{"identifier":"/us/usc/t16/s410eeee","title":16,"num":"\u00a7\u202f410eeee.","heading":"New River Gorge National Park and Preserve Designation","text":"\u00a7\u202f410eeee.\nNew River Gorge National Park and Preserve Designation\n(a)\nShort title\nThis section may be cited as the \u201cNew River Gorge National Park and Preserve Designation Act\u201d.\n(b)\nDesignation of New River Gorge National Park and New River Gorge National Preserve, West Virginia\n(1)\nRedesignation\nThe New River Gorge National River established under section 1101\n(A) the New River Gorge National Park; and\n(B) the New River Gorge National Preserve.\n(2)\nNew River Gorge National Park\nThe boundaries of the New River Gorge National Park referred to in paragraph (1)(A) shall be the boundaries depicted as \u201cProposed National Park Area\u201d on the map entitled \u201cNew River Gorge National Park and Preserve Proposed Boundary\u201d, numbered 637/163,199A, and dated September 2020.\n(3)\nNew River Gorge National Preserve; boundary\nThe boundaries of the New River Gorge National Preserve referred to in paragraph (1)(B) shall be the boundaries depicted as \u201cProposed National Preserve Area\u201d on the map entitled \u201cNew River Gorge National Park and Preserve Proposed Boundary\u201d, numbered 637/163,199A, and dated September 2020.\n(c)\nAdministration\n(1)\nIn general\nThe New River Gorge National Park and Preserve shall be administered by the Secretary of the Interior (referred to in this section as the \u201cSecretary\u201d) in accordance with\u2014\n(A) this section;\n(B) the laws generally applicable to units of the National Park System, including\u2014\n(i) section 100101(a), chapter 1003, and sections 100751(a), 100752, 100753, and 102101 of title 54; and\n(ii) chapter 3201 of title 54; and\n(C) title XI of the National Parks and Recreation Act of 1978 (\n16 U.S.C. 460m\u201315\n1\n1\n16 U.S.C. 460m\u201320\n(2)\nHunting and fishing\n(A)\nHunting\nHunting within the New River Gorge National Preserve shall be administered by the Secretary\u2014\n(i) in the same manner as hunting was administered on the day before\nDecember 27, 2020\n(ii) in accordance with\u2014\n(I) section 1106\n1\n16 U.S.C. 460m\u201320\n(II) other applicable laws.\n(B)\nFishing\nFishing within the New River Gorge National Park and Preserve shall be administered by the Secretary\u2014\n(i) in the same manner as fishing was administered within the New River Gorge National River on the day before\nDecember 27, 2020\n(ii) in accordance with\u2014\n(I) section 1106\n1\n16 U.S.C. 460m\u201320\n(II) other applicable laws.\n(C)\nPrivate land\nNothing in this section prohibits hunting, fishing, or trapping on private land in accordance with applicable State and Federal laws.\n(3)\nLand acquisition\n(A)\nAdditional land for national preserve\n(i)\nIn general\nThe Secretary may acquire land or any interest in land identified as \u201cProposed Additional Lands\u201d on the map entitled \u201cNew River Gorge National Park and Preserve Proposed Boundary\u201d, numbered 637/163,199A, and dated September 2020, by purchase from a willing seller, donation, or exchange.\n(ii)\nBoundary modification\nOn acquisition of any land or interest in land under clause (i), the Secretary shall\u2014\n(I) modify the boundary of the New River Gorge National Preserve to reflect the acquisition; and\n(II) administer the land or interest in land in accordance with the laws applicable to the New River Gorge National Preserve.\n(B)\nVisitor parking\n(i)\nIn general\nThe Secretary may acquire not more than 100 acres of land in the vicinity of the New River Gorge National Park and Preserve by purchase from a willing seller, donation, or exchange to provide for\u2014\n(I) visitor parking;
