{"identifier":"/us/usc/t43/s2401","title":43,"num":"\u00a7\u202f2401.","heading":"Definitions","text":"\u00a7\u202f2401.\nDefinitions\nIn this subchapter:\n(1)\nConstruction\nThe term \u201cconstruction\u201d means the installation of infrastructure and the upgrading of existing facilities in locations in which the infrastructure or facilities are associated with the new infrastructure of a rural water project recommended by the Secretary pursuant to this subchapter.\n(2)\nFederal reclamation law\nThe term \u201cFederal reclamation law\u201d means the Act of\nJune 17, 1902\n32 Stat. 388\n43 U.S.C. 371\n(3)\nIndian\nThe term \u201cIndian\u201d means an individual who is a member of an Indian tribe.\n(4)\nIndian tribe\nThe term \u201cIndian tribe\u201d has the meaning given the term in\nsection 5304 of title 25\n(5)\nNon-Federal project entity\nThe term \u201cnon-Federal project entity\u201d means a State, regional, or local authority, Indian tribe or tribal organization, or other qualifying entity, such as a water conservation district, water conservancy district, or rural water district or association.\n(6)\nOperations, maintenance, and replacement costs\n(A)\nIn general\nThe term \u201coperations, maintenance, and replacement costs\u201d means all costs for the operation of a rural water supply project that are necessary for the safe, efficient, and continued functioning of the project to produce the benefits described in a feasibility study.\n(B)\nInclusions\nThe term \u201coperations, maintenance, and replacement costs\u201d includes\u2014\n(i) repairs of a routine nature that maintain a rural water supply project in a well kept condition;\n(ii) replacement of worn-out project elements; and\n(iii) rehabilitation activities necessary to bring a deteriorated project back to the original condition of the project.\n(C)\nExclusion\nThe term \u201coperations, maintenance, and replacement costs\u201d does not include construction costs.\n(7)\nProgram\nThe term \u201cProgram\u201d means the rural water supply program carried out under\nsection 2402 of this title\n(8)\nReclamation States\nThe term \u201cReclamation States\u201d means the States and areas referred to in the first section of the Act of\nJune 17, 1902\n43 U.S.C. 391\n(9)\nRural water supply project\n(A)\nIn general\nThe term \u201crural water supply project\u201d means a project that is designed to serve a community or group of communities, each of which has a population of not more than 50,000 inhabitants, which may include Indian tribes and tribal organizations, dispersed homesites, or rural areas with domestic, industrial, municipal, and residential water.\n(B)\nInclusion\nThe term \u201crural water supply project\u201d includes\u2014\n(i) incidental noncommercial livestock watering and noncommercial irrigation of vegetation and small gardens of less than 1 acre; and\n(ii) a project to improve rural water infrastructure, including\u2014\n(I) pumps, pipes, wells, and other diversions;\n(II) storage tanks and small impoundments;\n(III) water treatment facilities for potable water supplies, including desalination facilities;\n(IV) equipment and management tools for water conservation, groundwater recovery, and water recycling; and\n(V) appurtenances.\n(C)\nExclusion\nThe term \u201crural water supply project\u201d does not include\u2014\n(i) commercial irrigation; or\n(ii) major impoundment structures.\n(10)\nSecretary\nThe term \u201cSecretary\u201d means the Secretary of the Interior.\n(11)\nTribal organization\nThe term \u201ctribal organization\u201d means\u2014\n(A) the recognized governing body of an Indian tribe;
