{"identifier":"/us/usc/t29/s1167","title":29,"num":"\u00a7\u202f1167.","heading":"Definitions and special rules","text":"\u00a7\u202f1167.\nDefinitions and special rules\nFor purposes of this part\u2014\n(1)\nGroup health plan\nThe term \u201cgroup health plan\u201d means an employee welfare benefit plan providing medical care (as defined in\nsection 213(d) of title 26\nsection 7702B(c) of title 26\nsection 9831(d)(2) of title 26\n(2)\nCovered employee\nThe term \u201ccovered employee\u201d means an individual who is (or was) provided coverage under a group health plan by virtue of the performance of services by the individual for 1 or more persons maintaining the plan (including as an employee defined in\nsection 401(c)(1) of title 26\n(3)\nQualified beneficiary\n(A)\nIn general\nThe term \u201cqualified beneficiary\u201d means, with respect to a covered employee under a group health plan, any other individual who, on the day before the qualifying event for that employee, is a beneficiary under the plan\u2014\n(i) as the spouse of the covered employee, or\n(ii) as the dependent child of the employee.\nSuch term shall also include a child who is born to or placed for adoption with the covered employee during the period of continuation coverage under this part.\n(B)\nSpecial rule for terminations and reduced employment\nIn the case of a qualifying event described in\nsection 1163(2) of this title\n(C)\nSpecial rule for retirees and widows\nIn the case of a qualifying event described in\n(i) as the spouse of the covered employee,\n(ii) as the dependent child of the employee, or\n(iii) as the surviving spouse of the covered employee.\n(4)\nEmployer\nSubsection (n) (relating to leased employees) and subsection (t) (relating to application of controlled group rules to certain employee benefits) of\nsection 414 of title 26\nsection 106 of title 26\n(5)\nOptional extension of required periods\nA group health plan shall not be treated as failing to meet the requirements of this part solely because the plan provides both\u2014\n(A) that the period of extended coverage referred to in\nsection 1162(2) of this title\n(B) that the applicable notice period provided under\nsection 1166(a)(2) of this title","url":"https://projectusc.org/usc/t29/s1167.html","content":[{"t":"sec","id":"/us/usc/t29/s1167","children":[{"t":"num","text":"\u00a7\u202f1167."},{"t":"heading","text":"Definitions and special rules","tail":"\n"},{"t":"chapeau","text":"For purposes of this part\u2014"},{"t":"para","id":"/us/usc/t29/s1167/1","children":[{"t":"num","text":"(1)"},{"t":"heading","text":"Group health plan"},{"t":"content","children":[{"t":"p","text":"The term \u201cgroup health plan\u201d means an employee welfare benefit plan providing medical care (as defined in ","children":[{"t":"ref","text":"section 213(d) of title 26","href":"/us/usc/t26/s213/d","tail":") to participants or beneficiaries directly or through insurance, reimbursement, or otherwise.
