{"identifier":"/us/usc/t16/s5609","title":16,"num":"\u00a7\u202f5609.","heading":"Definitions","text":"\u00a7\u202f5609.\nDefinitions\nIn this chapter:\n(1)\n1982 Convention\nThe term \u201c1982 Convention\u201d means the United Nations Convention on the Law of the Sea of 10 December 1982.\n(2)\nAuthorized enforcement officer\nThe term \u201cauthorized enforcement officer\u201d means a person authorized to enforce this chapter, any regulation issued under this chapter, or any measure that is legally binding on the United States under the Convention.\n(3)\nCommission\nThe term \u201cCommission\u201d means the body provided for by Articles V, VI, XIII, XIV, and XV of the Convention.\n(4)\nCommissioner\nThe term \u201cCommissioner\u201d means a United States Commissioner to the Northwest Atlantic Fisheries Organization appointed under\nsection 5601 of this title\n(5)\nConvention\nThe term \u201cConvention\u201d means the Convention on Future Multilateral Cooperation in the Northwest Atlantic Fisheries, done at Ottawa on\nOctober 24, 1978\nSeptember 28, 2007\n(6)\nConvention Area\nThe term \u201cConvention Area\u201d means the waters of the Northwest Atlantic Ocean north of 35\u00b000\u2032 N and west of a line extending due north from 35\u00b000\u2032 N and 42\u00b000\u2032 W to 59\u00b000\u2032 N, thence due west to 44\u00b000\u2032 W, and thence due north to the coast of Greenland, and the waters of the Gulf of St. Lawrence, Davis Strait and Baffin Bay south of 78\u00b010\u2032 N.\n(7)\nCouncil\nThe term \u201cCouncil\u201d means the New England Fishery Management Council or the Mid-Atlantic Fishery Management Council.\n(8)\nFishery resources\n(A)\nIn general\nThe term \u201cfishery resources\u201d means all fish, mollusks, and crustaceans, including any products thereof, within the Convention Area.\n(B)\nExclusions\nThe term \u201cfishery resources\u201d does not include\u2014\n(i) sedentary species over which coastal States may exercise sovereign rights consistent with Article 77 of the 1982 Convention; or\n(ii) insofar as they are managed under other international treaties, anadromous and catadromous stocks and highly migratory species listed in Annex I of the 1982 Convention.\n(9)\nFishing activities\n(A)\nIn general\nThe term \u201cfishing activities\u201d means harvesting or processing fishery resources, or transhipping\n1\n1 So in original. resources;\n(ii) any activity that can reasonably be expected to result in locating, catching, taking, or harvesting of fishery resources for any purpose; and\n(iii) any operation at sea in support of, or in preparation for, any activity described in this paragraph.\n(C)\nExclusions\nThe term \u201cfishing activities\u201d does not include any operation related to emergencies involving the health and safety of crew members or the safety of a vessel.\n(10)\nFishing vessel\n(A)\nIn general\nThe term \u201cfishing vessel\u201d means a vessel that is or has been engaged in fishing activities.\n(B)\nInclusions\nThe term \u201cfishing vessel\u201d includes a fish processing vessel or a vessel engaged in transshipment or any other activity in preparation for or related to fishing activities, or in experimental or exploratory fishing activities.\n(11)\nOrganization\nThe term \u201cOrganization\u201d means the Northwest Atlantic Fisheries Organization provided for by Article V of the Convention.\n(12)\nPerson\nThe term \u201cperson\u201d means any individual (whether or not a citizen or national of the United States), and any corporation, partnership, association, or other entity (whether or not organized or existing under the laws of any State).\n(13)\nRepresentative\nThe term \u201cRepresentative\u201d means a United States Representative to the Northwest Atlantic Fisheries Scientific Council appointed under\nsection 5601 of this title\n(14)\nScientific council\nThe term \u201cScientific Council\u201d means the Scientific Council provided for by Articles V, VI, and VII of the Convention.\n(15)\nSecretary\nThe term \u201cSecretary\u201d means the Secretary of Commerce.\n(16)\nState\nThe term \u201cState\u201d means each of the several States of the United States, the District of Columbia, and any other commonwealth, territory, or possession of the United States.\n(17)\nTransshipment\nThe term \u201ctransshipment\u201d means the unloading of all or any of the fishery resources on board a fishing vessel to another fishing vessel either at sea or in
