{"identifier":"/us/usc/t16/s6415","title":16,"num":"\u00a7\u202f6415.","heading":"Definitions","text":"\u00a7\u202f6415.\nDefinitions\nIn this chapter:\n(1)\nAdministrator\nThe term \u201cAdministrator\u201d means the Administrator of the National Oceanic and Atmospheric Administration.\n(2)\nAlaska Native Corporation\nThe term \u201cAlaska Native Corporation\u201d has the meaning given the term \u201cNative Corporation\u201d in\nsection 1602 of title 43\n(3)\nAppropriate congressional committees\nThe term \u201cappropriate congressional committees\u201d means the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Natural Resources of the House of Representatives.\n(4)\nConservation\nThe term \u201cconservation\u201d means the use of methods and procedures necessary to preserve or sustain native corals and associated species as diverse, viable, and self-perpetuating coral reef ecosystems with minimal impacts from invasive species, including\u2014\n(A) all activities associated with resource management, such as monitoring, assessment, protection, restoration, sustainable use, management of habitat, and maintenance or augmentation of genetic diversity;\n(B) mapping;\n(C) scientific expertise and technical assistance in the development and implementation of management strategies for marine protected areas and marine resources required by Federal law;\n(D) law enforcement;\n(E) conflict resolution initiatives;\n(F) community outreach and education; and\n(G) promotion of safe and ecologically sound navigation and anchoring.\n(5)\nCoral\nThe term \u201ccoral\u201d means species of the phylum Cnidaria, including\u2014\n(A) all species of the orders Antipatharia (black corals), Scleractinia (stony corals), Alcyonacea (soft corals, organ pipe corals, gorgonians), and Helioporacea (blue coral), of the class Anthozoa; and\n(B) all species of the order Anthoathecata (fire corals and other hydrocorals) of the class Hydrozoa.\n(6)\nCoral products\nThe term \u201ccoral products\u201d means any living or dead specimens, parts, or derivatives, or any product containing specimens, parts, or derivatives, of any species of coral.\n(7)\nCoral reef\nThe term \u201ccoral reef\u201d means calcium carbonate structures in the form of a reef or shoal, composed in whole or in part by living coral, skeletal remains of coral, crustose coralline algae, and other associated sessile marine plants and animals.\n(8)\nCoral reef ecosystem\nThe term \u201ccoral reef ecosystem\u201d means\u2014\n(A) corals and other geographically and ecologically associated marine communities of other reef organisms (including reef plants and animals) associated with coral reef habitat; and\n(B) the biotic and abiotic factors and processes that control or significantly affect coral calcification rates, tissue growth, reproduction, recruitment, abundance, coral-algal symbiosis, and biodiversity in such habitat.\n(9)\nCoral reef ecosystem services\nThe term \u201ccoral reef ecosystem services\u201d means the attributes and benefits provided by coral reef ecosystems including\u2014\n(A) protection of coastal beaches, structures, and infrastructure;\n(B) habitat for organisms of economic, ecological, biomedical, medicinal, and cultural value;\n(C) serving as centers for the promulgation, performance, and training of cultural practices representative of traditional ecological knowledge; and\n(D) aesthetic value.\n(10)\nCovered Native entity\nThe term \u201ccovered Native entity\u201d means a Native entity with interests in a coral reef ecosystem.\n(11)\nCovered reef manager\nThe term \u201ccovered reef manager\u201d means\u2014\n(A) a management unit of a covered State with jurisdiction over a coral reef ecosystem;\n(B) a covered State; or\n(C) a coral reef stewardship partnership under\nsection 6405 of this title\n(12)\nCovered State\nThe term \u201ccovered State\u201d means Florida, Hawaii, and the territories of American Samoa, the Commonwealth of the Northern Mariana Islands, Guam, Puerto Rico, and the United States Virgin Islands.\n(13)\nFederal reef manager\n(A)\nIn general\nThe term \u201cFederal reef manager\u201d means\u2014\n(i) a management unit of a Federal agency specified in subparagraph (B) with lead management jurisdiction over a coral reef ecosystem; or\n(ii) a coral reef stewardship partnership under\nsection 6405(c) of this title\n(B)\nFederal agencies specified\nA Federal agency specified in this subparagraph is one of the following:\n(i) The National Oceanic and Atmospheric Administration.\n(ii) The National Park Service.\n(iii) The United States Fish and Wildlife Service.\n(iv) The Office of Insular Affairs.\n(14)\nInstitution of higher education\nThe term \u201cinstitution of higher education\u201d has the meaning given that term in\nsection 1001 of title 20\n(15)\nInterested stakeholder groups\nThe term \u201cinterested stakeholder groups\u201d means any of the following with interest in an applicable coral reef or ecologically significant unit of a coral reef:\n(A) A business.\n(B) A commercial or recreational fisherman.\n(C) A recreationalist.\n(D) A Federal, State, Tribal, or local government unit with related jurisdiction.\n(E) An institution of higher education (as such term is defined in\nsection 1001(a) of title 20\n1\n1 So in original. A closing parenthesis probably should precede the period.\n(F) A nongovernmental organization.\n(16)\nNational Coral Reef Resilience Strategy\nThe term \u201cNational Coral Reef Resilience Strategy\u201d means the National Coral Reef Resilience Strategy in effect under\nsection 6403 of this title\n(17)\nNative entity\nThe term \u201cNative entity\u201d means any of the following:\n(A) An Indian Tribe (as defined in\nsection 5304 of title 25\n(B) An Alaska Native Corporation.\n(C) The Department of Hawaiian Home Lands.\n(D) The Office of Hawaiian Affairs.\n(E) A Native Hawaiian organization (as defined in\nsection 7517 of title 20\n(18)\nNonprofit organization\nThe term \u201cnonprofit organization\u201d means any corporation, trust, association, cooperative, or other organization, not including an institution of higher education, that\u2014\n(A) is operated primarily for scientific, educational, service, charitable, or similar purposes in the public interest;\n(B) is not organized primarily for profit; and\n(C) uses net proceeds to maintain, improve, or expand the operations of the organization.\n(19)\nRestoration\nThe term \u201crestoration\u201d means the use of methods and procedures necessary to enhance, rehabilitate, recreate, or create a functioning coral reef or coral reef ecosystem, in whole or in part, within suitable waters of the historical geographic range of such ecosystems, to provide ecological, economic, cultural, or coastal resiliency services associated with healthy coral reefs and benefit native populations of coral reef organisms.\n(20)\nResilience\nThe term \u201cresilience\u201d means the capacity for corals within their native range, coral reefs, or coral reef ecosystems to resist and recover from natural and human disturbances, and maintain structure and function to provide coral reef ecosystem services, as determined by clearly identifiable, measurable, and science-based standards.\n(21)\nSecretary\nThe term \u201cSecretary\u201d means the Secretary of Commerce.\n(22)\nState\nThe term \u201cState\u201d means\u2014\n(A) any State of the United States that contains a coral reef ecosystem within its seaward boundaries;\n(B) American Samoa, the Commonwealth of the Northern Mariana Islands, Guam, Puerto Rico, or the United States Virgin Islands;
