{"identifier":"/us/usc/t41/s8701","title":41,"num":"\u00a7\u202f8701.","heading":"Definitions","text":"\u00a7\u202f8701.\nDefinitions\nIn this chapter:\n(1)\nContracting agency.\u2014\nThe term \u201ccontracting agency\u201d, when used with respect to a prime contractor, means a department, agency, or establishment of the Federal Government that enters into a prime contract with a prime contractor.\n(2)\nKickback.\u2014\nThe term \u201ckickback\u201d means any money, fee, commission, credit, gift, gratuity, thing of value, or compensation of any kind that is provided to a prime contractor, prime contractor employee, subcontractor, or subcontractor employee to improperly obtain or reward favorable treatment in connection with a prime contract or a subcontract relating to a prime contract.\n(3)\nPerson.\u2014\nThe term \u201cperson\u201d means a corporation, partnership, business association of any kind, trust, joint-stock company, or individual.\n(4)\nPrime contract.\u2014\nThe term \u201cprime contract\u201d means a contract or contractual action entered into by the Federal Government to obtain supplies, materials, equipment, or services of any kind.\n(5)\nPrime contractor.\u2014\nThe term \u201cprime contractor\u201d means a person that has entered into a prime contract with the Federal Government.\n(6)\nPrime contractor employee.\u2014\nThe term \u201cprime contractor employee\u201d means an officer, partner, employee, or agent of a prime contractor.\n(7)\nSubcontract.\u2014\nThe term \u201csubcontract\u201d means a contract or contractual action entered into by a prime contractor or subcontractor to obtain supplies, materials, equipment, or services of any kind under a prime contract.\n(8)\nSubcontractor.\u2014\nThe term \u201csubcontractor\u201d\u2014\n(A) means a person, other than the prime contractor, that offers to furnish or furnishes supplies, materials, equipment, or services of any kind under a prime contract or a subcontract entered into in connection with the prime contract;
