{"identifier":"/us/usc/t33/s3301","title":33,"num":"\u00a7\u202f3301.","heading":"Definitions","text":"\u00a7\u202f3301.\nDefinitions\nIn this chapter, the following definitions apply:\n(1)\nAdministrator\nThe term \u201cAdministrator\u201d means the Administrator of the Federal Emergency Management Agency.\n(2)\nCanal structure\n(A)\nIn general\nThe term \u201ccanal structure\u201d means an embankment, wall, or structure along a canal or manmade watercourse that\u2014\n(i) constrains water flows;\n(ii) is subject to frequent water loading; and\n(iii) is an integral part of a flood risk reduction system that protects the leveed area from flood waters associated with hurricanes, precipitation events, seasonal high water, and other weather-related events.\n(B)\nExclusion\nThe term \u201ccanal structure\u201d does not include a barrier across a watercourse.\n(3)\nCommittee\nThe term \u201ccommittee\u201d means the Committee on Levee Safety established by\nsection 3302(a) of this title\n(4)\nFloodplain management\nThe term \u201cfloodplain management\u201d means the operation of a community program of corrective and preventative measures for reducing flood damage.\n(5)\nIndian tribe\nThe term \u201cIndian tribe\u201d has the meaning given the term in\nsection 5304 of title 25\n(6)\nInspection\nThe term \u201cinspection\u201d means an actual inspection of a levee\u2014\n(A) to establish the global information system location of the levee;\n(B) to determine the general condition of the levee; and\n(C) to estimate the number of structures and population at risk and protected by the levee that would be adversely impacted if the levee fails or water levels exceed the height of the levee.\n(7)\nLevee\n(A)\nIn general\nThe term \u201clevee\u201d means a manmade barrier (such as an embankment, floodwall, or other structure)\u2014\n(i) the primary purpose of which is to provide hurricane, storm, or flood protection relating to seasonal high water, storm surges, precipitation, or other weather events; and\n(ii) that is normally subject to water loading for only a few days or weeks during a calendar year.\n(B)\nInclusions\nThe term \u201clevee\u201d includes a levee system, including\u2014\n(i) levees and canal structures that\u2014\n(I) constrain water flows;\n(II) are subject to more frequent water loading; and\n(III) do not constitute a barrier across a watercourse; and\n(ii) roadway and railroad embankments, but only to the extent that the embankments are integral to the performance of a flood damage reduction system.\n(C)\nExclusions\nThe term \u201clevee\u201d does not include\u2014\n(i) a roadway or railroad embankment that is not integral to the performance of a flood damage reduction system;\n(ii) a canal constructed completely within natural ground without any manmade structure (such as an embankment or retaining wall to retain water or a case in which water is retained only by natural ground);\n(iii) a canal regulated by a Federal or State agency in a manner that ensures that applicable Federal safety criteria are met;\n(iv) a levee or canal structure\u2014\n(I) that is not a part of a Federal flood damage reduction system;\n(II) that is not recognized under the National Flood Insurance Program as providing protection from the 1-percent-annual-chance or greater flood;\n(III) that is not greater than 3 feet high;\n(IV) the population in the leveed area of which is less than 50 individuals; and\n(V) the leveed area of which is less than 1,000 acres; or\n(v) any shoreline protection or river bank protection system (such as revetments or barrier islands).\n(8)\nLevee feature\nThe term \u201clevee feature\u201d means a structure that is critical to the functioning of a levee, including\u2014\n(A) an embankment section;\n(B) a floodwall section;\n(C) a closure structure;\n(D) a pumping station;\n(E) an interior drainage work; and\n(F) a flood damage reduction channel.\n(9)\nLevee system\nThe term \u201clevee system\u201d means 1 or more levee segments, including all levee features that are interconnected and necessary to ensure protection of the associated leveed areas\u2014\n(A) that collectively provide flood damage reduction to a defined area; and\n(B) the failure of 1 of which may result in the failure of the entire system.\n(10)\nNational levee database\nThe term \u201cnational levee database\u201d means the levee database established under\nsection 3303 of this title\n(11)\nParticipating program\nThe term \u201cparticipating program\u201d means a levee safety program developed by a State, regional district, or Indian tribe that includes the minimum components necessary for recognition by the Secretary.\n(12)\nRegional district\nThe term \u201cregional district\u201d means a subdivision of a State government, or a subdivision of multiple State governments, that is authorized to acquire, construct, operate, and maintain projects for the purpose of flood damage reduction.\n(13)\nRehabilitation\n(A)\nIn general\nThe term \u201crehabilitation\u201d means the repair, replacement, reconstruction, removal of a levee, or reconfiguration of a levee system, including a setback levee, that is carried out to reduce flood risk, increase resiliency to extreme weather events, or meet national levee safety guidelines.\n(B)\nInclusions\nThe term \u201crehabilitation\u201d includes improvements to a levee in conjunction with any repair, replacement, reconstruction, or reconfiguration.\n(14)\nRisk\nThe term \u201crisk\u201d means a measure of the probability and severity of undesirable consequences.\n(15)\nState\nThe term \u201cState\u201d means\u2014\n(A) a State;\n(B) the District of Columbia;\n(C) the Commonwealth of Puerto Rico;
