{"identifier":"/us/usc/t16/s6592d","title":16,"num":"\u00a7\u202f6592d.","heading":"Joint Chiefs Landscape Restoration Partnership program","text":"\u00a7\u202f6592d.\nJoint Chiefs Landscape Restoration Partnership program\n(a)\nDefinitions\nIn this section:\n(1)\nChiefs\nThe term \u201cChiefs\u201d means the Chief of the Forest Service and the Chief of the Natural Resources Conservation Service.\n(2)\nEligible activity\nThe term \u201celigible activity\u201d means an activity\u2014\n(A) to reduce the risk of wildfire;\n(B) to protect water quality and supply; or\n(C) to improve wildlife habitat for at-risk species.\n(3)\nProgram\nThe term \u201cProgram\u201d means the Joint Chiefs Landscape Restoration Partnership program established under subsection (b)(1).\n(4)\nSecretary\nThe term \u201cSecretary\u201d means the Secretary of Agriculture.\n(5)\nWildland-urban interface\nThe term \u201cwildland-urban interface\u201d has the meaning given the term in\nsection 6511 of this title\n(b)\nEstablishment\n(1)\nIn general\nThe Secretary shall establish a Joint Chiefs Landscape Restoration Partnership program to improve the health and resilience of forest landscapes across National Forest System land and State, Tribal, and private land.\n(2)\nAdministration\nThe Secretary shall administer the Program by coordinating eligible activities conducted on National Forest System land and State, Tribal, or private land across a forest landscape to improve the health and resilience of the forest landscape by\u2014\n(A) assisting producers and landowners in implementing eligible activities on eligible private or Tribal land using the applicable programs and authorities administered by the Chief of the Natural Resources Conservation Service under title XII of the Food Security Act of 1985 (\n16 U.S.C. 3801\n16 U.S.C. 3831\n(B) conducting eligible activities on National Forest System land or assisting landowners in implementing eligible activities on State, Tribal, or private land using the applicable programs and authorities administered by the Chief of the Forest Service.\n(c)\nSelection of eligible activities\nThe appropriate Regional Forester and State Conservationist shall jointly submit to the Chiefs on an annual basis proposals for eligible activities under the Program.\n(d)\nEvaluation criteria\nIn evaluating and selecting proposals submitted under subsection (c), the Chiefs shall consider\u2014\n(1) criteria including whether the proposal\u2014\n(A) reduces wildfire risk in a municipal watershed or the wildland-urban interface;\n(B) was developed through a collaborative process with participation from diverse stakeholders;\n(C) increases forest workforce capacity or forest business infrastructure and development;\n(D) leverages existing authorities and non-Federal funding;\n(E) provides measurable outcomes; or\n(F) supports established State and regional priorities; and\n(2) such other criteria relating to the merits of the proposals as the Chiefs determine to be appropriate.\n(e)\nOutreach\nThe Secretary shall provide\u2014\n(1) public notice on the websites of the Forest Service and the Natural Resources Conservation Service describing\u2014\n(A) the solicitation of proposals under subsection (c); and\n(B) the criteria for selecting proposals in accordance with subsection (d); and\n(2) information relating to the Program and activities funded under the Program to States, Indian Tribes, units of local government, and private landowners.\n(f)\nExclusions\nAn eligible activity may not be carried out under the Program\u2014\n(1) in a wilderness area or designated wilderness study area;\n(2) in an inventoried roadless area;\n(3) on any Federal land on which, by Act of Congress or Presidential proclamation, the removal of vegetation is restricted or prohibited; or\n(4) in an area in which the eligible activity would be inconsistent with the applicable land and resource management plan.\n(g)\nAccountability\n(1)\nInitial report\nNot later than 1 year after\n(A) funding mechanisms for the Program;\n(B) staff capacity to carry out the Program;\n(C) privacy laws applicable to the Program;\n(D) data collection under the Program;\n(E) monitoring and outcomes under the Program; and\n(F) such other matters as the Secretary considers to be appropriate.\n(2)\nAdditional reports\nFor each of fiscal years 2022 and 2023, the Chiefs shall submit to the Committee on Agriculture, Nutrition, and Forestry and the Committee on Appropriations of the Senate and the Committee on Agriculture and the Committee on Appropriations of the House of Representatives a report describing projects for which funding is provided under the Program, including the status and outcomes of those projects.\n(h)\nFunding\n(1)\nAuthorization of appropriations\nThere is authorized to be appropriated to the Secretary to carry out the Program $90,000,000 for each of fiscal years 2022 and 2023.\n(2)\nAdditional funds\nIn addition to the funds described in paragraph (1), the Secretary may obligate available funds from accounts used to carry out the existing Joint Chiefs\u2019 Landscape Restoration Partnership prior to\nNovember 15, 2021\n(3)\nDuration of availability\nFunds made available under paragraph (1) shall remain available until expended.\n(4)\nDistribution of funds\nOf the funds made available under paragraph (1)\u2014\n(A) not less than 40 percent shall be allocated to carry out eligible activities through the Natural Resources Conservation Service;\n(B) not less than 40 percent shall be allocated to carry out eligible activities through the Forest Service;
