{"identifier":"/us/usc/t42/s4370m\u20138","title":42,"num":"\u00a7\u202f4370m\u20138.","heading":"Funding for governance, oversight, and processing of environmental reviews and permits","text":"\u00a7\u202f4370m\u20138.\nFunding for governance, oversight, and processing of environmental reviews and permits\n(a)\nIn general\nFor the purpose of carrying out this subchapter, the Executive Director, in consultation with the heads of the agencies listed in\nsection 4370m\u20131(b)(2)(B) of this title\n(b)\nReasonable costs\nAs used in this section, the term \u201creasonable costs\u201d shall include costs to implement the requirements and authorities required under sections 4370m\u20131 through 4370m\u20137 of this title, including the costs to agencies and the costs of operating the Council.\n(c)\nFee structure\nThe fee structure established under subsection (a) shall\u2014\n(1) be developed in consultation with affected project proponents, industries, and other stakeholders;\n(2) exclude parties for which the fee would impose an undue financial burden or is otherwise determined to be inappropriate;
