u201d means any person serving on the National Council or on any council;\n(10) \u201cNational Council\u201d means the National Fish and Seafood Promotional Council established in\nsection 4004 of this title\n(11) \u201cperson\u201d means any individual, group of individuals, partnership, corporation, association, cooperative, or any private entity organized or existing under the laws of the United States or any State, commonwealth, territory or possession of the United States;\n(12) \u201cprocessor\u201d means any person who is in the business of preparing or packaging fish or fish products (including fish of the processor\u2019s own harvesting) for sale;\n(13) \u201creceiver\u201d means any person who owns fish processing vessels and any person in the business of acquiring fish directly from harvesters;\n(14) \u201cresearch\u201d means any type of research designed to advance the image, desirability, usage, marketability, production or quality of fish and fish products;\n(15) \u201csector\u201d means\u2014\n(A) the sector consisting of harvesters;\n(B) the sector consisting of importers;\n(C) the sector consisting of marketers;\n(D) the sector consisting of processors;\n(E) the sector consisting of receivers; or\n(F) the consumer sector consisting of persons professionally engaged in the dissemination of information pertaining to the nutritional benefits and preparation of fish and fish products;\n(16) \u201cSecretary\u201d means the Secretary of Commerce, or the Secretary\u2019s designee;
