{"identifier":"/us/usc/t42/s10362","title":42,"num":"\u00a7\u202f10362.","heading":"Definitions","text":"\u00a7\u202f10362.\nDefinitions\nIn this chapter:\n(1)\nAdministrator\nThe term \u201cAdministrator\u201d means the Administrator of the National Oceanic and Atmospheric Administration.\n(2)\nAdvisory Committee\nThe term \u201cAdvisory Committee\u201d means the National Advisory Committee on Water Information established\u2014\n(A) under the Office of Management and Budget Circular 92\u201301; and\n(B) to coordinate water data collection activities.\n(3)\nAssessment program\nThe term \u201cassessment program\u201d means the water availability and use assessment program established by the Secretary under\nsection 10368(a) of this title\n(4)\nClimate division\nThe term \u201cclimate division\u201d means 1 of the 359 divisions in the United States that represents 2 or more regions located within a State that are as climatically homogeneous as possible, as determined by the Administrator.\n(5)\nCommissioner\nThe term \u201cCommissioner\u201d means the Commissioner of Reclamation.\n(6)\nDirector\nThe term \u201cDirector\u201d means the Director of the United States Geological Survey.\n(7)\nEligible applicant\nThe term \u201celigible applicant\u201d means\u2014\n(A) any State, Indian tribe, irrigation district, or water district;\n(B) any State, regional, or local authority, the members of which include 1 or more organizations with water or power delivery authority;\n(C) any other organization with water or power delivery authority; and\n(D) any nonprofit conservation organization, if\u2014\n(i) the nonprofit conservation organization is acting in partnership with and with the agreement of an entity described in subparagraph (A), (B), or (C); or\n(ii) in the case of an application for a project to improve the condition of a natural feature or nature-based feature on Federal land, the entities described in subparagraph (A), (B), or (C) from the applicable service area have been notified of the project application and there is no written objection to the project.\n(8)\nFederal Power Marketing Administration\nThe term \u201cFederal Power Marketing Administration\u201d means\u2014\n(A) the Bonneville Power Administration;\n(B) the Southeastern Power Administration;\n(C) the Southwestern Power Administration; and\n(D) the Western Area Power Administration.\n(9)\nHydrologic accounting unit\nThe term \u201chydrologic accounting unit\u201d means 1 of the 352 river basin hydrologic accounting units used by the United States Geological Survey.\n(10)\nIndian tribe\nThe term \u201cIndian tribe\u201d has the meaning given the term in\nsection 5304 of title 25\n(11)\nMajor aquifer system\nThe term \u201cmajor aquifer system\u201d means a groundwater system that is\u2014\n(A) identified as a significant groundwater system by the Director; and\n(B) included in the Groundwater Atlas of the United States, published by the United States Geological Survey.\n(12)\nMajor reclamation river basin\n(A)\nIn general\nThe term \u201cmajor reclamation river basin\u201d means each major river system (including tributaries)\u2014\n(i) that is located in a service area of the Bureau of Reclamation; and\n(ii) at which is located a federally authorized project of the Bureau of Reclamation.\n(B)\nInclusions\nThe term \u201cmajor reclamation river basin\u201d includes\u2014\n(i) the Colorado River;\n(ii) the Columbia River;\n(iii) the Klamath River;\n(iv) the Missouri River;\n(v) the Rio Grande;\n(vi) the Sacramento River;\n(vii) the San Joaquin River; and\n(viii) the Truckee River.\n(13)\nNatural feature\nThe term \u201cnatural feature\u201d means a feature that is created through the action of physical, geological, biological, and chemical processes over time.\n(14)\nNature-based feature\nThe term \u201cnature-based feature\u201d means a feature that is created by human design, engineering, and construction to provide a means to reduce water supply and demand imbalances or drought or flood risk by acting in concert with natural processes.\n(15)\nNon-Federal participant\nThe term \u201cnon-Federal participant\u201d means\u2014\n(A) a State, regional, or local authority;\n(B) an Indian tribe or tribal organization; or\n(C) any other qualifying entity, such as a water conservation district, water conservancy district, or rural water district or association, or a nongovernmental organization.\n(16)\nPanel\nThe term \u201cpanel\u201d means the climate change and water intragovernmental panel established by the Secretary under\nsection 10366(a) of this title\n(17)\nProgram\nThe term \u201cprogram\u201d means the regional integrated sciences and assessments program\u2014\n(A) established by the Administrator; and\n(B) that is comprised of 8 regional programs that use advances in integrated climate sciences to assist decisionmaking processes.\n(18)\nSecretary\n(A)\nIn general\nExcept as provided in subparagraph (B), the term \u201cSecretary\u201d means the Secretary of the Interior.\n(B)\nExceptions\nThe term \u201cSecretary\u201d means\u2014\n(i) in the case of sections 10363, 10364, and 10369 of this title, the Secretary of the Interior (acting through the Commissioner);
