{"identifier":"/us/usc/t25/s3072","title":25,"num":"\u00a7\u202f3072.","heading":"Definitions","text":"\u00a7\u202f3072.\nDefinitions\nIn this chapter:\n(1)\nArchaeological resource\nThe term \u201carchaeological resource\u201d means an archaeological resource (as defined in\nsection 470bb of title 16\n(2)\nCultural affiliation\nThe term \u201ccultural affiliation\u201d means that there is a relationship of shared group identity that can be reasonably traced historically or prehistorically between a present day Indian Tribe or Native Hawaiian organization and an identifiable earlier group.\n(3)\nCultural item\nThe term \u201ccultural item\u201d means any 1 or more cultural items (as defined in section 2 of the Native American Graves Protection and Repatriation Act (\n25 U.S.C. 3001\n(4)\nIndian Tribe\nThe term \u201cIndian Tribe\u201d has the meaning given the term \u201cIndian tribe\u201d in section 2 of the Native American Graves Protection and Repatriation Act (\n25 U.S.C. 3001\n(5)\nItem Prohibited from Exportation\nThe term \u201cItem Prohibited from Exportation\u201d means\u2014\n(A) a cultural item prohibited from being trafficked, including through sale, purchase, use for profit, or transport for sale or profit, by\u2014\n(i) section 1170(b) of title 18\n25 U.S.C. 3001\n(ii) any other Federal law or treaty; and\n(B) an archaeological resource prohibited from being trafficked, including through sale, purchase, exchange, transport, receipt, or offer to sell, purchase, or exchange, including in interstate or foreign commerce, by\u2014\n(i) subsections (b) and (c) of\nsection 470ee of title 16\n(ii) any other Federal law or treaty.\n(6)\nItem Requiring Export Certification\n(A)\nIn general\nThe term \u201cItem Requiring Export Certification\u201d means\u2014\n(i) a cultural item; and\n(ii) an archaeological resource.\n(B)\nExclusion\nThe term \u201cItem Requiring Export Certification\u201d does not include an item described in clause (i) or (ii) of subparagraph (A) for which an Indian Tribe or Native Hawaiian organization with a cultural affiliation with the item has provided a certificate authorizing exportation of the item.\n(7)\nNative American\nThe term \u201cNative American\u201d means\u2014\n(A) Native American (as defined in section 2 of the Native American Graves Protection and Repatriation Act (\n25 U.S.C. 3001\n(B) Native Hawaiian (as so defined).\n(8)\nNative Hawaiian organization\nThe term \u201cNative Hawaiian organization\u201d has the meaning given the term in section 2 of the Native American Graves Protection and Repatriation Act (\n25 U.S.C. 3001\n(9)\nSecretary\nThe term \u201cSecretary\u201d means the Secretary of the Interior.\n(10)\nTangible cultural heritage\nThe term \u201ctangible cultural heritage\u201d means\u2014\n(A) Native American human remains;
