{"identifier":"/us/usc/t47/s1721","title":47,"num":"\u00a7\u202f1721.","heading":"Definitions","text":"\u00a7\u202f1721.\nDefinitions\nIn this subchapter:\n(1)\nAdoption of broadband\nThe term \u201cadoption of broadband\u201d means the process by which an individual obtains daily access to the internet\u2014\n(A) at a speed, quality, and capacity\u2014\n(i) that is necessary for the individual to accomplish common tasks; and\n(ii) such that the access qualifies as an advanced telecommunications capability;\n(B) with the digital skills that are necessary for the individual to participate online; and\n(C) on a\u2014\n(i) personal device; and\n(ii) secure and convenient network.\n(2)\nAdvanced telecommunications capability\nThe term \u201cadvanced telecommunications capability\u201d has the meaning given the term in\nsection 1302(d) of this title\n(3)\nAging individual\nThe term \u201caging individual\u201d has the meaning given the term \u201colder individual\u201d in\nsection 3002 of title 42\n(4)\nAppropriate committees of Congress\nThe term \u201cappropriate committees of Congress\u201d means\u2014\n(A) the Committee on Appropriations of the Senate;\n(B) the Committee on Commerce, Science, and Transportation of the Senate;\n(C) the Committee on Appropriations of the House of Representatives; and\n(D) the Committee on Energy and Commerce of the House of Representatives.\n(5)\nAssistant Secretary\nThe term \u201cAssistant Secretary\u201d means the Assistant Secretary of Commerce for Communications and Information.\n(6)\nCommunity anchor institution\nThe term \u201ccommunity anchor institution\u201d means a public school, a public or multi-family housing authority, a library, a medical or healthcare provider, a community college or other institution of higher education, a State library agency, and any other nonprofit or governmental community support organization.\n(7)\nCovered household\nThe term \u201ccovered household\u201d means a household, the income of which for the most recently completed year is not more than 150 percent of an amount equal to the poverty level, as determined by using criteria of poverty established by the Bureau of the Census.\n(8)\nCovered populations\nThe term \u201ccovered populations\u201d means\u2014\n(A) individuals who live in covered households;\n(B) aging individuals;\n(C) incarcerated individuals, other than individuals who are incarcerated in a Federal correctional facility;\n(D) veterans;\n(E) individuals with disabilities;\n(F) individuals with a language barrier, including individuals who\u2014\n(i) are English learners; and\n(ii) have low levels of literacy;\n(G) individuals who are members of a racial or ethnic minority group; and\n(H) individuals who primarily reside in a rural area.\n(9)\nCovered programs\nThe term \u201ccovered programs\u201d means the State Digital Equity Capacity Grant Program established under\nsection 1723 of this title\nsection 1724 of this title\n(10)\nDigital equity\nThe term \u201cdigital equity\u201d means the condition in which individuals and communities have the information technology capacity that is needed for full participation in the society and economy of the United States.\n(11)\nDigital inclusion\nThe term \u201cdigital inclusion\u201d\u2014\n(A) means the activities that are necessary to ensure that all individuals in the United States have access to, and the use of, affordable information and communication technologies, such as\u2014\n(i) reliable fixed and wireless broadband internet service;\n(ii) internet-enabled devices that meet the needs of the user; and\n(iii) applications and online content designed to enable and encourage self-sufficiency, participation, and collaboration; and\n(B) includes\u2014\n(i) obtaining access to digital literacy training;\n(ii) the provision of quality technical support; and\n(iii) obtaining basic awareness of measures to ensure online privacy and cybersecurity.\n(12)\nDigital literacy\nThe term \u201cdigital literacy\u201d means the skills associated with using technology to enable users to find, evaluate, organize, create, and communicate information.\n(13)\nDisability\nThe term \u201cdisability\u201d has the meaning given the term in\nsection 12102 of title 42\n(14)\nEligible State\nThe term \u201celigible State\u201d means\u2014\n(A) with respect to planning grants made available under section 60304(c)(3), a State with respect to which the Assistant Secretary has approved an application submitted to the Assistant Secretary under\nsection 1723(c)(3)(C) of this title\n(B) with respect to capacity grants awarded under\nsection 1723(d) of this title\nsection 1723(d)(2) of this title\nsection 1723(c) of this title\n(15)\nGender identity\nThe term \u201cgender identity\u201d has the meaning given the term in\nsection 249(c) of title 18\n(16)\nIndian Tribe\nThe term \u201cIndian Tribe\u201d has the meaning given the term in\nsection 5304(e) of title 25\n(17)\nInstitution of higher education\nThe term \u201cinstitution of higher education\u201d\u2014\n(A) has the meaning given the term in\nsection 1001 of title 20\n(B) includes a postsecondary vocational institution.\n(18)\nLocal educational agency\nThe term \u201clocal educational agency\u201d has the meaning given the term in\nsection 7801(30) of title 20\n(19)\nPostsecondary vocational institution\nThe term \u201cpostsecondary vocational institution\u201d has the meaning given the term in\nsection 1002(c) of title 20\n(20)\nRural area\nThe term \u201crural area\u201d has the meaning given the term in\nsection 950bb(b)(3) of title 7\n(21)\nState\nThe term \u201cState\u201d means\u2014\n(A) any State of the United States;\n(B) the District of Columbia;
