storm damage reduction projects\n(a)\nIn general\nWith respect to a project for hurricane and storm damage reduction for which the Secretary is requiring a perpetual easement, the Secretary shall, upon request by the non-Federal interest for the project, certify real estate availability and proceed to construction of such project with a nonperpetual easement if\u2014\n(1) such certification and construction are in compliance with the terms of the report of the Chief of Engineers for the project and the applicable project partnership agreement; and\n(2) the Secretary provides the non-Federal interest with formal notice that, in the event in which the nonperpetual easement expires and is not extended, the Secretary will be unable to\u2014\n(A) fulfill the Federal responsibility with respect to the project or carry out any required nourishment of the project under the existing project authorization;\n(B) carry out repair and rehabilitation of the project under\nsection 701n of this title\n(C) provide any other relevant Federal assistance with respect to the project.\n(b)\nDisclosure\nFor any project for hurricane storm damage risk reduction, or a proposal to modify such a project, that is authorized after\nJanuary 4, 2025\n(c)\nManagement\nTo the maximum extent practicable, the Secretary shall, at the request of the non-Federal interest for a project for hurricane storm damage risk reduction, identify and accept the minimum real estate interests necessary to carry out the project, in accordance with\nsection 598b of this title\n(d)\nHurricane and storm damage reduction project implementation\n(1)\nIn general\nDuring the 2-year period beginning on\nJanuary 4, 2025\nAugust 4, 1995\nsection 701n(a) of this title\n(2)\nCovered project defined\nIn this subsection, the term \u201ccovered project\u201d means an authorized project for hurricane and storm damage reduction in any one of the following locations:\n(A) Brevard County, Canaveral Harbor, Florida \u2013 Mid Reach.\n(B) Brevard County, Canaveral Harbor, Florida \u2013 North Reach.\n(C) Brevard County, Canaveral Harbor, Florida \u2013 South Reach.\n(D) Broward County, Florida \u2013 Segment II.\n(E) Broward County, Florida \u2013 Segment III.\n(F) Dade County, Florida \u2013 Main Segment.\n(G) Dade County, Florida \u2013 Sunny Isles Segment.\n(H) Duval County, Florida.\n(I) Fort Pierce Beach, Florida.\n(J) Lee County, Florida \u2013 Captiva.\n(K) Lee County, Florida \u2013 Gasparilla.\n(L) Manatee County, Florida.\n(M) Martin County, Florida.\n(N) Nassau County, Florida.\n(O) Secretary for a covered project to comply with the memorandum of the Corps of Engineers entitled \u201cStandard Estates \u2013 Perpetual Beach Nourishment and Perpetual Restrictive Dune Easement\u201d
