{"identifier":"/us/usc/t42/s10402","title":42,"num":"\u00a7\u202f10402.","heading":"Definitions","text":"\u00a7\u202f10402.\nDefinitions\nIn this chapter:\n(1)\nAlaska Native\nThe term \u201cAlaska Native\u201d has the meaning given the term \u201cNative\u201d in\nsection 1602 of title 43\n(2)\nDating violence\nThe term \u201cdating violence\u201d has the meaning given such term in\nsection 12291(a) of this title\n(3)\nDomestic violence\nThe term \u201cdomestic violence\u201d has the meaning given such term in\nsection 12291(a) of this title\n(4)\nFamily violence\nThe term \u201cfamily violence\u201d means any act or threatened act of violence, including any forceful detention of an individual, that\u2014\n(A) results or threatens to result in physical injury; and\n(B) is committed by a person against another individual (including an elderly individual) to or with whom such person\u2014\n(i) is related by blood;\n(ii) is or was related by marriage or is or was otherwise legally related; or\n(iii) is or was lawfully residing.\n(5)\nIndian; Indian tribe; tribal organization\nThe terms \u201cIndian\u201d, \u201cIndian tribe\u201d, and \u201ctribal organization\u201d have the meanings given such terms in\nsection 5304 of title 25\n(6)\nNative Hawaiian\nThe term \u201cNative Hawaiian\u201d has the meaning given the term in\nsection 7517 of title 20\n(7)\nPersonally identifying information\nThe term \u201cpersonally identifying information\u201d has the meaning given the term in\nsection 12291(a) of this title\n(8)\nSecretary\nThe term \u201cSecretary\u201d means the Secretary of Health and Human Services.\n(9)\nShelter\nThe term \u201cshelter\u201d means the provision of temporary refuge and supportive services in compliance with applicable State law (including regulation) governing the provision, on a regular basis, of shelter, safe homes, meals, and supportive services to victims of family violence, domestic violence, or dating violence, and their dependents.\n(10)\nState\nThe term \u201cState\u201d means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, and, except as otherwise provided, Guam, American Samoa, the United States Virgin Islands, and the Commonwealth of the Northern Mariana Islands.\n(11)\nState Domestic Violence Coalition\nThe term \u201cState Domestic Violence Coalition\u201d means a statewide nongovernmental nonprofit private domestic violence organization that\u2014\n(A) has a membership that includes a majority of the primary-purpose domestic violence service providers in the State;\n(B) has board membership that is representative of primary-purpose domestic violence service providers, and which may include representatives of the communities in which the services are being provided in the State;\n(C) has as its purpose to provide education, support, and technical assistance to such service providers to enable the providers to establish and maintain shelter and supportive services for victims of domestic violence and their dependents; and\n(D) serves as an information clearinghouse, primary point of contact, and resource center on domestic violence for the State and supports the development of polices, protocols, and procedures to enhance domestic violence intervention and prevention in the State.\n(12)\nSupportive services\nThe term \u201csupportive services\u201d means services for adult and youth victims of family violence, domestic violence, or dating violence, and dependents exposed to family violence, domestic violence, or dating violence, that are designed to\u2014\n(A) meet the needs of such victims of family violence, domestic violence, or dating violence, and their dependents, for short-term, transitional, or long-term safety;
