{"identifier":"/us/usc/t49/s60101","title":49,"num":"\u00a7\u202f60101.","heading":"Definitions","text":"\u00a7\u202f60101.\nDefinitions\n(a)\nGeneral.\u2014\nIn this chapter\u2014\n(1) \u201cexisting liquefied natural gas facility\u201d\u2014\n(A) means a liquefied natural gas facility for which an application to approve the site, construction, or operation of the facility was filed before\n(i) the Federal Energy Regulatory Commission (or any predecessor); or\n(ii) the appropriate State or local authority, if the facility is not subject to the jurisdiction of the Commission under the Natural Gas Act (\n15 U.S.C. 717\n(B) does not include a facility on which construction is begun after\nNovember 29, 1979\n(2) \u201cgas\u201d means natural gas, flammable gas, or toxic or corrosive gas;\n(3) \u201cgas pipeline facility\u201d includes a pipeline, a right of way, a facility, a building, or equipment used in transporting gas or treating gas during its transportation;\n(4) \u201chazardous liquid\u201d means\u2014\n(A) petroleum or a petroleum product;\n(B) nonpetroleum fuel, including biofuel, that is flammable, toxic, or corrosive or would be harmful to the environment if released in significant quantities; and\n(C) a substance the Secretary of Transportation decides may pose an unreasonable risk to life or property when transported by a hazardous liquid pipeline facility in a liquid state (except for liquefied natural gas);\n(5) \u201chazardous liquid pipeline facility\u201d includes a pipeline, a right of way, a facility, a building, or equipment used or intended to be used in transporting hazardous liquid;\n(6) \u201cinterstate gas pipeline facility\u201d means a gas pipeline facility\u2014\n(A) used to transport gas; and\n(B) subject to the jurisdiction of the Commission under the Natural Gas Act (\n15 U.S.C. 717\n(7) \u201cinterstate hazardous liquid pipeline facility\u201d means a hazardous liquid pipeline facility used to transport hazardous liquid in interstate or foreign commerce;\n(8) \u201cinterstate or foreign commerce\u201d\u2014\n(A) related to gas, means commerce\u2014\n(i) between a place in a State and a place outside that State; or\n(ii) that affects any commerce described in subclause (A)(i) of this clause; and\n(B) related to hazardous liquid, means commerce between\u2014\n(i) a place in a State and a place outside that State; or\n(ii) places in the same State through a place outside the State;\n(9) \u201cintrastate gas pipeline facility\u201d means a gas pipeline facility and transportation of gas within a State not subject to the jurisdiction of the Commission under the Natural Gas Act (\n15 U.S.C. 717\n(10) \u201cintrastate hazardous liquid pipeline facility\u201d means a hazardous liquid pipeline facility that is not an interstate hazardous liquid pipeline facility;\n(11) \u201cliquefied natural gas\u201d means natural gas in a liquid or semisolid state;\n(12) \u201cliquefied natural gas accident\u201d means a release, burning, or explosion of liquefied natural gas from any cause, except a release, burning, or explosion that, under regulations prescribed by the Secretary, does not pose a threat to public health or safety, property, or the environment;\n(13) \u201cliquefied natural gas conversion\u201d means conversion of natural gas into liquefied natural gas or conversion of liquefied natural gas into natural gas;\n(14) \u201cliquefied natural gas pipeline facility\u201d\u2014\n(A) means a gas pipeline facility used for transporting or storing liquefied natural gas, or for liquefied natural gas conversion, in interstate or foreign commerce; but\n(B) does not include any part of a structure or equipment located in navigable waters (as defined in section 3 of the Federal Power Act (\n16 U.S.C. 796\n(15) \u201cmunicipality\u201d means a political subdivision of a State;\n(16) \u201cnew liquefied natural gas pipeline facility\u201d means a liquefied natural gas pipeline facility except an existing liquefied natural gas pipeline facility;\n(17) \u201cperson\u201d, in addition to its meaning under\nsection 1 of title 1\n(18) \u201cpipeline facility\u201d means a gas pipeline facility and a hazardous liquid pipeline facility;\n(19) \u201cpipeline transportation\u201d means transporting gas and transporting hazardous liquid;\n(20) \u201cState\u201d means a State of the United States, the District of Columbia, and Puerto Rico;\n(21) \u201ctransporting gas\u201d\u2014\n(A) means\u2014\n(i) the gathering, transmission, or distribution of gas by pipeline, or the storage of gas, in interstate or foreign commerce; and\n(ii) the movement of gas through regulated gathering lines; but\n(B) does not include gathering gas (except through regulated gathering lines) in a rural area outside a populated area designated by the Secretary as a nonrural area;\n(22) \u201ctransporting hazardous liquid\u201d\u2014\n(A) means\u2014\n(i) the movement of hazardous liquid by pipeline, or the storage of hazardous liquid incidental to the movement of hazardous liquid by pipeline, in or affecting interstate or foreign commerce; and\n(ii) the movement of hazardous liquid through regulated gathering lines; but\n(B) does not include moving hazardous liquid through\u2014\n(i) gathering lines (except regulated gathering lines) in a rural area;\n(ii) onshore production, refining, or manufacturing facilities; or\n(iii) storage or in-plant piping systems associated with onshore production, refining, or manufacturing facilities;\n(23) \u201crisk management\u201d means the systematic application, by the owner or operator of a pipeline facility, of management policies, procedures, finite resources, and practices to the tasks of identifying, analyzing, assessing, reducing, and controlling risk in order to protect employees, the general public, the environment, and pipeline facilities;\n(24) \u201crisk management plan\u201d means a management plan utilized by a gas or hazardous liquid pipeline facility owner or operator that encompasses risk management;\n(25) \u201cSecretary\u201d means the Secretary of Transportation; and\n(26) \u201cunderground natural gas storage facility\u201d means a gas pipeline facility that stores natural gas in an underground facility, including\u2014\n(A) a depleted hydrocarbon reservoir;\n(B) an aquifer reservoir; or\n(C) a solution-mined salt cavern reservoir.\n(b)\nGathering Lines.\u2014\n(1)\n(A) Not later than\nOctober 24, 1994\n(B) In defining \u201cgathering line\u201d for gas, the Secretary\u2014\n(i) shall consider functional and operational characteristics of the lines to be included in the definition;
