{"identifier":"/us/usc/t20/s1003","title":20,"num":"\u00a7\u202f1003.","heading":"Additional definitions","text":"\u00a7\u202f1003.\nAdditional definitions\nIn this chapter:\n(1)\nAuthorizing committees\nThe term \u201cauthorizing committees\u201d means the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Education and Labor of the House of Representatives.\n(2)\nCombination of institutions of higher education\nThe term \u201ccombination of institutions of higher education\u201d means a group of institutions of higher education that have entered into a cooperative arrangement for the purpose of carrying out a common objective, or a public or private nonprofit agency, organization, or institution designated or created by a group of institutions of higher education for the purpose of carrying out a common objective on the group\u2019s behalf.\n(3)\nCritical foreign language\nExcept as otherwise provided, the term \u201ccritical foreign language\u201d means each of the languages contained in the list of critical languages designated by the Secretary in the Federal Register on\nAugust 2, 1985\n(4)\nDepartment\nThe term \u201cDepartment\u201d means the Department of Education.\n(5)\nDiploma mill\nThe term \u201cdiploma mill\u201d means an entity that\u2014\n(A)\n(i) offers, for a fee, degrees, diplomas, or certificates, that may be used to represent to the general public that the individual possessing such a degree, diploma, or certificate has completed a program of postsecondary education or training; and\n(ii) requires such individual to complete little or no education or coursework to obtain such degree, diploma, or certificate; and\n(B) lacks accreditation by an accrediting agency or association that is recognized as an accrediting agency or association of institutions of higher education (as such term is defined in\n(i) the Secretary pursuant to subpart 2 of part H of subchapter IV; or\n(ii) a Federal agency, State government, or other organization or association that recognizes accrediting agencies or associations.\n(6)\nDisability\nThe term \u201cdisability\u201d has the same meaning given that term under\nsection 12102(2) of title 42\n(7)\nDistance education\n(A)\nIn general\nExcept as otherwise provided, the term \u201cdistance education\u201d means education that uses one or more of the technologies described in subparagraph (B)\u2014\n(i) to deliver instruction to students who are separated from the instructor; and\n(ii) to support regular and substantive interaction between the students and the instructor, synchronously or asynchronously.\n(B)\nInclusions\nFor the purposes of subparagraph (A), the technologies used may include\u2014\n(i) the Internet;\n(ii) one-way and two-way transmissions through open broadcast, closed circuit, cable, microwave, broadband lines, fiber optics, satellite, or wireless communications devices;\n(iii) audio conferencing; or\n(iv) video cassettes, DVDs, and CD\u2013ROMs, if the cassettes, DVDs, or CD\u2013ROMs are used in a course in conjunction with any of the technologies listed in clauses (i) through (iii).\n(8)\nEarly childhood education program\nThe term \u201cearly childhood education program\u201d means\u2014\n(A) a Head Start program or an Early Head Start program carried out under the Head Start Act (\n42 U.S.C. 9831\n(B) a State licensed or regulated child care program; or\n(C) a program that\u2014\n(i) serves children from birth through age six that addresses the children\u2019s cognitive (including language, early literacy, and early mathematics), social, emotional, and physical development; and\n(ii) is\u2014\n(I) a State prekindergarten program;\n(II) a program authorized under section 619 [\n20 U.S.C. 1419\n20 U.S.C. 1431\n(III) a program operated by a local educational agency.\n(9)\nElementary school\nThe term \u201celementary school\u201d has the same meaning given that term under\nsection 7801 of this title\n(10)\nGifted and talented\nThe term \u201cgifted and talented\u201d has the same meaning given that term under\nsection 7801 of this title\n(11)\nLocal educational agency\nThe term \u201clocal educational agency\u201d has the same meaning given that term under\nsection 7801 of this title\n(12)\nNew borrower\nThe term \u201cnew borrower\u201d when used with respect to any date means an individual who on that date has no outstanding balance of principal or interest owing on any loan made, insured, or guaranteed under subchapter IV.\n(13)\nNonprofit\nThe term \u201cnonprofit\u201d as applied to a school, agency, organization, or institution means a school, agency, organization, or institution owned and operated by one or more nonprofit corporations or associations, no part of the net earnings of which inures, or may lawfully inure, to the benefit of any private shareholder or individual.\n(14)\nPoverty line\nThe term \u201cpoverty line\u201d means the poverty line (as defined in\nsection 9902(2) of title 42\n(15)\nSchool or department of divinity\nThe term \u201cschool or department of divinity\u201d means an institution, or a department or a branch of an institution, the program of instruction of which is designed for the education of students\u2014\n(A) to prepare the students to become ministers of religion or to enter upon some other religious vocation (or to provide continuing training for any such vocation); or\n(B) to prepare the students to teach theological subjects.\n(16)\nSecondary school\nThe term \u201csecondary school\u201d has the same meaning given that term under\nsection 7801 of this title\n(17)\nSecretary\nThe term \u201cSecretary\u201d means the Secretary of Education.\n(18)\nService-learning\nThe term \u201cservice-learning\u201d has the same meaning given that term under section 12511(23)\n1\n1 See References in Text note below.\n(19)\nSpecial education teacher\nThe term \u201cspecial education teacher\u201d means teachers who teach children with disabilities as defined in section 602 of the Individuals with Disabilities Education Act.\n(20)\nState educational agency\nThe term \u201cState educational agency\u201d has the same meaning given that term under\nsection 7801 of this title\n(21)\nState;
