term \u201cillicit\u201d means unlawful or injurious,\n(7) the term \u201cinstitution of higher education\u201d has the meaning given it in\nsection 1001 of title 20\n(8) the term \u201cpublic agency\u201d has the meaning given it in\nsection 11103(11) of title 34\n(9) the term \u201cSecretary\u201d means\u2014\n(A) the Secretary of Education for purposes of subtitle A (other than section 3201),\n(B) the Secretary of Agriculture for purposes of the amendments made by section 3201, and\n(C) the Secretary of Health and Human Services for purposes of subtitle B,\n(10) the term
