{"identifier":"/us/usc/t20/s1432","title":20,"num":"\u00a7\u202f1432.","heading":"Definitions","text":"\u00a7\u202f1432.\nDefinitions\nIn this subchapter:\n(1)\nAt-risk infant or toddler\nThe term \u201cat-risk infant or toddler\u201d means an individual under 3 years of age who would be at risk of experiencing a substantial developmental delay if early intervention services were not provided to the individual.\n(2)\nCouncil\nThe term \u201ccouncil\u201d means a State interagency coordinating council established under\nsection 1441 of this title\n(3)\nDevelopmental delay\nThe term \u201cdevelopmental delay\u201d, when used with respect to an individual residing in a State, has the meaning given such term by the State under\nsection 1435(a)(1) of this title\n(4)\nEarly intervention services\nThe term \u201cearly intervention services\u201d means developmental services that\u2014\n(A) are provided under public supervision;\n(B) are provided at no cost except where Federal or State law provides for a system of payments by families, including a schedule of sliding fees;\n(C) are designed to meet the developmental needs of an infant or toddler with a disability, as identified by the individualized family service plan team, in any 1 or more of the following areas:\n(i) physical development;\n(ii) cognitive development;\n(iii) communication development;\n(iv) social or emotional development; or\n(v) adaptive development;\n(D) meet the standards of the State in which the services are provided, including the requirements of this subchapter;\n(E) include\u2014\n(i) family training, counseling, and home visits;\n(ii) special instruction;\n(iii) speech-language pathology and audiology services, and sign language and cued language services;\n(iv) occupational therapy;\n(v) physical therapy;\n(vi) psychological services;\n(vii) service coordination services;\n(viii) medical services only for diagnostic or evaluation purposes;\n(ix) early identification, screening, and assessment services;\n(x) health services necessary to enable the infant or toddler to benefit from the other early intervention services;\n(xi) social work services;\n(xii) vision services;\n(xiii) assistive technology devices and assistive technology services; and\n(xiv) transportation and related costs that are necessary to enable an infant or toddler and the infant\u2019s or toddler\u2019s family to receive another service described in this paragraph;\n(F) are provided by qualified personnel, including\u2014\n(i) special educators;\n(ii) speech-language pathologists and audiologists;\n(iii) occupational therapists;\n(iv) physical therapists;\n(v) psychologists;\n(vi) social workers;\n(vii) nurses;\n(viii) registered dietitians;\n(ix) family therapists;\n(x) vision specialists, including ophthalmologists and optometrists;\n(xi) orientation and mobility specialists; and\n(xii) pediatricians and other physicians;\n(G) to the maximum extent appropriate, are provided in natural environments, including the home, and community settings in which children without disabilities participate; and\n(H) are provided in conformity with an individualized family service plan adopted in accordance with\nsection 1436 of this title\n(5)\nInfant or toddler with a disability\nThe term \u201cinfant or toddler with a disability\u201d\u2014\n(A) means an individual under 3 years of age who needs early intervention services because the individual\u2014\n(i) is experiencing developmental delays, as measured by appropriate diagnostic instruments and procedures in 1 or more of the areas of cognitive development, physical development, communication development, social or emotional development, and adaptive development; or\n(ii) has a diagnosed physical or mental condition that has a high probability of resulting in developmental delay; and\n(B) may also include, at a State\u2019s discretion\u2014\n(i) at-risk infants and toddlers;
