{"identifier":"/us/usc/t19/s4571","title":19,"num":"\u00a7\u202f4571.","heading":"Definitions","text":"\u00a7\u202f4571.\nDefinitions\nIn this part:\n(1)\nBorder commercial zone\nThe term \u201cborder commercial zone\u201d means\u2014\n(A) the area of United States territory of the municipalities along the United States-Mexico international border and the commercial zones of such municipalities as described in subpart B of part 372 of title 49, Code of Federal Regulations; and\n(B) any additional border crossing and associated commercial zones listed in the Federal Motor Carrier Safety Administration OP\u20132 application instructions or successor documents.\n(2)\nCargo originating in Mexico\nThe term \u201ccargo originating in Mexico\u201d means any cargo that enters the United States by commercial motor vehicle from Mexico, including cargo that may have originated in a country other than Mexico.\n(3)\nChange in circumstances\nThe term \u201cchange in circumstance\u201d may include a substantial increase in services supplied by the grantee of a grant of authority.\n(4)\nCommercial motor vehicle\nThe term \u201ccommercial motor vehicle\u201d means a commercial motor vehicle, as such term is defined in paragraph (1) of\nsection 31132 of title 49\n(5)\nCross-border long-haul trucking services\nThe term \u201ccross-border long-haul trucking services\u201d means\u2014\n(A) the transportation by commercial motor vehicle of cargo originating in Mexico to a point in the United States outside of a border commercial zone; or\n(B) the transportation by commercial motor vehicle of cargo originating in the United States from a point in the United States outside of a border commercial zone to a point in a border commercial zone or a point in Mexico.\n(6)\nDriver\nThe term \u201cdriver\u201d means a person that drives a commercial motor vehicle in cross-border long-haul trucking services.\n(7)\nGrant of authority\nThe term \u201cgrant of authority\u201d means registration granted pursuant to\nsection 13902 of title 49\n(8)\nInterested party\nThe term \u201cinterested party\u201d means\u2014\n(A) persons of the United States engaged in the provision of cross-border long-haul trucking services;\n(B) a trade or business association, a majority of whose members are part of the relevant United States long-haul trucking services industry;\n(C) a certified or recognized union, or representative group of suppliers, operators, or drivers who are part of the United States long-haul trucking services industry;\n(D) the Government of Mexico; or\n(E) persons of Mexico.\n(9)\nMaterial harm\nThe term \u201cmaterial harm\u201d means a significant loss in the share of the United States market or relevant sub-market for cross-border long-haul trucking services held by persons of the United States.\n(10)\nOperator or supplier\nThe term \u201coperator\u201d or \u201csupplier\u201d means an entity that has been granted registration under\nsection 13902 of title 49\n(11)\nPersons of Mexico\nThe term \u201cpersons of Mexico\u201d includes\u2014\n(A) entities domiciled in Mexico organized, or otherwise constituted under Mexican law, including subsidiaries of United States companies domiciled in Mexico, or entities owned or controlled by a Mexican national, which conduct cross-border long-haul trucking services, or employ drivers who are non-United States nationals; and\n(B) drivers who are Mexican nationals.\n(12)\nPersons of the United States\nThe term \u201cpersons of the United States\u201d includes entities domiciled in the United States, organized or otherwise constituted under United States law, and not owned or controlled by persons of Mexico, which provide cross-border long-haul trucking services and long-haul commercial motor vehicle drivers who are United States nationals.\n(13)\nThreat of material harm\nThe term \u201cthreat of material harm\u201d means material harm that is likely to occur.\n(14)\nUnited States long-haul trucking services industry\nThe term \u201cUnited States long-haul trucking services industry\u201d means\u2014\n(A) United States suppliers, operators, or drivers as a whole providing cross-border long-haul trucking services;
