{"identifier":"/us/usc/t25/s305e","title":25,"num":"\u00a7\u202f305e.","heading":"Cause of action for misrepresentation of Indian produced goods","text":"\u00a7\u202f305e.\nCause of action for misrepresentation of Indian produced goods\n(a)\nDefinitions\nIn this section:\n(1)\nIndian\nThe term \u201cIndian\u201d means an individual that\u2014\n(A) is a member of an Indian tribe; or\n(B) is certified as an Indian artisan by an Indian tribe.\n(2)\nIndian product\nThe term \u201cIndian product\u201d has the meaning given the term in any regulation promulgated by the Secretary.\n(3)\nIndian tribe\n(A)\nIn general\nThe term \u201cIndian tribe\u201d has the meaning given the term in\nsection 5304 of this title\n(B)\nInclusion\nThe term \u201cIndian tribe\u201d includes, for purposes of this section only, an Indian group that has been formally recognized as an Indian tribe by\u2014\n(i) a State legislature;\n(ii) a State commission; or\n(iii) another similar organization vested with State legislative tribal recognition authority.\n(4)\nSecretary\nThe term \u201cSecretary\u201d means the Secretary of the Interior.\n(b)\nInjunctive or equitable relief; damages\nA person specified in subsection (d) may, in a civil action in a court of competent jurisdiction, bring an action against a person who, directly or indirectly, offers or displays for sale or sells a good, with or without a Government trademark, in a manner that falsely suggests it is Indian produced, an Indian product, or the product of a particular Indian or Indian tribe or Indian arts and crafts organization, resident within the United States, to\u2014\n(1) obtain injunctive or other equitable relief; and\n(2) recover the greater of\u2014\n(A) treble damages; or\n(B) in the case of each aggrieved individual Indian, Indian tribe, or Indian arts and crafts organization, not less than $1,000 for each day on which the offer or display for sale or sale continues.\nFor purposes of paragraph (2)(A), damages shall include any and all gross profits accrued by the defendant as a result of the activities found to violate this subsection.\n(c)\nPunitive damages; attorney\u2019s fee\nIn addition to the relief specified in subsection (b), the court may award punitive damages and the costs of the civil action and a reasonable attorney\u2019s fee.\n(d)\nPersons that may initiate civil actions\n(1)\nIn general\nA civil action under subsection (b) may be initiated by\u2014\n(A) the Attorney General, at the request of the Secretary acting on behalf of\u2014\n(i) an Indian tribe;\n(ii) an Indian; or\n(iii) an Indian arts and crafts organization;\n(B) an Indian tribe, acting on behalf of\u2014\n(i) the Indian tribe;\n(ii) a member of that Indian tribe; or\n(iii) an Indian arts and crafts organization;\n(C) an Indian; or\n(D) an Indian arts and crafts organization.\n(2)\nDisposition of amounts recovered\n(A)\nIn general\nExcept as provided in subparagraph (B), an amount recovered in a civil action under this section shall be paid to the Indian tribe, the Indian, or the Indian arts and crafts organization on the behalf of which the civil action was initiated.\n(B)\nExceptions\n(i)\nAttorney General\nIn the case of a civil action initiated under paragraph (1)(A), the Attorney General may deduct from the amount\u2014\n(I) the amount of the cost of the civil action and reasonable attorney\u2019s fees awarded under subsection (c), to be deposited in the Treasury and credited to appropriations available to the Attorney General on the date on which the amount is recovered; and\n(II) the amount of the costs of investigation awarded under subsection (c), to reimburse the Board for the activities of the Board relating to the civil action.\n(ii)\nIndian tribe\nIn the case of a civil action initiated under paragraph (1)(B), the Indian tribe may deduct from the amount\u2014\n(I) the amount of the cost of the civil action;
