Property interests relating to federally funded advanced nuclear reactor projects\n(1)\nDefinitions\nIn this section:\n(A)\nAdvanced nuclear reactor\nThe term \u201cadvanced nuclear reactor\u201d has the meaning given the term in\nsection 16271(b) of this title\n(B)\nProperty interest\n(i)\nIn general\nExcept as provided in clause (ii), the term \u201cproperty interest\u201d means any interest in real property or personal property (as those terms are defined in section 200.1 of title 2, Code of Federal Regulations (as in effect on\nNovember 15, 2021\n(ii)\nExclusion\nThe term \u201cproperty interest\u201d does not include any interest in intellectual property developed using funding provided under a project described in paragraph (3).\n(2)\nAssignment of property interests\nThe Secretary may assign to any entity, including the United States, fee title or any other property interest acquired by the Secretary under an agreement entered into with respect to a project described in paragraph (3).\n(3)\nProject described\nA project referred to in paragraph (2) is\u2014\n(A) a project for which funding is provided pursuant to the funding opportunity announcement of the Department numbered DE\u2013FOA\u20130002271, including any project for which funding has been provided pursuant to that announcement as of\nNovember 15, 2021\n(B) any other project for which funding is provided using amounts made available for the Advanced Reactor Demonstration Program of the Department under the heading \u201cNuclear Energy\u201d under the heading \u201cENERGY PROGRAMS\u201d in title III of division C of the Further Consolidated Appropriations Act, 2020 (\nPublic Law 116\u201394\n133 Stat. 2670\n(C) any other project for which Federal funding is provided under the Advanced Reactor Demonstration Program of the Department; or\n(D) a project\u2014\n(i) relating to advanced nuclear reactors; and\n(ii) for which Federal funding is provided under a program focused on development and demonstration.\n(4)\nRetroactive vesting\nThe vesting of fee title or any other property interest assigned under paragraph (2) shall be retroactive to the date on which the applicable project first received Federal funding as described in any of subparagraphs (A) through (D) of paragraph (3).","url":"https://projectusc.org/usc/t42/s18752.html","content":[{"t":"sec","id":"/us/usc/t42/s18752","children":[{"t":"num","text":"\u00a7\u202f18752."},{"t":"heading","text":"Property interests relating to certain projects and protection of information relating to certain agreements"},{"t":"subsec","id":"/us/usc/t42/s18752/a","children":[{"t":"num","text":"(a)"},{"t":"heading","text":"11\u202fSo in original.
