{"identifier":"/us/usc/t16/s539m\u20131","title":16,"num":"\u00a7\u202f539m\u20131.","heading":"Definitions","text":"\u00a7\u202f539m\u20131.\nDefinitions\nIn sections 539m to 539m\u201312 of this title:\n(1)\nArea\n(A)\nIn general\nThe term \u201cArea\u201d means the T\u2019uf Shur Bien Preservation Trust Area, comprised of approximately 9890 acres of land in the Cibola National Forest, as depicted on the map.\n(B)\nExclusions\nThe term \u201cArea\u201d does not include\u2014\n(i) the subdivisions;\n(ii) Pueblo-owned land;\n(iii) the crest facilities; or\n(iv) the special use permit area.\n(2)\nCrest facilities\nThe term \u201ccrest facilities\u201d means\u2014\n(A) all facilities and developments located on the crest of Sandia Mountain, including the Sandia Crest Electronic Site;\n(B) electronic site access roads;\n(C) the Crest House;\n(D) the upper terminal, restaurant, and related facilities of Sandia Peak Tram Company;\n(E) the Crest Observation Area;\n(F) parking lots;\n(G) restrooms;\n(H) the Crest Trail (Trail No. 130);\n(I) hang glider launch sites;\n(J) the Kiwanis cabin; and\n(K) the land on which the facilities described in subparagraphs (A) through (J) are located and the land extending 100 feet along terrain to the west of each such facility, unless a different distance is agreed to in writing by the Secretary and the Pueblo and documented in the survey of the Area.\n(3)\nExisting use\nThe term \u201cexisting use\u201d means a use that\u2014\n(A) is occurring in the Area as of\nFebruary 20, 2003\n(B) is authorized in the Area after\nNovember 1, 1995\nFebruary 20, 2003\n(4)\nLa Luz tract\nThe term \u201cLa Luz tract\u201d means the tract comprised of approximately 31 acres of land owned in fee by the Pueblo and depicted on the map.\n(5)\nLocal public body\nThe term \u201clocal public body\u201d means a political subdivision of the State of New Mexico (as defined in New Mexico Code 6\u20135\u20131).\n(6)\nMap\nThe term \u201cmap\u201d means the Forest Service map entitled \u201cT\u2019uf Shur Bien Preservation Trust Area\u201d and dated April 2000.\n(7)\nModified use\n(A)\nIn general\nThe term \u201cmodified use\u201d means an existing use that, at any time after\nFebruary 20, 2003\n(B)\nInclusions\nThe term \u201cmodified use\u201d includes\u2014\n(i) a trail or trailhead being modified, such as to accommodate handicapped access;\n(ii) a parking area being reconfigured (but not expanded); and\n(iii) a special use authorization for a group recreation use being authorized for a different use area or time period.\n(8)\nNew use\n(A)\nIn general\nThe term \u201cnew use\u201d means\u2014\n(i) a use that is not occurring in the Area as of\nFebruary 20, 2003\n(ii) an existing use that is being modified so as to be significantly expanded or altered in scope, dimension, or impact on the land, water, air, or wildlife resources of the Area.\n(B)\nExclusions\nThe term \u201cnew use\u201d does not include a use that\u2014\n(i) is categorically excluded from documentation requirements under the National Environmental Policy Act of 1969 (\n42 U.S.C. 4321\n(ii) is carried out to comply with the Endangered Species Act of 1973 (\n16 U.S.C. 1531\n(9)\nPiedra Lisa tract\nThe term \u201cPiedra Lisa tract\u201d means the tract comprised of approximately 160 acres of land owned by the Pueblo and depicted on the map.\n(10)\nPueblo\nThe term \u201cPueblo\u201d means the Pueblo of Sandia in its governmental capacity.\n(11)\nSecretary\nThe term \u201cSecretary\u201d means the Secretary of Agriculture, acting through the Chief of the Forest Service.\n(12)\nSettlement Agreement\nThe term \u201cSettlement Agreement\u201d means the Agreement of Compromise and Settlement dated\nApril 4, 2000\n(13)\nSpecial use permit\nThe term \u201cspecial use permit\u201d means the Special Use Permit issued\nDecember 1, 1993\n(14)\nSpecial use permit area\n(A)\nIn general\nThe term \u201cspecial use permit area\u201d means the land and facilities subject to the special use permit.\n(B)\nInclusions\nThe term \u201cspecial use permit area\u201d includes\u2014\n(i) approximately 46 acres of land used as an aerial tramway corridor;\n(ii) approximately 945 acres of land used as a ski area; and\n(III) 7 helispots.\n(15)\nSubdivision\nThe term \u201csubdivision\u201d means\u2014\n(A) the subdivision of\u2014\n(i) Sandia Heights Addition;\n(ii) Sandia Heights North Unit I, II, or 3;\n(iii) Tierra Monte;\n(iv) Valley View Acres;
