{"identifier":"/us/usc/t29/s3102","title":29,"num":"\u00a7\u202f3102.","heading":"Definitions","text":"\u00a7\u202f3102.\nDefinitions\nIn this Act, and the core program provisions that are not in this Act, except as otherwise expressly provided:\n(1)\nAdministrative costs\nThe term \u201cadministrative costs\u201d means expenditures incurred by State boards and local boards, direct recipients (including State grant recipients under part B of subchapter I and recipients of awards under parts C and D of subchapter I), local grant recipients, local fiscal agents or local grant subrecipients, and one-stop operators in the performance of administrative functions and in carrying out activities under subchapter I that are not related to the direct provision of workforce investment services (including services to participants and employers). Such costs include both personnel and nonpersonnel costs and both direct and indirect costs.\n(2)\nAdult\nExcept as otherwise specified in\nsection 3172 of this title\n(3)\nAdult education; adult education and literacy activities\nThe terms \u201cadult education\u201d and \u201cadult education and literacy activities\u201d have the meanings given the terms in\nsection 3272 of this title\n(4)\nArea career and technical education school\nThe term \u201carea career and technical education school\u201d has the meaning given the term in\nsection 2302 of title 20\n(5)\nBasic skills deficient\nThe term \u201cbasic skills deficient\u201d means, with respect to an individual\u2014\n(A) who is a youth, that the individual has English reading, writing, or computing skills at or below the 8th grade level on a generally accepted standardized test; or\n(B) who is a youth or adult, that the individual is unable to compute or solve problems, or read, write, or speak English, at a level necessary to function on the job, in the individual\u2019s family, or in society.\n(6)\nCareer and technical education\nThe term \u201ccareer and technical education\u201d has the meaning given the term in\nsection 2302 of title 20\n(7)\nCareer pathway\nThe term \u201ccareer pathway\u201d means a combination of rigorous and high-quality education, training, and other services that\u2014\n(A) aligns with the skill needs of industries in the economy of the State or regional economy involved;\n(B) prepares an individual to be successful in any of a full range of secondary or postsecondary education options, including apprenticeships registered under the Act of\nAugust 16, 1937\n50 Stat. 664\n29 U.S.C. 50\nsection 3226 of this title\n(C) includes counseling to support an individual in achieving the individual\u2019s education and career goals;\n(D) includes, as appropriate, education offered concurrently with and in the same context as workforce preparation activities and training for a specific occupation or occupational cluster;\n(E) organizes education, training, and other services to meet the particular needs of an individual in a manner that accelerates the educational and career advancement of the individual to the extent practicable;\n(F) enables an individual to attain a secondary school diploma or its recognized equivalent, and at least 1 recognized postsecondary credential; and\n(G) helps an individual enter or advance within a specific occupation or occupational cluster.\n(8)\nCareer planning\nThe term \u201ccareer planning\u201d means the provision of a client-centered approach in the delivery of services, designed\u2014\n(A) to prepare and coordinate comprehensive employment plans, such as service strategies, for participants to ensure access to necessary workforce investment activities and supportive services, using, where feasible, computer-based technologies; and\n(B) to provide job, education, and career counseling, as appropriate during program participation and after job placement.\n(9)\nChief elected official\nThe term \u201cchief elected official\u201d means\u2014\n(A) the chief elected executive officer of a unit of general local government in a local area; and\n(B) in a case in which a local area includes more than 1 unit of general local government, the individuals designated under the agreement described in\nsection 3122(c)(1)(B) of this title\n(10)\nCommunity-based organization\nThe term \u201ccommunity-based organization\u201d means a private nonprofit organization (which may include a faith-based organization), that is representative of a community or a significant segment of a community and that has demonstrated expertise and effectiveness in the field of workforce development.\n(11)\nCompetitive integrated employment\nThe term \u201ccompetitive integrated employment\u201d has the meaning given the term in section 7 of the Rehabilitation Act of 1973 (\n29 U.S.C. 705\n(12)\nCore program\nThe term \u201ccore programs\u201d means a program authorized under a core program provision.\n(13)\nCore program provision\nThe term \u201ccore program provision\u201d means\u2014\n(A) subparts 2 and 3 of part B of subchapter I (relating to youth workforce investment activities and adult and dislocated worker employment and training activities);\n(B) subchapter II (relating to adult education and literacy activities);\n(C) sections 1 through 13 of the Wagner-Peyser Act (\n29 U.S.C. 49\n(D) title I of the Rehabilitation Act of 1973 (\n29 U.S.C. 720\n29 U.S.C. 732\n(14)\nCustomized training\nThe term \u201ccustomized training\u201d means training\u2014\n(A) that is designed to meet the specific requirements of an employer (including a group of employers);\n(B) that is conducted with a commitment by the employer to employ an individual upon successful completion of the training; and\n(C) for which the employer pays\u2014\n(i) a significant portion of the cost of training, as determined by the local board involved, taking into account the size of the employer and such other factors as the local board determines to be appropriate, which may include the number of employees participating in training, wage and benefit levels of those employees (at present and anticipated upon completion of the training), relation of the training to the competitiveness of a participant, and other employer-provided training and advancement opportunities; and\n(ii) in the case of customized training (as defined in subparagraphs (A) and (B)) involving an employer located in multiple local areas in the State, a significant portion of the cost of the training, as determined by the Governor of the State, taking into account the size of the employer and such other factors as the Governor determines to be appropriate.\n(15)\nDislocated worker\nThe term \u201cdislocated worker\u201d means an individual who\u2014\n(A)\n(i) has been terminated or laid off, or who has received a notice of termination or layoff, from employment;\n(ii)\n(I) is eligible for or has exhausted entitlement to unemployment compensation; or\n(II) has been employed for a duration sufficient to demonstrate, to the appropriate entity at a one-stop center referred to in\nsection 3151(e) of this title\n(iii) is unlikely to return to a previous industry or occupation;\n(B)\n(i) has been terminated or laid off, or has received a notice of termination or layoff, from employment as a result of any permanent closure of, or any substantial layoff at, a plant, facility, or enterprise;\n(ii) is employed at a facility at which the employer has made a general announcement that such facility will close within 180 days; or\n(iii) for purposes of eligibility to receive services other than training services described in\nsection 3174(c)(3) of this title\nsection 3174(c)(2)(A)(xii) of this title\n(C) was self-employed (including employment as a farmer, a rancher, or a fisherman) but is unemployed as a result of general economic conditions in the community in which the individual resides or because of natural disasters;\n(D) is a displaced homemaker; or\n(E)\n(i) is the spouse of a member of the Armed Forces on active duty (as defined in\nsection 101(d)(1) of title 10\n(ii) is the spouse of a member of the Armed Forces on active duty and who meets the criteria described in paragraph (16)(B).\n(16)\nDisplaced homemaker\nThe term \u201cdisplaced homemaker\u201d means an individual who has been providing unpaid services to family members in the home and who\u2014\n(A)\n(i) has been dependent on the income of another family member but is no longer supported by that income; or\n(ii) is the dependent spouse of a member of the Armed Forces on active duty (as defined in\nsection 101(d)(1) of title 10\nsection 991(b) of title 10\nsection 101(a)(13)(B) of title 10\nsection 101(16) of title 38\n(B) is unemployed or underemployed and is experiencing difficulty in obtaining or upgrading employment.\n(17)\nEconomic development agency\nThe term \u201ceconomic development agency\u201d includes a local planning or zoning commission or board, a community development agency, or another local agency or institution responsible for regulating, promoting, or assisting in local economic development.\n(18)\nEligible youth\nExcept as provided in parts C and D of subchapter I, the term \u201celigible youth\u201d means an in-school youth or out-of-school youth.\n(19)\nEmployment and training activity\nThe term \u201cemployment and training activity\u201d means an activity described in\nsection 3174 of this title\n(20)\nEnglish language acquisition program\nThe term \u201cEnglish language acquisition program\u201d has the meaning given the term in\nsection 3272 of this title\n(21)\nEnglish language learner\nThe term \u201cEnglish language learner\u201d has the meaning given the term in\nsection 3272 of this title\n(22)\nGovernor\nThe term \u201cGovernor\u201d means the chief executive of a State or an outlying area.\n(23)\nIn-demand industry sector or occupation\n(A)\nIn general\nThe term \u201cin-demand industry sector or occupation\u201d means\u2014\n(i) an industry sector that has a substantial current or potential impact (including through jobs that lead to economic self-sufficiency and opportunities for advancement) on the State, regional, or local economy, as appropriate, and that contributes to the growth or stability of other supporting businesses, or the growth of other industry sectors; or\n(ii) an occupation that currently has or is projected to have a number of positions (including positions that lead to economic self-sufficiency and opportunities for advancement) in an industry sector so as to have a significant impact on the State, regional, or local economy, as appropriate.\n(B)\nDetermination\nThe determination of whether an industry sector or occupation is in-demand under this paragraph shall be made by the State board or local board, as appropriate, using State and regional business and labor market projections, including the use of labor market information.\n(24)\nIndividual with a barrier to employment\nThe term \u201cindividual with a barrier to employment\u201d means a member of 1 or more of the following populations:\n(A) Displaced homemakers.\n(B) Low-income individuals.\n(C) Indians, Alaska Natives, and Native Hawaiians, as such terms are defined in\nsection 3221 of this title\n(D) Individuals with disabilities, including youth who are individuals with disabilities.\n(E) Older individuals.\n(F) Ex-offenders.\n(G) Homeless individuals (as defined in\nsection 12473(6) of title 34\nsection 11434a(2) of title 42\n(H) Youth who are in or have aged out of the foster care system.\n(I) Individuals who are English language learners, individuals who have low levels of literacy, and individuals facing substantial cultural barriers.\n(J) Eligible migrant and seasonal farmworkers, as defined in\nsection 3222(i) of this title\n(K) Individuals within 2 years of exhausting lifetime eligibility under part A of title IV of the Social Security Act (\n42 U.S.C. 601\n(L) Single parents (including single pregnant women).\n(M) Long-term unemployed individuals.\n(N) Such other groups as the Governor involved determines to have barriers to employment.\n(25)\nIndividual with a disability\n(A)\nIn general\nThe term \u201cindividual with a disability\u201d means an individual with a disability as defined in\nsection 12102 of title 42\n(B)\nIndividuals with disabilities\nThe term \u201cindividuals with disabilities\u201d means more than 1 individual with a disability.\n(26)\nIndustry or sector partnership\nThe term \u201cindustry or sector partnership\u201d means a workforce collaborative, convened by or acting in partnership with a State board or local board, that\u2014\n(A) organizes key stakeholders in an industry cluster into a working group that focuses on the shared goals and human resources needs of the industry cluster and that includes, at the appropriate stage of development of the partnership\u2014\n(i) representatives of multiple businesses or other employers in the industry cluster, including small and medium-sized employers when practicable;\n(ii) 1 or more representatives of a recognized State labor organization or central labor council, or another labor representative, as appropriate; and\n(iii) 1 or more representatives of an institution of higher education with, or another provider of, education or training programs that support the industry cluster; and\n(B) may include representatives of\u2014\n(i) State or local government;\n(ii) State or local economic development agencies;\n(iii) State boards or local boards, as appropriate;\n(iv) a State workforce agency or other entity providing employment services;\n(v) other State or local agencies;\n(vi) business or trade associations;\n(vii) economic development organizations;\n(viii) nonprofit organizations, community-based organizations, or intermediaries;\n(ix) philanthropic organizations;\n(x) industry associations; and\n(xi) other organizations, as determined to be necessary by the members comprising the industry or sector partnership.\n(27)\nIn-school youth\nThe term \u201cin-school youth\u201d means a youth described in\nsection 3164(a)(1)(C) of this title\n(28)\nInstitution of higher education\nThe term \u201cinstitution of higher education\u201d has the meaning given the term in\nsection 1001 of title 20\n(29)\nIntegrated education and training\nThe term \u201cintegrated education and training\u201d has the meaning given the term in\nsection 3272 of this title\n(30)\nLabor market area\nThe term \u201clabor market area\u201d means an economically integrated geographic area within which individuals can reside and find employment within a reasonable distance or can readily change employment without changing their place of residence. Such an area shall be identified in accordance with criteria used by the Bureau of Labor Statistics of the Department of Labor in defining such areas or similar criteria established by a Governor.\n(31)\nLiteracy\nThe term \u201cliteracy\u201d has the meaning given the term in\nsection 3272 of this title\n(32)\nLocal area\nThe term \u201clocal area\u201d means a local workforce investment area designated under\nsection 3121 of this title\n(33)\nLocal board\nThe term \u201clocal board\u201d means a local workforce development board established under\nsection 3122 of this title\nsection 3122(c)(4)(B)(i) of this title\n(34)\nLocal educational agency\nThe term \u201clocal educational agency\u201d has the meaning given the term in\nsection 7801 of title 20\n(35)\nLocal plan\nThe term \u201clocal plan\u201d means a plan submitted under\nsection 3123 of this title\nsection 3121(c)(3)(B) of this title\n(36)\nLow-income individual\n(A)\nIn general\nThe term \u201clow-income individual\u201d means an individual who\u2014\n(i) receives, or in the past 6 months has received, or is a member of a family that is receiving or in the past 6 months has received, assistance through the supplemental nutrition assistance program established under the Food and Nutrition Act of 2008 (\n7 U.S.C. 2011\n42 U.S.C. 601\n42 U.S.C. 1381\n(ii) is in a family with total family income that does not exceed the higher of\u2014\n(I) the poverty line; or\n(II) 70 percent of the lower living standard income level;\n(iii) is a homeless individual (as defined in\nsection 12473(6) of title 34\nsection 11434a(2) of title 42\n(iv) receives or is eligible to receive a free or reduced price lunch under the Richard B. Russell National School Lunch Act (\n42 U.S.C. 1751\n(v) is a foster child on behalf of whom State or local government payments are made; or\n(vi) is an individual with a disability whose own income meets the income requirement of clause (ii), but who is a member of a family whose income does not meet this requirement.\n(B)\nLower living standard income level\nThe term \u201clower living standard income level\u201d means that income level (adjusted for regional, metropolitan, urban, and rural differences and family size) determined annually by the Secretary of Labor based on the most recent lower living family budget issued by the Secretary.\n(37)\nNontraditional employment\nThe term \u201cnontraditional employment\u201d refers to occupations or fields of work, for which individuals from the gender involved comprise less than 25 percent of the individuals employed in each such occupation or field of work.\n(38)\nOffender\nThe term \u201coffender\u201d means an adult or juvenile\u2014\n(A) who is or has been subject to any stage of the criminal justice process, and for whom services under this Act may be beneficial; or\n(B) who requires assistance in overcoming artificial barriers to employment resulting from a record of arrest or conviction.\n(39)\nOlder individual\nThe term \u201colder individual\u201d means an individual age 55 or older.\n(40)\nOne-stop center\nThe term \u201cone-stop center\u201d means a site described in\nsection 3151(e)(2) of this title\n(41)\nOne-stop operator\nThe term \u201cone-stop operator\u201d means 1 or more entities designated or certified under\nsection 3151(d) of this title\n(42)\nOne-stop partner\nThe term \u201cone-stop partner\u201d means\u2014\n(A) an entity described in\nsection 3151(b)(1) of this title\n(B) an entity described in\nsection 3151(b)(2) of this title\n(43)\nOne-stop partner program\nThe term \u201cone-stop partner program\u201d means a program or activities described in\nsection 3151(b) of this title\n(44)\nOn-the-job training\nThe term \u201con-the-job training\u201d means training by an employer that is provided to a paid participant while engaged in productive work in a job that\u2014\n(A) provides knowledge or skills essential to the full and adequate performance of the job;\n(B) is made available through a program that provides reimbursement to the employer of up to 50 percent of the wage rate of the participant, except as provided in\nsection 3174(c)(3)(H) of this title\n(C) is limited in duration as appropriate to the occupation for which the participant is being trained, taking into account the content of the training, the prior work experience of the participant, and the service strategy of the participant, as appropriate.\n(45)\nOutlying area\nThe term \u201coutlying area\u201d means\u2014\n(A) American Samoa, Guam, the Commonwealth of the Northern Mariana Islands, and the United States Virgin Islands; and\n(B) the Republic of Palau, except during any period for which the Secretary of Labor and the Secretary of Education determine that a Compact of Free Association is in effect and contains provisions for training and education assistance prohibiting the assistance provided under this Act.\n(46)\nOut-of-school youth\nThe term \u201cout-of-school youth\u201d means a youth described in\nsection 3164(a)(1)(B) of this title\n(47)\nPay-for-performance contract strategy\nThe term \u201cpay-for-performance contract strategy\u201d means a procurement strategy that uses pay-for-performance contracts in the provision of training services described in\n(A) contracts, each of which shall specify a fixed amount that will be paid to an eligible service provider (which may include a local or national community-based organization or intermediary, community college, or other training provider, that is eligible under section 3152 or 3153 of this title, as appropriate) based on the achievement of specified levels of performance on the primary indicators of performance described in\nsection 3141(b)(2)(A) of this title\n(B) a strategy for independently validating the achievement of the performance described in subparagraph (A); and\n(C) a description of how the State or local area will reallocate funds not paid to a provider because the achievement of the performance described in subparagraph (A) did not occur, for further activities related to such a procurement strategy, subject to\nsection 3249(g)(4) of this title\n(48)\nPlanning region\nThe term \u201cplanning region\u201d means a region described in subparagraph (B) or (C) of\nsection 3121(a)(2) of this title\nsection 3122(c)(4)(B)(i) of this title\n(49)\nPoverty line\nThe term \u201cpoverty line\u201d means the poverty line (as defined by the Office of Management and Budget, and revised annually in accordance with\nsection 9902(2) of title 42\n(50)\nPublic assistance\nThe term \u201cpublic assistance\u201d means Federal, State, or local government cash payments for which eligibility is determined by a needs or income test.\n(51)\nRapid response activity\nThe term \u201crapid response activity\u201d means an activity provided by a State, or by an entity designated by a State, with funds provided by the State under\n(A) the establishment of onsite contact with employers and employee representatives\u2014\n(i) immediately after the State is notified of a current or projected permanent closure or mass layoff; or\n(ii) in the case of a disaster, immediately after the State is made aware of mass job dislocation as a result of such disaster;\n(B) the provision of information on and access to available employment and training activities;\n(C) assistance in establishing a labor-management committee, voluntarily agreed to by labor and management, with the ability to devise and implement a strategy for assessing the employment and training needs of dislocated workers and obtaining services to meet such needs;\n(D) the provision of emergency assistance adapted to the particular closure, layoff, or disaster; and\n(E) the provision of assistance to the local community in developing a coordinated response and in obtaining access to State economic development assistance.\n(52)\nRecognized postsecondary credential\nThe term \u201crecognized postsecondary credential\u201d means a credential consisting of an industry-recognized certificate or certification, a certificate of completion of an apprenticeship, a license recognized by the State involved or Federal Government, or an associate or baccalaureate degree.\n(53)\nRegion\nThe term \u201cregion\u201d, used without further description, means a region identified under\nsection 3121(a) of this title\nsection 3122(c)(4)(B)(i) of this title\nsection 3121(b)(1)(B)(ii) of this title\n(54)\nSchool dropout\nThe term \u201cschool dropout\u201d means an individual who is no longer attending any school and who has not received a secondary school diploma or its recognized equivalent.\n(55)\nSecondary school\nThe term \u201csecondary school\u201d has the meaning given the term in\nsection 7801 of title 20\n(56)\nState\nThe term \u201cState\u201d means each of the several States of the United States, the District of Columbia, and the Commonwealth of Puerto Rico.\n(57)\nState board\nThe term \u201cState board\u201d means a State workforce development board established under\nsection 3111 of this title\n(58)\nState plan\nThe term \u201cState plan\u201d, used without further description, means a unified State plan under\nsection 3112 of this title\nsection 3113 of this title\n(59)\nSupportive services\nThe term \u201csupportive services\u201d means services such as transportation, child care, dependent care, housing, and needs-related payments, that are necessary to enable an individual to participate in activities authorized under this Act.\n(60)\nTraining services\nThe term \u201ctraining services\u201d means services described in\nsection 3174(c)(3) of this title\n(61)\nUnemployed individual\nThe term \u201cunemployed individual\u201d means an individual who is without a job and who wants and is available for work. The determination of whether an individual is without a job, for purposes of this paragraph, shall be made in accordance with the criteria used by the Bureau of Labor Statistics of the Department of Labor in defining individuals as unemployed.\n(62)\nUnit of general local government\nThe term \u201cunit of general local government\u201d means any general purpose political subdivision of a State that has the power to levy taxes and spend funds, as well as general corporate and police powers.\n(63)\nVeteran; related definition\n(A)\nVeteran\nThe term \u201cveteran\u201d has the meaning given the term in\nsection 101 of title 38\n(B)\nRecently separated veteran\nThe term \u201crecently separated veteran\u201d means any veteran who applies for participation under this Act within 48 months after the discharge or release from active military, naval, or air service.\n(64)\nVocational rehabilitation program\nThe term \u201cvocational rehabilitation program\u201d means a program authorized under a provision covered under paragraph (13)(D).\n(65)\nWorkforce development activity\nThe term \u201cworkforce development activity\u201d means an activity carried out through a workforce development program.\n(66)\nWorkforce development program\nThe term \u201cworkforce development program\u201d means a program made available through a workforce development system.\n(67)\nWorkforce development system\nThe term \u201cworkforce development system\u201d means a system that makes available the core programs, the other one-stop partner programs, and any other programs providing employment and training services as identified by a State board or local board.\n(68)\nWorkforce investment activity\nThe term \u201cworkforce investment activity\u201d means an employment and training activity, and a youth workforce investment activity.\n(69)\nWorkforce preparation activities\nThe term \u201cworkforce preparation activities\u201d has the meaning given the term in\nsection 3272 of this title\n(70)\nWorkplace learning advisor\nThe term \u201cworkplace learning advisor\u201d means an individual employed by an organization who has the knowledge and skills necessary to advise other employees of that organization about the education, skill development, job training, career counseling services, and credentials, including services provided through the workforce development system, required to progress toward career goals of such employees in order to meet employer requirements related to job openings and career advancements that support economic self-sufficiency.\n(71)\nYouth workforce investment activity\nThe term \u201cyouth workforce investment activity\u201d means an activity described in\nsection 3164 of this title\nsection 3164(a)(3)(A) of this title","url":"https://projectusc.org/usc/t29/s3102.html","content":[{"t":"sec","id":"/us/usc/t29/s3102","children":[{"t":"num","text":"\u00a7\u202f3102."},{"t":"heading","text":"Definitions","tail":"\n"},{"t":"chapeau","text":"In this Act, and the core program provisions that are not in this Act, except as otherwise expressly provided:"},{"t":"para","id":"/us/usc/t29/s3102/1","children":[{"t":"num","text":"(1)"},{"t":"heading","text":"Administrative costs"},{"t":"content","children":[{"t":"p","text":"The term \u201cadministrative costs\u201d means expenditures incurred by State boards and local boards, direct recipients (including State grant recipients under part B of subchapter I and recipients of awards under parts C and D of subchapter I), local grant recipients, local fiscal agents or local grant subrecipients, and one-stop operators in the performance of administrative functions and in carrying out activities under subchapter I that are not related to the direct provision of workforce investment services (including services to participants and employers).
