{"identifier":"/us/usc/t16/s8571","title":16,"num":"\u00a7\u202f8571.","heading":"Good neighbor authority for recreation","text":"\u00a7\u202f8571.\nGood neighbor authority for recreation\n(a)\nDefinitions\nIn this section:\n(1)\nAuthorized recreation services\nThe term \u201cauthorized recreation services\u201d means similar and complementary recreation enhancement or improvement services carried out\u2014\n(A) on Federal land, non-Federal land, or land owned by an Indian Tribe; and\n(B) by either the Secretary or a Governor, Indian Tribe, or county, as applicable, pursuant to a good neighbor agreement.\n(2)\nCounty\nThe term \u201ccounty\u201d means\u2014\n(A) the appropriate executive official of an affected county; or\n(B) in any case in which multiple counties are affected, the appropriate executive official of a compact of the affected counties.\n(3)\nFederal land\nThe term \u201cFederal land\u201d means land that is\u2014\n(A) owned and administered by the United States as a part of\u2014\n(i) the National Forest System; or\n(ii) the National Park System; or\n(B) public lands (as defined in\nsection 1702 of title 43\n(4)\nRecreation enhancement or improvement services\nThe term \u201crecreation enhancement or improvement services\u201d means\u2014\n(A) establishing, repairing, restoring, improving, relocating, constructing, or reconstructing new or existing\u2014\n(i) trails or trailheads;\n(ii) campgrounds and camping areas;\n(iii) cabins;\n(iv) picnic areas or other day use areas;\n(v) shooting ranges;\n(vi) restroom or shower facilities;\n(vii) paved or permanent roads or parking areas that serve existing recreation facilities or areas;\n(viii) fishing piers, wildlife viewing platforms, docks, or other constructed features at a recreation site;\n(ix) boat landings;\n(x) hunting or fishing sites;\n(xi) infrastructure within ski areas; or\n(xii) visitor centers or other interpretative sites; and\n(B) activities that create, improve, or restore access to existing recreation facilities or areas.\n(5)\nGood neighbor agreement\nThe term \u201cgood neighbor agreement\u201d means a cooperative agreement or contract (including a sole source contract) entered into between the Secretary and a Governor, Indian Tribe, or county, as applicable, to carry out authorized recreation services under this subchapter.\n(6)\nGovernor\nThe term \u201cGovernor\u201d means the Governor or any other appropriate executive official of an affected State or the Commonwealth of Puerto Rico.\n(7)\nSecretary concerned\nThe term \u201cSecretary concerned\u201d means\u2014\n(A) the Secretary of Agriculture, with respect to National Forest System land;
