{"identifier":"/us/usc/t34/s12242","title":34,"num":"\u00a7\u202f12242.","heading":"Definitions","text":"\u00a7\u202f12242.\nDefinitions\nIn this part\u2014\n\u201cchild\u201d means a person who is less than 7 years of age.\n\u201ccommunity correctional facility\u201d means a residential facility that\u2014\n(A) is used only for eligible offenders and their children under 7 years of age;\n(B) is not within the confines of a jail or prison;\n(C) houses no more than 50 prisoners in addition to their children; and\n(D) provides to inmates and their children\u2014\n(i) a safe, stable, environment for children;\n(ii) pediatric and adult medical care consistent with medical standards for correctional facilities;\n(iii) programs to improve the stability of the parent-child relationship, including educating parents regarding\u2014\n(I) child development; and\n(II) household management;\n(iv) alcoholism and drug addiction treatment for prisoners; and\n(v) programs and support services to help inmates\u2014\n(I) to improve and maintain mental and physical health, including access to counseling;\n(II) to obtain adequate housing upon release from State incarceration;\n(III) to obtain suitable education, employment, or training for employment; and\n(IV) to obtain suitable child care.\n\u201celigible offender\u201d means a primary caretaker parent who\u2014\n(A) has been sentenced to a term of imprisonment of not more than 7 years or is awaiting sentencing for a conviction punishable by such a term of imprisonment; and\n(B) has not engaged in conduct that\u2014\n(i) knowingly resulted in death or serious bodily injury;\n(ii) is a felony for a crime of violence against a person; or\n(iii) constitutes child neglect or mental, physical, or sexual abuse of a child.\n\u201cprimary caretaker parent\u201d means\u2014\n(A) a parent who has consistently assumed responsibility for the housing, health, and safety of a child prior to incarceration;
