{"identifier":"/us/usc/t19/s2571","title":19,"num":"\u00a7\u202f2571.","heading":"Definitions","text":"\u00a7\u202f2571.\nDefinitions\nAs used in this subchapter\u2014\n(1)\nAgreement\nThe term \u201cAgreement\u201d means the Agreement on Technical Barriers to Trade referred to in\nsection 3511(d)(5) of this title\n(2)\nConformity assessment procedure\nThe term \u201cconformity assessment procedure\u201d means any procedure used, directly or indirectly, to determine that relevant requirements in technical regulations or standards are fulfilled.\n(3)\nFederal agency\nThe term \u201cFederal agency\u201d means any of the following within the meaning of chapter 2 of part I of title 5:\n(A) Any executive department.\n(B) Any military department.\n(C) Any Government corporation.\n(D) Any Government-controlled corporation.\n(E) Any independent establishment.\n(4)\nInternational conformity assessment procedure\nThe term \u201cinternational conformity assessment procedure\u201d means a conformity assessment procedure that is adopted by an international standards organization.\n(5)\nInternational standard\nThe term \u201cinternational standard\u201d means any standard that is promulgated by an international standards organization.\n(6)\nInternational standards organization\nThe term \u201cinternational standards organization\u201d means any organization\u2014\n(A) the membership of which is open to representatives, whether public or private, of the United States and at least all Members; and\n(B) that is engaged in international standards-related activities.\n(7)\nInternational standards-related activity\nThe term \u201cinternational standards-related activity\u201d means the negotiation, development, or promulgation of, or any amendment or change to, an international standard, or an international conformity assessment procedure, or both.\n(8)\nMember\nThe term \u201cMember\u201d means a WTO member as defined in\nsection 3501(10) of this title\n(9)\nPrivate person\nThe term \u201cprivate person\u201d means\u2014\n(A) any individual who is a citizen or national of the United States; and\n(B) any corporation, partnership, association, or other legal entity organized or existing under the law of any State, whether for profit or not for profit.\n(10)\nProduct\nThe term \u201cproduct\u201d means any natural or manufactured item.\n(11)\nSecretary concerned\nThe term \u201cSecretary concerned\u201d means the Secretary of Commerce with respect to functions under this subchapter relating to non\u00adagricultural products, and the Secretary of Agriculture with respect to functions under this subchapter relating to agricultural products.\n(12)\nTrade Representative\nThe term \u201cTrade Representative\u201d means the United States Trade Representative.\n(13)\nStandard\nThe term \u201cstandard\u201d means a document approved by a recognized body, that provides, for common and repeated use, rules, guidelines, or characteristics for products or related processes and production methods, with which compliance is not mandatory. Such term may also include or deal exclusively with terminology, symbols, packaging, marking, or labeling requirements as they apply to a product, process, or production method.\n(14)\nStandards-related activity\nThe term \u201cstandards-related activity\u201d means the development, adoption, or application of any standard, technical regulation, or conformity assessment procedure.\n(15)\nState\nThe term \u201cState\u201d means any of the several States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, American Samoa, Guam and any other Commonwealth, territory, or possession of the United States.\n(16)\nState agency\nThe term \u201cState agency\u201d means any department, agency, or other instrumentality of the government of any State or of any political subdivision of any State.\n(17)\nTechnical regulation\nThe term \u201ctechnical regulation\u201d means a document which lays down product characteristics or their related processes and production methods, including the applicable administrative provisions, with which compliance is mandatory.
