{"identifier":"/us/usc/t18/s2283","title":18,"num":"\u00a7\u202f2283.","heading":"Transportation of explosive, biological, chemical, or radioactive or nuclear materials","text":"\u00a7\u202f2283.\nTransportation of explosive, biological, chemical, or radioactive or nuclear materials\n(a)\nIn General.\u2014\nWhoever knowingly transports aboard any vessel within the United States and on waters subject to the jurisdiction of the United States or any vessel outside the United States and on the high seas or having United States nationality an explosive or incendiary device, biological agent, chemical weapon, or radioactive or nuclear material, knowing that any such item is intended to be used to commit an offense listed under section 2332b(g)(5)(B), shall be fined under this title or imprisoned for any term of years or for life, or both.\n(b)\nCausing Death.\u2014\nAny person who causes the death of a person by engaging in conduct prohibited by subsection (a) may be punished by death.\n(c)\nDefinitions.\u2014\nIn this section:\n(1)\nBiological agent.\u2014\nThe term \u201cbiological agent\u201d means any biological agent, toxin, or vector (as those terms are defined in section 178).\n(2)\nBy-product material.\u2014\nThe term \u201cby-product material\u201d has the meaning given that term in section 11(e) of the Atomic Energy Act of 1954 (\n42 U.S.C. 2014(e)\n(3)\nChemical weapon.\u2014\nThe term \u201cchemical weapon\u201d has the meaning given that term in section 229F(1).\n(4)\nExplosive or incendiary device.\u2014\nThe term \u201cexplosive or incendiary device\u201d has the meaning given the term in section 232(5) and includes explosive materials, as that term is defined in section 841(c) and explosive as defined in section 844(j).\n(5)\nNuclear material.\u2014\nThe term \u201cnuclear material\u201d has the meaning given that term in section 831(f)(1).\n1\n1 See References in Text note below.\n(6)\nRadioactive material.\u2014\nThe term \u201cradioactive material\u201d means\u2014\n(A) source material and special nuclear material, but does not include natural or depleted uranium;\n(B) nuclear by-product material;\n(C) material made radioactive by bombardment in an accelerator; or\n(D) all refined isotopes of radium.\n(8)\n22\u202fSo in original.
