{"identifier":"/us/usc/t42/s12896","title":42,"num":"\u00a7\u202f12896.","heading":"Definitions","text":"\u00a7\u202f12896.\nDefinitions\nFor purposes of this part:\n(1) The term \u201capplicant\u201d means a private nonprofit organization, cooperative association, or a public agency (including an agency or instrumentality thereof) in cooperation with a private nonprofit organization.\n(2) The term \u201cdisplaced homemaker\u201d has the same meaning as in\nsection 12704 of this title\n(3) The term \u201celigible family\u201d means a family or individual who\u2014\n(A) has an income that does not exceed 80 percent of the median income for the area, as determined by the Secretary with adjustments for smaller and larger families; and\n(B) is a first-time homebuyer.\n(4) The term \u201celigible property\u201d means a single family property, containing no more than four units, that is owned or held by the Secretary, the Secretary of Veterans Affairs, the Secretary of Agriculture, the Resolution Trust Corporation, the Federal Deposit Insurance Corporation, the Secretary of Defense, the Secretary of Transportation, the General Services Administration, any other Federal agency, a State or local government (including any in rem property), or a public housing agency or an Indian housing authority (excluding public or Indian housing under the United States Housing Act of 1937 [\n42 U.S.C. 1437\n(5) The term \u201cfirst-time homebuyer\u201d has the same meaning as in\nsection 12704 of this title\n(6) The term \u201chomeownership program\u201d means a program for homeownership under this part.\n(7) The term \u201cIndian housing authority\u201d has the meaning given such term in section 3(b)(11)\n1\n1 See References in Text note below.\n(8) The term \u201clow-income family\u201d has the meaning given such term in section 3(b)(2) of the United States Housing Act of 1937 [\n42 U.S.C. 1437a(b)(2)\n(9) The term \u201cpublic housing agency\u201d has the meaning given such term in section 3(b)(6) of the United States Housing Act of 1937 [\n42 U.S.C. 1437a(b)(6)\n(10) The term \u201crecipient\u201d means an applicant approved to receive a grant under this part or such other entity specified in the approved application that will assume the obligations of the recipient under this part.\n(11) The term \u201cSecretary\u201d means the Secretary of Housing and Urban Development.\n(12) The term \u201csingle parent\u201d means an individual who\u2014\n(A) is unmarried or legally separated from a spouse;
