{"identifier":"/us/usc/t42/s6341","title":42,"num":"\u00a7\u202f6341.","heading":"Definitions","text":"\u00a7\u202f6341.\nDefinitions\nIn this part:\n(1)\nAdministrator\nThe term \u201cAdministrator\u201d means the Administrator of the Environmental Protection Agency.\n(2)\nCombined heat and power\nThe term \u201ccombined heat and power system\u201d means a facility that\u2014\n(A) simultaneously and efficiently produces useful thermal energy and electricity; and\n(B) recovers not less than 60 percent of the energy value in the fuel (on a higher-heating-value basis) in the form of useful thermal energy and electricity.\n(3)\nNet excess power\nThe term \u201cnet excess power\u201d means, for any facility, recoverable waste energy recovered in the form of electricity in quantities exceeding the total consumption of electricity at the specific time of generation on the site at which the facility is located.\n(4)\nProject\nThe term \u201cproject\u201d means a recoverable waste energy project or a combined heat and power system project.\n(5)\nRecoverable waste energy\nThe term \u201crecoverable waste energy\u201d means waste energy from which electricity or useful thermal energy may be recovered through modification of an existing facility or addition of a new facility.\n(6)\nRegistry\nThe term \u201cRegistry\u201d means the Registry of Recoverable Waste Energy Sources established under\nsection 6342(d) of this title\n(7)\nUseful thermal energy\nThe term \u201cuseful thermal energy\u201d means energy\u2014\n(A) in the form of direct heat, steam, hot water, or other thermal form that is used in production and beneficial measures for heating, cooling, humidity control, process use, or other valid thermal end-use energy requirements; and\n(B) for which fuel or electricity would otherwise be consumed.\n(8)\nWaste energy\nThe term \u201cwaste energy\u201d means\u2014\n(A) exhaust heat or flared gas from any industrial process;\n(B) waste gas or industrial tail gas that would otherwise be flared, incinerated, or vented;\n(C) a pressure drop in any gas, excluding any pressure drop to a condenser that subsequently vents the resulting heat;
