{"identifier":"/us/usc/t26/s1400Z\u20131","title":26,"num":"\u00a7\u202f1400Z\u20131.","heading":"Designation","text":"\u00a7\u202f1400Z\u20131.\nDesignation\n(a)\nQualified opportunity zone defined\nFor the purposes of this subchapter, the term \u201cqualified opportunity zone\u201d means a population census tract that is a low-income community that is designated as a qualified opportunity zone.\n(b)\nDesignation\n(1)\nIn general\nFor purposes of subsection (a), a population census tract that is a low-income community is designated as a qualified opportunity zone if\u2014\n(A) not later than the end of the determination period, the chief executive officer of the State in which the tract is located\u2014\n(i) nominates the tract for designation as a qualified opportunity zone, and\n(ii) notifies the Secretary in writing of such nomination, and\n(B) the Secretary certifies such nomination and designates such tract as a qualified opportunity zone before the end of the consideration period.\n(2)\nExtension of periods\nA chief executive officer of a State may request that the Secretary extend either the determination or consideration period, or both (determined without regard to this subparagraph),\n1\n1 So in original. communities\nThe term \u201clow-income community\u201d means any population census tract if\u2014\n(A) such population census tract has a median family income that\u2014\n(i) in the case of a population census tract not located within a metropolitan area, does not exceed 70 percent of the statewide median family income, or\n(ii) in the case of a population census tract located within a metropolitan area, does not exceed 70 percent of the metropolitan area median family income, or\n(B) such population census tract\u2014\n(i) has a poverty rate of at least 20 percent, and\n(ii) has a median family income that\u2014\n(I) in the case of a population census tract not located within a metropolitan area, does not exceed 125 percent of the statewide median family income, or\n(II) in the case of a population census tract located within a metropolitan area, does not exceed 125 percent of the metropolitan area median family income.\n(2)\nDefinition of periods\n(A)\nConsideration period\nThe term \u201cconsideration period\u201d means the 30-day period beginning on the date on which the Secretary receives notice under subsection (b)(1)(A)(ii), as extended under subsection (b)(2).\n(B)\nDetermination period\nThe term \u201cdetermination period\u201d means the 90-day period beginning on the decennial determination date, as extended under subsection (b)(2).\n(C)\nDecennial determination date\nThe term \u201cdecennial determination date\u201d means\u2014\n(i) July 1, 2026\n(ii) each July 1 of the year that is 10 years after the preceding decennial determination date under this subparagraph.\n(3)\nState\nFor purposes of this section, the term \u201cState\u201d includes any possession of the United States.\n(d)\nNumber of designations\n(1)\nIn general\nExcept as provided by paragraph (2), the number of population census tracts in a State that may be designated as qualified opportunity zones under this section during any period may not exceed 25 percent of the number of low-income communities in the State.\n(2)\nException\nIf the number of low-income communities in a State is less than 100, then a total of 25 of such tracts may be designated as qualified opportunity zones during any period.\n(e)\nPeriod for which designation is in effect\n(1)\nIn general\nA designation as a qualified opportunity zone shall remain in effect for
