{"identifier":"/us/usc/t17/s1502","title":17,"num":"\u00a7\u202f1502.","heading":"Copyright Claims Board","text":"\u00a7\u202f1502.\nCopyright Claims Board\n(a)\nIn General.\u2014\nThere is established in the Copyright Office the Copyright Claims Board, which shall serve as an alternative forum in which parties may voluntarily seek to resolve certain copyright claims regarding any category of copyrighted work, as provided in this chapter.\n(b)\nOfficers and Staff.\u2014\n(1)\nCopyright claims officers.\u2014\nThe Register of Copyrights shall recommend 3 full-time Copyright Claims Officers to serve on the Copyright Claims Board in accordance with paragraph (3)(A). The Officers shall be appointed by the Librarian of Congress to such positions after consultation with the Register of Copyrights.\n(2)\nCopyright claims attorneys.\u2014\nThe Register of Copyrights shall hire not fewer than 2 full-time Copyright Claims Attorneys to assist in the administration of the Copyright Claims Board.\n(3)\nQualifications.\u2014\n(A)\nCopyright claims officers.\u2014\n(i)\nIn general.\u2014\nEach Copyright Claims Officer shall be an attorney who has not fewer than 7 years of legal experience.\n(ii)\nExperience.\u2014\nTwo of the Copyright Claims Officers shall\u2014\n(I) have substantial experience in the evaluation, litigation, or adjudication of copyright infringement claims; and\n(II) between those 2 Officers, have represented or presided over a diversity of copyright interests, including those of both owners and users of copyrighted works.\n(iii)\nAlternative dispute resolution.\u2014\nThe Copyright Claims Officer not described in clause (ii) shall have substantial familiarity with copyright law and experience in the field of alternative dispute resolution, including the resolution of litigation matters through that method of resolution.\n(B)\nCopyright claims attorneys.\u2014\nEach Copyright Claims Attorney shall be an attorney who has not fewer than 3 years of substantial experience in copyright law.\n(4)\nCompensation.\u2014\n(A)\nCopyright claims officers.\u2014\n(i)\nDefinition.\u2014\nIn this subparagraph, the term \u201csenior level employee of the Federal Government\u201d means an employee, other than an employee in the Senior Executive Service, the position of whom is classified above GS\u201315 of the General Schedule.\n(ii)\nPay range.\u2014\nEach Copyright Claims Officer shall be compensated at a rate of pay that is not less than the minimum, and not more than the maximum, rate of pay payable for senior level employees of the Federal Government, including locality pay, as applicable.\n(B)\nCopyright claims attorneys.\u2014\nEach Copyright Claims Attorney shall be compensated at a rate of pay that is not more than the maximum rate of pay payable for level 10 of GS\u201315 of the General Schedule, including locality pay, as applicable.\n(5)\nTerms.\u2014\n(A)\nIn general.\u2014\nSubject to subparagraph (B), a Copyright Claims Officer shall serve for a renewable term of 6 years.\n(B)\nInitial terms.\u2014\nThe terms for the first Copyright Claims Officers appointed under this chapter shall be as follows:\n(i) The first such Copyright Claims Officer appointed shall be appointed for a term of 4 years.\n(ii) The second Copyright Claims Officer appointed shall be appointed for a term of 5 years.\n(iii) The third Copyright Claims Officer appointed shall be appointed for a term of 6 years.\n(6)\nVacancies and incapacity.\u2014\n(A)\nVacancy.\u2014\n(i)\nIn general.\u2014\nIf a vacancy occurs in the position of a Copyright Claims Officer, the Librarian of Congress shall, upon the recommendation of, and in consultation with, the Register of Copyrights, act expeditiously to appoint a Copyright Claims Officer for that position.\n(ii)\nVacancy before expiration.\u2014\nAn individual appointed to fill a vacancy occurring before the expiration of the term for which the predecessor of the individual was appointed shall be appointed to serve a 6-year term.\n(B)\nIncapacity.\u2014\nIf a Copyright Claims Officer is temporarily unable to perform the duties of the Officer, the Librarian of Congress shall, upon recommendation of, and in consultation with, the Register of Copyrights, act expeditiously to appoint an interim Copyright Claims Officer to perform such duties during the period of such incapacity.\n(7)\nSanction or removal.\u2014\nSubject to section 1503(b), the Librarian of Congress may sanction or remove a Copyright Claims Officer.\n(8)\nAdministrative support.\u2014\nThe Register of Copyrights shall provide the Copyright Claims Officers and Copyright Claims Attorneys with necessary administrative support, including technological facilities, to carry out the duties of the Officers and Attorneys under this chapter.\n(9)\nLocation of copyright claims board.\u2014\nThe offices and facilities of the Copyright Claims Officers and Copyright Claims Attorneys shall be located at the Copyright Office.","url":"https://projectusc.org/usc/t17/s1502.html","content":[{"t":"sec","id":"/us/usc/t17/s1502","children":[{"t":"num","text":"\u00a7\u202f1502."},{"t":"heading","text":"Copyright Claims Board"},{"t":"subsec","id":"/us/usc/t17/s1502/a","children":[{"t":"num","text":"(a)"},{"t":"heading","text":"In General.\u2014"},{"t":"content","text":"There is established in the Copyright Office the Copyright Claims Board, which shall serve as an alternative forum in which parties may voluntarily seek to resolve certain copyright claims regarding any category of copyrighted work, as provided in this chapter.","tail":"\n"}],"tail":"\n"},{"t":"subsec","id":"/us/usc/t17/s1502/b","children":[{"t":"num","text":"(b)"},{"t":"heading","text":"Officers and Staff.\u2014"},{"t":"para","id":"/us/usc/t17/s1502/b/1","children":[{"t":"num","text":"(1)"},{"t":"heading","text":"Copyright claims officers.\u2014"},{"t":"content","text":"The Register of Copyrights shall recommend 3 full-time Copyright Claims Officers to serve on the Copyright Claims Board in accordance with paragraph (3)(A).
