{"identifier":"/us/usc/t4/s124","title":4,"num":"\u00a7\u202f124.","heading":"Definitions","text":"\u00a7\u202f124.\nDefinitions\nIn sections 116 through 126 of this title:\n(1)\nCharges for mobile telecommunications services.\u2014\nThe term \u201ccharges for mobile telecommunications services\u201d means any charge for, or associated with, the provision of commercial mobile radio service, as defined in section 20.3 of title 47 of the Code of Federal Regulations as in effect on\nJune 1, 1999\n(2)\nCustomer.\u2014\n(A)\nIn general.\u2014\nThe term \u201ccustomer\u201d means\u2014\n(i) the person or entity that contracts with the home service provider for mobile telecommunications services; or\n(ii) if the end user of mobile telecommunications services is not the contracting party, the end user of the mobile telecommunications service, but this clause applies only for the purpose of determining the place of primary use.\n(B) The term \u201ccustomer\u201d does not include\u2014\n(i) a reseller of mobile telecommunications service; or\n(ii) a serving carrier under an arrangement to serve the customer outside the home service provider\u2019s licensed service area.\n(3)\nDesignated database provider.\u2014\nThe term \u201cdesignated database provider\u201d means a corporation, association, or other entity representing all the political subdivisions of a State that is\u2014\n(A) responsible for providing an electronic database prescribed in section 119(a) if the State has not provided such electronic database; and\n(B) approved by municipal and county associations or leagues of the State whose responsibility it would otherwise be to provide such database prescribed by sections 116 through 126 of this title.\n(4)\nEnhanced zip code.\u2014\nThe term \u201cenhanced zip code\u201d means a United States postal zip code of 9 or more digits.\n(5)\nHome service provider.\u2014\nThe term \u201chome service provider\u201d means the facilities-based carrier or reseller with which the customer contracts for the provision of mobile telecommunications services.\n(6)\nLicensed service area.\u2014\nThe term \u201clicensed service area\u201d means the geographic area in which the home service provider is authorized by law or contract to provide commercial mobile radio service to the customer.\n(7)\nMobile telecommunications service.\u2014\nThe term \u201cmobile telecommunications service\u201d means commercial mobile radio service, as defined in section 20.3 of title 47 of the Code of Federal Regulations as in effect on\nJune 1, 1999\n(8)\nPlace of primary use.\u2014\nThe term \u201cplace of primary use\u201d means the street address representative of where the customer\u2019s use of the mobile telecommunications service primarily occurs, which must be\u2014\n(A) the residential street address or the primary business street address of the customer; and\n(B) within the licensed service area of the home service provider.\n(9)\nPrepaid telephone calling services.\u2014\nThe term \u201cprepaid telephone calling service\u201d means the right to purchase exclusively telecommunications services that must be paid for in advance, that enables the origination of calls using an access number, authorization code, or both, whether manually or electronically dialed, if the remaining amount of units of service that have been prepaid is known by the provider of the prepaid service on a continuous basis.\n(10)\nReseller.\u2014\nThe term \u201creseller\u201d\u2014\n(A) means a provider who purchases telecommunications services from another telecommunications service provider and then resells, uses as a component part of, or integrates the purchased services into a mobile telecommunications service;
