{"identifier":"/us/usc/t25/s4221","title":25,"num":"\u00a7\u202f4221.","heading":"Definitions","text":"\u00a7\u202f4221.\nDefinitions\nIn this subchapter:\n(1)\nDepartment of Hawaiian Home Lands; Department\nThe term \u201cDepartment of Hawaiian Home Lands\u201d or \u201cDepartment\u201d means the agency or department of the government of the State of Hawaii that is responsible for the administration of the Hawaiian Homes Commission Act, 1920 (\n42 Stat. 108\n(2)\nDirector\nThe term \u201cDirector\u201d means the Director of the Department of Hawaiian Home Lands.\n(3)\nElderly families; near-elderly families\n(A)\nIn general\nThe term \u201celderly family\u201d or \u201cnear-elderly family\u201d means a family whose head (or his or her spouse), or whose sole member, is\u2014\n(i) for an elderly family, an elderly person; or\n(ii) for a near-elderly family, a near-elderly person.\n(B)\nCertain families included\nThe term \u201celderly family\u201d or \u201cnear-elderly family\u201d includes\u2014\n(i) two or more elderly persons or near-elderly persons, as the case may be, living together; and\n(ii) one or more persons described in clause (i) living with one or more persons determined under the housing plan to be essential to their care or well-being.\n(4)\nHawaiian Home Lands\nThe term \u201cHawaiian Home Lands\u201d means lands that\u2014\n(A) have the status as Hawaiian home lands under section 204 of the Hawaiian Homes Commission Act, 1920 (\n42 Stat. 110\n(B) are acquired pursuant to that Act.\n(5)\nHousing area\nThe term \u201chousing area\u201d means an area of Hawaiian Home Lands with respect to which the Department of Hawaiian Home Lands is authorized to provide assistance for affordable housing under this chapter.\n(6)\nHousing entity\nThe term \u201chousing entity\u201d means the Department of Hawaiian Home Lands.\n(7)\nHousing plan\nThe term \u201chousing plan\u201d means a plan developed by the Department of Hawaiian Home Lands.\n(8)\nMedian income\nThe term \u201cmedian income\u201d means, with respect to an area that is a Hawaiian housing area, the greater of\u2014\n(A) the median income for the Hawaiian housing area, which shall be determined by the Secretary; or\n(B) the median income for the State of Hawaii.\n(9)\nNative Hawaiian\nThe term \u201cNative Hawaiian\u201d means any individual who is\u2014\n(A) a citizen of the United States; and\n(B) a descendant of the aboriginal people, who, prior to 1778, occupied and exercised sovereignty in the area that currently constitutes the State of Hawaii, as evidenced by\u2014\n(i) genealogical records;\n(ii) verification by kupuna (elders) or kama\u02bbaina (long-term community residents);
