{"identifier":"/us/usc/t49/s6703","title":49,"num":"\u00a7\u202f6703.","heading":"National culvert removal, replacement, and restoration grant program","text":"\u00a7\u202f6703.\nNational culvert removal, replacement, and restoration grant program\n(a)\nDefinitions.\u2014\nIn this section:\n(1)\nDirector.\u2014\nThe term \u201cDirector\u201d means the Director of the United States Fish and Wildlife Service.\n(2)\nIndian tribe.\u2014\nThe term \u201cIndian Tribe\u201d has the meaning given the term in section 4 of the Indian Self-Determination and Education Assistance Act (\n25 U.S.C. 5304\n(3)\nProgram.\u2014\nThe term \u201cprogram\u201d means the annual competitive grant program established under subsection (b).\n(4)\nSecretary.\u2014\nThe term \u201cSecretary\u201d means the Secretary of Transportation.\n(5)\nUndersecretary.\u2014\nThe term \u201cUndersecretary\u201d means the Undersecretary of Commerce for Oceans and Atmosphere.\n(b)\nEstablishment.\u2014\nThe Secretary, in consultation with the Undersecretary, shall establish an annual competitive grant program to award grants to eligible entities for projects for the replacement, removal, and repair of culverts or weirs that\u2014\n(1) would meaningfully improve or restore fish passage for anadromous fish; and\n(2) with respect to weirs, may include\u2014\n(A) infrastructure to facilitate fish passage around or over the weir; and\n(B) weir improvements.\n(c)\nEligible Entities.\u2014\nAn entity eligible to receive a grant under the program is\u2014\n(1) a State;\n(2) a unit of local government; or\n(3) an Indian Tribe.\n(d)\nGrant Selection Process.\u2014\nThe Secretary, in consultation with the Undersecretary and the Director, shall establish a process for determining criteria for awarding grants under the program, subject to subsection (e).\n(e)\nPrioritization.\u2014\nThe Secretary, in consultation with the Undersecretary and the Director, shall establish procedures to prioritize awarding grants under the program to\u2014\n(1) projects that would improve fish passage for\u2014\n(A) anadromous fish stocks listed as an endangered species or a threatened species under section 4 of the Endangered Species Act of 1973 (\n16 U.S.C. 1533\n(B) anadromous fish stocks identified by the Undersecretary or the Director that could reasonably become listed as an endangered species or a threatened species under that section;\n(C) anadromous fish stocks identified by the Undersecretary or the Director as prey for endangered species, threatened species, or protected species, including Southern resident orcas (Orcinus orcas);
