{"identifier":"/us/usc/t22/s6701","title":22,"num":"\u00a7\u202f6701.","heading":"Definitions","text":"\u00a7\u202f6701.\nDefinitions\nIn this chapter:\n(1)\nChemical weapon\nThe term \u201cchemical weapon\u201d means the following, together or separately:\n(A) A toxic chemical and its precursors, except where intended for a purpose not prohibited under this chapter as long as the type and quantity is consistent with such a purpose.\n(B) A munition or device, specifically designed to cause death or other harm through toxic properties of those toxic chemicals specified in subparagraph (A), which would be released as a result of the employment of such munition or device.\n(C) Any equipment specifically designed for use directly in connection with the employment of munitions or devices specified in subparagraph (B).\n(2)\nChemical Weapons Convention; Convention\nThe terms \u201cChemical Weapons Convention\u201d and \u201cConvention\u201d mean the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction, opened for signature on\nJanuary 13, 1993\n(3)\nKey component of a binary or multicomponent chemical system\nThe term \u201ckey component of a binary or multicomponent chemical system\u201d means the precursor which plays the most important role in determining the toxic properties of the final product and reacts rapidly with other chemicals in the binary or multicomponent system.\n(4)\nNational of the United States\nThe term \u201cnational of the United States\u201d has the same meaning given such term in\nsection 1101(a)(22) of title 8\n(5)\nOrganization\nThe term \u201cOrganization\u201d means the Organization for the Prohibition of Chemical Weapons.\n(6)\nPerson\nThe term \u201cperson\u201d, except as otherwise provided, means any individual, corporation, partnership, firm, association, trust, estate, public or private institution, any State or any political subdivision thereof, or any political entity within a State, any foreign government or nation or any agency, instrumentality or political subdivision of any such government or nation, or other entity located in the United States.\n(7)\nPrecursor\n(A)\nIn general\nThe term \u201cprecursor\u201d means any chemical reactant which takes part at any stage in the production by whatever method of a toxic chemical. The term includes any key component of a binary or multicomponent chemical system.\n(B)\nList of precursors\nPrecursors which have been identified for the application of verification measures under Article VI of the Convention are listed in schedules contained in the Annex on Chemicals of the Chemical Weapons Convention.\n(8)\nPurposes not prohibited by this chapter\nThe term \u201cpurposes not prohibited by this chapter\u201d means the following:\n(A)\nPeaceful purposes\nAny peaceful purpose related to an industrial, agricultural, research, medical, or pharmaceutical activity or other activity.\n(B)\nProtective purposes\nAny purpose directly related to protection against toxic chemicals and to protection against chemical weapons.\n(C)\nUnrelated military purposes\nAny military purpose of the United States that is not connected with the use of a chemical weapon and that is not dependent on the use of the toxic or poisonous properties of the chemical weapon to cause death or other harm.\n(D)\nLaw enforcement purposes\nAny law enforcement purpose, including any domestic riot control purpose and including imposition of capital punishment.\n(9)\nTechnical Secretariat\nThe term \u201cTechnical Secretariat\u201d means the Technical Secretariat of the Organization for the Prohibition of Chemical Weapons established by the Chemical Weapons Convention.\n(10)\nSchedule 1 chemical agent\nThe term \u201cSchedule 1 chemical agent\u201d means any of the following, together or separately:\n(A) O-Alkyl (\u2264C\n10\n(Me, Et, n-Pr or i-Pr)-phosphonofluoridates\n(e.g. Sarin: O-Isopropyl methylphosphonofluoridate Soman: O-Pinacolyl methylphosphonofluoridate).\n(B) O-Alkyl (\u2264C\n10\n(Me, Et, n-Pr or i-Pr)-phosphoramidocyanidates\n(e.g. Tabun: O-Ethyl N,N-dimethyl phosphoramidocyanidate).\n(C) O-Alkyl (H or \u2264C\n10\n(Me, Et, n-Pr or i-Pr)-aminoethyl alkyl\n(Me, Et, n-Pr or i-Pr) phosphonothiolates and corresponding alkylated or protonated salts\n(e.g. VX: O-Ethyl S-2-diisopropylaminoethyl methyl phosphonothiolate).\n(D) Sulfur mustards:\n2-Chloroethylchloromethylsulfide\nMustard gas: (Bis(2-chloroethyl)sulfide\n1\n1 So in original.
