{"identifier":"/us/usc/t46/s53701","title":46,"num":"\u00a7\u202f53701.","heading":"Definitions","text":"\u00a7\u202f53701.\nDefinitions\nIn this chapter:\n(1)\nActual cost.\u2014\nThe term \u201cactual cost\u201d means the sum of\u2014\n(A) all amounts paid by or for the account of the obligor as of the date on which a determination is made under\nsection 53715(d)(1) of this title\n(B) all amounts that the Secretary or Administrator reasonably estimates the obligor will become obligated to pay from time to time thereafter, for the construction, reconstruction, or reconditioning of the vessel, including guarantee fees that will become payable under\nsection 53714 of this title\n(2)\nAdministrator.\u2014\nThe term \u201cAdministrator\u201d means the Administrator of the Maritime Administration.\n(3)\nConstruction, reconstruction, and reconditioning.\u2014\nThe terms \u201cconstruction\u201d, \u201creconstruction\u201d, and \u201creconditioning\u201d include designing, inspecting, outfitting, and equipping.\n(4)\nDepreciated actual cost.\u2014\nThe term \u201cdepreciated actual cost\u201d of a vessel means\u2014\n(A) if the vessel was not reconstructed or reconditioned, the actual cost of the vessel depreciated on a straight line basis over the useful life of the vessel as determined by the Secretary or Administrator, not to exceed 25 years from the date of delivery by the builder; or\n(B) if the vessel was reconstructed or reconditioned, the sum of\u2014\n(i) the actual cost of the vessel depreciated on a straight line basis from the date of delivery by the builder to the date of the reconstruction or reconditioning, using the original useful life of the vessel, and from the date of the reconstruction or reconditioning, using a useful life of the vessel determined by the Secretary or Administrator; and\n(ii) any amount paid or obligated to be paid for the reconstruction or reconditioning, depreciated on a straight line basis using a useful life of the vessel determined by the Secretary or Administrator.\n(5)\nFishery facility.\u2014\n(A)\nIn general.\u2014\nSubject to subparagraph (B), the term \u201cfishery facility\u201d means\u2014\n(i) for operations on land\u2014\n(I) a structure or appurtenance thereto designed for the unloading and receiving from vessels, the processing, the holding pending processing, the distribution after processing, or the holding pending distribution, of fish from a fishery;\n(II) the land necessary for the structure or appurtenance; and\n(III) equipment that is for use with the structure or appurtenance and that is necessary for performing a function referred to in subclause (I);\n(ii) for operations not on land, a vessel built in the United States and used for, equipped to be used for, or of a type normally used for, the processing of fish; or\n(iii) for aquaculture, including operations on land or elsewhere\u2014\n(I) a structure or appurtenance thereto designed for aquaculture;\n(II) the land necessary for the structure or appurtenance;\n(III) equipment that is for use with the structure or appurtenance and that is necessary for performing a function referred to in subclause (I); and\n(IV) a vessel built in the United States and used for, equipped to be used for, or of a type normally used for, aquaculture.\n(B)\nRequired ownership.\u2014\nUnder subparagraph (A), the structure, appurtenance, land, equipment, or vessel must be owned by\u2014\n(i) an individual who is a citizen of the United States; or\n(ii) an entity that is a citizen of the United States under\nsection 50501 of this title\n(6)\nFishing vessel.\u2014\nThe term \u201cfishing vessel\u201d has the meaning given that term in section 3 of the Magnuson-Stevens Fishery Conservation and Management Act (\n16 U.S.C. 1802\n(7)\nHistorical uses.\u2014\nThe term \u201chistorical uses\u201d includes\u2014\n(A) refurbishing, repairing, rebuilding, or replacing equipment on a fishing vessel, without materially increasing harvesting capacity;\n(B) purchasing a used fishing vessel;\n(C) purchasing, constructing, expanding, or reconditioning a fishery facility;\n(D) refinancing existing debt;\n(E) reducing fishing capacity; and\n(F) making upgrades to a fishing vessel, including upgrades in technology, gear, or equipment, that improve\u2014\n(i) collection and reporting of fishery-dependent data;\n(ii) bycatch reduction or avoidance;\n(iii) gear selectivity;\n(iv) adverse impacts caused by fishing gear; or\n(v) safety.\n(8)\nMortgage.\u2014\nThe term \u201cmortgage\u201d includes\u2014\n(A) a preferred mortgage as defined in\nsection 31301 of this title\n(B) a mortgage on a vessel that will become a preferred mortgage when filed or recorded under chapter 313 of this title.\n(9)\nObligation.\u2014\nThe term \u201cobligation\u201d means an instrument of indebtedness issued for a purpose described in\n(A) an obligation issued by the Secretary or Administrator under\nsection 53723 of this title\n(B) an obligation eligible for investment of funds under section 53715(f) or 53717 of this title.\n(10)\nObligee.\u2014\nThe term \u201cobligee\u201d means the holder of an obligation.\n(11)\nObligor.\u2014\nThe term \u201cobligor\u201d means a party primarily liable for payment of the principal of or interest on an obligation.\n(12)\nOcean thermal energy conversion facility or plantship.\u2014\nThe term \u201cocean thermal energy conversion facility or plantship\u201d means an at-sea facility or vessel, whether mobile, floating unmoored, moored, or standing on the seabed, that uses temperature differences in ocean water to produce electricity or another form of energy capable of being used directly to perform work, and includes\u2014\n(A) equipment installed on the facility or vessel to use the electricity or other form of energy to produce, process, refine, or manufacture a product;\n(B) a cable or pipeline used to deliver the electricity, freshwater, or product to shore; and\n(C) other associated equipment and appurtenances of the facility or vessel to the extent they are located seaward of the high water mark.\n(13)\nSecretary.\u2014\nThe term \u201cSecretary\u201d means the Secretary of Commerce with respect to fishing vessels and fishery facilities.\n(14)\nVessel.\u2014\nThe term \u201cvessel\u201d means any type of vessel, whether in existence or under construction, including\u2014\n(A) a cargo vessel;\n(B) a passenger vessel;\n(C) a combination cargo and passenger vessel;\n(D) a tanker;\n(E) a tug or towboat;\n(F) a barge;\n(G) a dredge;\n(H) a floating drydock with a capacity of at least 35,000 lifting tons and a beam of at least 125 feet between the wing walls;\n(I) an oceanographic research vessel;\n(J) an instruction vessel;\n(K) a pollution treatment, abatement, or control vessel;\n(L) a fishing vessel whose ownership meets the citizenship requirements under\nsection 50501 of this title\n(M) an ocean thermal energy conversion facility or plantship that is or will be documented under the laws of the United States.\n(15)\nVessel of national interest.\u2014\nThe term \u201cVessel of National Interest\u201d means a vessel deemed to be of national interest that meets characteristics determined by the Administrator, in consultation with the Secretary of Defense, the Secretary of the Department in which the Coast Guard is operating when it is not operating as a service in the Department of the Navy, or the heads of other Federal agencies, as described in section 53703(d).","url":"https://projectusc.org/usc/t46/s53701.html","content":[{"t":"sec","id":"/us/usc/t46/s53701","children":[{"t":"num","text":"\u00a7\u202f53701."},{"t":"heading","text":"Definitions","tail":"\n"},{"t":"chapeau","text":"In this chapter:"},{"t":"para","id":"/us/usc/t46/s53701/1","children":[{"t":"num","text":"(1)"},{"t":"heading","text":"Actual cost.\u2014"},{"t":"chapeau","text":"The term \u201cactual cost\u201d means the sum of\u2014"},{"t":"subpara","id":"/us/usc/t46/s53701/1/A","children":[{"t":"num","text":"(A)"},{"t":"content","text":" all amounts paid by or for the account of the obligor as of the date on which a determination is made under ","children":[{"t":"ref","text":"section 53715(d)(1) of this title","href":"/us/usc/t46/s53715/d/1","tail":";
