{"identifier":"/us/usc/t20/s1019","title":20,"num":"\u00a7\u202f1019.","heading":"Definitions","text":"\u00a7\u202f1019.\nDefinitions\nIn this part:\n(1)\nAgent\nThe term \u201cagent\u201d means an officer or employee of a covered institution or an institution-affiliated organization.\n(2)\nCovered institution\nThe term \u201ccovered institution\u201d means any institution of higher education, as such term is defined in\nsection 1002 of this title\n(3)\nEducation loan\nThe term \u201ceducation loan\u201d (except when used as part of the term \u201cprivate education loan\u201d) means\u2014\n(A) any loan made, insured, or guaranteed under part B of subchapter IV;\n(B) any loan made under part D of subchapter IV; or\n(C) a private education loan.\n(4)\nEligible lender\nThe term \u201celigible lender\u201d has the meaning given such term in\nsection 1085(d) of this title\n(5)\nInstitution-affiliated organization\nThe term \u201cinstitution-affiliated organization\u201d\u2014\n(A) means any organization that\u2014\n(i) is directly or indirectly related to a covered institution; and\n(ii) is engaged in the practice of recommending, promoting, or endorsing education loans for students attending such covered institution or the families of such students;\n(B) may include an alumni organization, athletic organization, foundation, or social, academic, or professional organization, of a covered institution; and\n(C) notwithstanding subparagraphs (A) and (B), does not include any lender with respect to any education loan secured, made, or extended by such lender.\n(6)\nLender\nThe term \u201clender\u201d (except when used as part of the terms \u201celigible lender\u201d and \u201cprivate educational lender\u201d)\u2014\n(A) means\u2014\n(i) in the case of a loan made, insured, or guaranteed under part B of subchapter IV, an eligible lender;\n(ii) in the case of any loan issued or provided to a student under part D of subchapter IV, the Secretary; and\n(iii) in the case of a private education loan, a private educational lender as defined in\nsection 1650 of title 15\n(B) includes any other person engaged in the business of securing, making, or extending education loans on behalf of the lender.\n(7)\nOfficer\nThe term \u201cofficer\u201d includes a director or trustee of a covered institution or institution-affiliated organization, if such individual is treated as an employee of such covered institution or institution-affiliated organization, respectively.\n(8)\nPreferred lender arrangement\nThe term \u201cpreferred lender arrangement\u201d\u2014\n(A) means an arrangement or agreement between a lender and a covered institution or an institution-affiliated organization of such covered institution\u2014\n(i) under which a lender provides or otherwise issues education loans to the students attending such covered institution or the families of such students; and\n(ii) that relates to such covered institution or such institution-affiliated organization recommending, promoting, or endorsing the education loan products of the lender; and\n(B) does not include\u2014\n(i) arrangements or agreements with respect to loans under part D of subchapter IV;
