{"identifier":"/us/usc/t42/s2021b","title":42,"num":"\u00a7\u202f2021b.","heading":"Definitions","text":"\u00a7\u202f2021b.\nDefinitions\nFor purposes of sections 2021b to 2021j of this title:\n(1)\nAgreement State\nThe term \u201cagreement State\u201d means a State that\u2014\n(A) has entered into an agreement with the Nuclear Regulatory Commission under\nsection 2021 of this title\n(B) has authority to regulate the disposal of low-level radioactive waste under such agreement.\n(2)\nAllocation\nThe term \u201callocation\u201d means the assignment of a specific amount of low-level radioactive waste disposal capacity to a commercial nuclear power reactor for which access is required to be provided by sited States subject to the conditions specified under sections 2021b to 2021j of this title.\n(3)\nCommercial nuclear power reactor\nThe term \u201ccommercial nuclear power reactor\u201d means any unit of a civilian light-water moderated utilization facility required to be licensed under section 2133 or 2134(b) of this title.\n(4)\nCompact\nThe term \u201ccompact\u201d means a compact entered into by two or more States pursuant to sections 2021b to 2021j of this title.\n(5)\nCompact commission\nThe term \u201ccompact commission\u201d means the regional commission, committee, or board established in a compact to administer such compact.\n(6)\nCompact region\nThe term \u201ccompact region\u201d means the area consisting of all States that are members of a compact.\n(7)\nDisposal\nThe term \u201cdisposal\u201d means the permanent isolation of low-level radioactive waste pursuant to the requirements established by the Nuclear Regulatory Commission under applicable laws, or by an agreement State if such isolation occurs in such agreement State.\n(8)\nGenerate\nThe term \u201cgenerate\u201d, when used in relation to low-level radioactive waste, means to produce low-level radioactive waste.\n(9)\nLow-level radioactive waste\n(A)\nIn general\nThe term \u201clow-level radioactive waste\u201d means radioactive material that\u2014\n(i) is not high-level radioactive waste, spent nuclear fuel, or byproduct material (as defined in\nsection 2014(e)(2) of this title\n(ii) the Nuclear Regulatory Commission, consistent with existing law and in accordance with paragraph (A), classifies as low-level radioactive waste.\n(B)\nExclusion\nThe term \u201clow-level radioactive waste\u201d does not include byproduct material (as defined in paragraphs (3) and (4) of\nsection 2014(e) of this title\n(10)\nNon-sited compact region\nThe term \u201cnon-sited compact region\u201d means any compact region that is not a sited compact region.\n(11)\nRegional disposal facility\nThe term \u201cregional disposal facility\u201d means a non-Federal low-level radioactive waste disposal facility in operation on\nJanuary 1, 1985\n(12)\nSecretary\nThe term \u201cSecretary\u201d means the Secretary of Energy.\n(13)\nSited compact region\nThe term \u201csited compact region\u201d means a compact region in which there is located one of the regional disposal facilities at Barnwell, in the State of South Carolina;
