{"identifier":"/us/usc/t43/s2902","title":43,"num":"\u00a7\u202f2902.","heading":"Definitions","text":"\u00a7\u202f2902.\nDefinitions\nIn this chapter:\n(1)\nConveyed property\nThe term \u201cconveyed property\u201d means an eligible facility that has been conveyed to a qualifying entity under\nsection 2903 of this title\n(2)\nEligible facility\nThe term \u201celigible facility\u201d means a facility that meets the criteria for potential transfer established under\nsection 2904(a) of this title\n(3)\nFacility\n(A)\nIn general\nThe term \u201cfacility\u201d includes a dam or appurtenant works, canal, lateral, ditch, gate, control structure, pumping station, other infrastructure, recreational facility, building, distribution and drainage works, and associated land or interest in land or water.\n(B)\nExclusions\nThe term \u201cfacility\u201d does not include a Reclamation project facility, or a portion of a Reclamation project facility\u2014\n(i) that is a reserved works as of\nMarch 12, 2019\n(ii) that generates hydropower marketed by a Federal power marketing administration; or\n(iii) that is managed for recreation under a lease, permit, license, or other management agreement that does contribute to capital repayment.\n(4)\nProject use power\nThe term \u201cproject use power\u201d means the electrical capacity, energy, and associated ancillary service components required to provide the minimum electrical service needed to operate or maintain Reclamation project facilities in accordance with the authorization for the Reclamation project.\n(5)\nQualifying entity\nThe term \u201cqualifying entity\u201d means an agency of a State or political subdivision of a State, a joint action or powers agency, a water users association, or an Indian Tribe or Tribal utility authority that\u2014\n(A) as of the date of conveyance under this chapter, is the current operator of the eligible facility pursuant to a contract with Reclamation; and\n(B) as determined by the Secretary, has the capacity to continue to manage the eligible facility for the same purposes for which the property has been managed under the reclamation laws.\n(6)\nReclamation\nThe term \u201cReclamation\u201d means the Bureau of Reclamation.\n(7)\nReclamation project\nThe term \u201cReclamation project\u201d means\u2014\n(A) any reclamation or irrigation project, including incidental features of the project\u2014\n(i) that is authorized by the reclamation laws;\n(ii) that is constructed by the United States pursuant to the reclamation laws; or\n(iii) in connection with which there is a repayment or water service contract executed by the United States pursuant to the reclamation laws; or\n(B) any project constructed by the Secretary for the reclamation of land.\n(8)\nReserved works\nThe term \u201creserved works\u201d means any building, structure, facility, or equipment\u2014\n(A) that is owned by the Bureau;
