{"identifier":"/us/usc/t16/s410sss","title":16,"num":"\u00a7\u202f410sss.","heading":"Harriet Tubman Underground Railroad National Historical Park, Maryland","text":"\u00a7\u202f410sss.\nHarriet Tubman Underground Railroad National Historical Park, Maryland\n(a)\nDefinitions\nIn this section:\n(1)\nHistorical park\nThe term \u201chistorical park\u201d means the Harriet Tubman Underground Railroad National Historical Park established by subsection (b)(1)(A).\n(2)\nMap\nThe term \u201cmap\u201d means the map entitled \u201cHarriet Tubman Underground Railroad National Historical Park, Proposed Boundary and Authorized Acquisition Areas\u201d, numbered T20/80,001A, and dated March 2014.\n(3)\nSecretary\nThe term \u201cSecretary\u201d means the Secretary of the Interior.\n(4)\nState\nThe term \u201cState\u201d means the State of Maryland.\n(b)\nHarriet Tubman Underground Railroad National Historical Park\n(1)\nEstablishment\n(A)\nIn general\nThere is established as a unit of the National Park System the Harriet Tubman Underground Railroad National Historical Park in the State, consisting of the area depicted on the map as \u201cHarriet Tubman Underground Railroad National Historical Park Boundary\u201d.\n(B)\nBoundary\nThe boundary of the historical park shall consist of\u2014\n(i) the land described in subparagraph (A); and\n(ii) any land and interests in land acquired under paragraph (3).\n(C)\nAvailability of map\nThe map shall be on file and available for public inspection in appropriate offices of the National Park Service.\n(2)\nPurpose\nThe purpose of the historical park is to preserve and interpret for the benefit of present and future generations the historical, cultural, and natural resources associated with the life of Harriet Tubman and the Underground Railroad.\n(3)\nLand acquisition\n(A)\nIn general\nThe Secretary may acquire land and interests in land within the areas depicted on the map as \u201cAuthorized Acquisition Areas for the National Historical Park\u201d only by purchase from willing sellers, donation, or exchange.\n(B)\nLimitation\nThe Secretary may not acquire land or an interest in land for purposes of this section by condemnation.\n(C)\nBoundary adjustment\nOn acquisition of land or an interest in land under subparagraph (A), the boundary of the historical park shall be adjusted to reflect the acquisition.\n(c)\nAdministration\n(1)\nIn general\nThe Secretary shall administer the historical park and the portion of the Harriet Tubman Underground Railroad National Monument administered by the National Park Service as a single unit of the National Park System, which shall be known as the \u201cHarriet Tubman Underground Railroad National Historical Park\u201d.\n(2)\nApplicable law\nThe Secretary shall administer the historical park in accordance with this section, Presidential Proclamation Number 8943 (78 Fed. Reg. 18763), and the laws generally applicable to units of the National Park System, including\u2014\n(A) the National Park System Organic Act (\n16 U.S.C. 1\n1\n1 See References in Text note below.\n(B) the Act of\nAugust 21, 1935\n16 U.S.C. 461\n1\n(3)\nInteragency agreement\nNot later than 1 year after\nDecember 19, 2014\n(4)\nInterpretive tours\nThe Secretary may provide interpretive tours to sites and resources located outside the boundary of the historical park in Caroline, Dorchester, and Talbot Counties, Maryland, relating to the life of Harriet Tubman and the Underground Railroad.\n(5)\nLand uses and agreements\nNothing in this section affects\u2014\n(A) land within the boundaries of the Blackwater National Wildlife Refuge;\n(B) agreements between the Secretary and private landowners regarding hunting, fishing, farming, or other activities; or\n(C) land use rights of private property owners within or adjacent to the historical park or the Harriet Tubman Underground Railroad National Monument, including activities or uses on private land that can be seen or heard within the historical park or the Harriet Tubman Underground Railroad National Monument.\n(6)\nAgreements\n(A)\nIn general\nThe Secretary may enter into an agreement with the State, political subdivisions of the State, colleges and universities, non-profit organizations, and individuals\u2014\n(i) to mark, interpret, and restore nationally significant historic or cultural resources relating to the life of Harriet Tubman or the Underground Railroad within the boundaries of the historical park, if the agreement provides for reasonable public access; or\n(ii) to conduct research relating to the life of Harriet Tubman and the Underground Railroad.\n(B)\nVisitor center\nThe Secretary may enter into an agreement to design, construct, operate, and maintain a joint visitor center on land owned by the State\u2014\n(i) to provide for National Park Service visitor and interpretive facilities for the historical park; and\n(ii) to provide to the Secretary, at no additional cost, sufficient office space to administer the historical park.\n(C)\nCost-sharing requirement\n(i)\nFederal share\nThe Federal share of the total cost of any activity carried out under this paragraph shall not exceed 50 percent.\n(ii)\nForm of non-Federal share\nThe non-Federal share of the cost of carrying out an activity under this paragraph may be in the form of in-kind contributions or goods or services fairly valued.\n(d)\nGeneral management plan\n(1)\nIn general\nNot later than 3 years after the date on which funds are made available to carry out this section, the Secretary shall prepare a general management plan for the historical park in accordance with\nsection 100502 of title 54\n(2)\nConsultation\nThe general management plan shall be prepared in consultation with the State (including political subdivisions of the State).\n(3)\nPublic comment\nThe Secretary shall\u2014\n(A) hold not less than 1 public meeting in the area of the historical park on the proposed general management plan, including opportunity for public comment;
