{"identifier":"/us/usc/t38/s3765","title":38,"num":"\u00a7\u202f3765.","heading":"Definitions","text":"\u00a7\u202f3765.\nDefinitions\nFor the purposes of this subchapter\u2014\n(1) The term \u201ctrust land\u201d means any land that\u2014\n(A) is held in trust by the United States for Native Americans;\n(B) is subject to restrictions on alienation imposed by the United States on Indian lands (including native Hawaiian homelands);\n(C) is located in the State of Alaska within a region established under section 7(a) of the Alaska Native Claims Settlement Act (\n43 U.S.C. 1606(a)\n(D) is on any island in the Pacific Ocean if such land is, by cultural tradition, communally-owned land, as determined by the Secretary;\n(E) is defined by the Secretary of the Interior and recognized by the United States as land over which an Indian Tribe has governmental dominion; or\n(F) is on any land that the Secretary determines is provided to Native American veterans because of their status as Native Americans.\n(2) The term \u201cNative American veteran\u201d means any veteran who is a Native American.\n(3) The term \u201cNative American\u201d means\u2014\n(A) an Indian, as defined in section 4(d) of the Indian Self-Determination and Education Assistance Act (\n25 U.S.C. 450b(d)\n1\n1 See References in Text note below.\n(B) a native Hawaiian, as that term is defined in section 201(a)(7) of the Hawaiian Homes Commission Act, 1920 (\nPublic Law 67\u201334\n42 Stat. 108\n(C) an Alaska Native, within the meaning provided for the term \u201cNative\u201d in section 3(b) of the Alaska Native Claims Settlement Act (\n43 U.S.C. 1602(b)\n(D) a Pacific Islander, within the meaning of the Native American Programs Act of 1974 (\n42 U.S.C. 2991\n(4) The term \u201ctribal organization\u201d shall have the meaning given such term in section 4(\nl\n25 U.S.C. 450b\nl\n1\n(5) The term \u201cqualified non-Native American veteran\u201d means a veteran who\u2014\n(A) is the spouse of a Native American, but\n(B) is not a Native American.\n(6) The term \u201ccommunity development financial institution\u201d has the meaning given that term in section 103 of the Community Development Banking and Financial Institutions Act of 1994 (\n12 U.S.C. 4702\n(7) The term \u201cIndian Tribe\u201d means any Indian tribe, band, nation, or other organized group or community, including any Alaska Native village or regional or village corporation as defined in or established pursuant to the Alaska Native Claims Settlement Act (\n43 U.S.C. 1601\n(8) The term \u201cNative community development financial institution\u201d means any entity\u2014\n(A) that has been certified as a community development financial institution by the Secretary of the Treasury;\n(B) that is not less than 51 percent owned or controlled by Native Americans;
