{"identifier":"/us/usc/t42/s9877","title":42,"num":"\u00a7\u202f9877.","heading":"Definitions","text":"\u00a7\u202f9877.\nDefinitions\nFor purposes of this subchapter\u2014\n(1) the term \u201ccommunity center\u201d means facilities operated by nonprofit community-based organizations for the provision of recreational, social, or educational services to the general public;\n(2) the term \u201cdependent\u201d means\u2014\n(A) an individual who has not attained the age of 17 years;\n(B) an individual who has attained the age of 55 years; or\n(C) an individual with a developmental disability;\n(3) the term \u201cdevelopmental disability\u201d has the same meaning as in\nsection 15002 of this title\n(4) the term \u201cequipment\u201d has the same meaning given that term by section 198(a)(8) of the Elementary and Secondary Education Act of 1965;\n1\n1 See References in Text note below.\n(5) the term \u201cinstitution of higher education\u201d has the same meaning given that term under\nsection 1001 of title 20\n(6) the term \u201clocal educational agency\u201d has the same meaning given that term under\nsection 7801 of title 20\n(7) the term \u201cschool-age children\u201d means children aged five through thirteen, except that in any State in which by State law children at an earlier age are provided free public education, the age provided in State law shall be substituted for age five;\n(8) the term \u201cschool facilities\u201d means classrooms and related facilities used for the provision of education;\n(9) the term \u201cSecretary\u201d means the Secretary of Health and Human Services;\n(10) the term \u201cState\u201d means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, the Federated States of Micronesia, the Republic of the Marshall Islands, Palau, and the Commonwealth of the Northern Mariana Islands;
