{"identifier":"/us/usc/t7/s3103","title":7,"num":"\u00a7\u202f3103.","heading":"Definitions","text":"\u00a7\u202f3103.\nDefinitions\nWhen used in this chapter:\n(1) The term \u201cAdvisory Board\u201d means the National Agricultural Research, Extension, Education, and Economics Advisory Board.\n(2) The term \u201cagricultural research\u201d means research in the food and agricultural sciences.\n(3) The term \u201caquaculture\u201d means the propagation and rearing of aquacultural species, including, but not limited to, any species of finfish, mollusk, or crustacean (or other aquatic invertebrate), amphibian, reptile, ornamental fish, or aquatic plant, in controlled or selected environments.\n(4)\nCollege and university.\u2014\n(A)\nIn general.\u2014\nThe terms \u201ccollege\u201d and \u201cuniversity\u201d mean an educational institution in any State which (i) admits as regular students only persons having a certificate of graduation from a school providing secondary education, or the recognized equivalent of such a certificate, (ii) is legally authorized within such State to provide a program of education beyond secondary education, (iii) provides an educational program for which a bachelor\u2019s degree or any other higher degree is awarded, (iv) is a public or other nonprofit institution, and (v) is accredited by a nationally recognized accrediting agency or association.\n(B)\nInclusions.\u2014\nThe terms \u201ccollege\u201d and \u201cuniversity\u201d include a research foundation maintained by a college or university described in subparagraph (A).\n(5)\nCooperating forestry school.\u2014\n(A)\nIn general.\u2014\nThe term \u201ccooperating forestry school\u201d means an institution\u2014\n(i) that is eligible to receive funds under\nPublic Law 87\u2013788\n16 U.S.C. 582a\n(ii) with respect to which the Secretary has not received a declaration of the intent of that institution to not be considered a cooperating forestry school.\n(B)\nTermination of declaration.\u2014\nA declaration of the intent of an institution to not be considered a cooperating forestry school submitted to the Secretary shall be in effect until\nSeptember 30, 2018\n(6) The term \u201ccooperative extension services\u201d means the organizations established at the land-grant colleges and universities under the Smith-Lever Act of\nMay 8, 1914\n38 Stat. 372\u2013374\n7 U.S.C. 341\u2013349\nsection 209(b) of the Act of October 26, 1974\n88 Stat. 1428\n(7) The term \u201cDepartment of Agriculture\u201d means the United States Department of Agriculture.\n(8) The term \u201cextension\u201d means the informal education programs conducted in the States in cooperation with the Department of Agriculture.\n(9)\nFood and agricultural sciences.\u2014\nThe term \u201cfood and agricultural sciences\u201d means basic, applied, and developmental research, extension, and teaching activities in food and fiber, agricultural, renewable energy and natural resources, forestry, and physical and social sciences, including activities relating to the following:\n(A) Animal health, production, and well-being.\n(B) Plant health and production.\n(C) Animal and plant germ plasm collection and preservation.\n(D) Aquaculture.\n(E) Food safety.\n(F) Soil, water, and related resource conservation and improvement.\n(G) Forestry, horticulture, and range management.\n(H) Nutritional sciences and promotion.\n(I) Farm enhancement, including financial management, input efficiency, and profitability.\n(J) Home economics.\n(K) Rural human ecology.\n(L) Youth development and agricultural education, including 4\u2013H clubs.\n(M) Expansion of domestic and international markets for agricultural commodities and products, including agricultural trade barrier identification and analysis.\n(N) Information management and technology transfer related to agriculture.\n(O) Biotechnology related to agriculture.\n(P) The processing, distributing, marketing, and utilization of food and agricultural products.\n(10)\nHispanic-serving agricultural colleges and universities.\u2014\n(A)\nIn general.\u2014\nThe term \u201cHispanic-serving agricultural colleges and universities\u201d means colleges or universities\u2014\n(i) that qualify as Hispanic-serving institutions;\n(ii) that offer associate, bachelors, or other accredited degree programs in agriculture-related fields; and\n(iii) with respect to which the Secretary has not received a declaration of the intent of a college or university to not be considered a Hispanic-serving agricultural college or university.\n(B)\nException.\u2014\nThe term \u201cHispanic-serving agricultural colleges and universities\u201d does not include 1862 institutions (as defined in\nsection 7601 of this title\n(C)\nTermination of declaration of intent.\u2014\nA declaration of the intent of a college or university to not be considered a Hispanic-serving agricultural college or university submitted to the Secretary shall be in effect until\nSeptember 30, 2018\n(11)\nHispanic-serving institution.\u2014\nThe term \u201cHispanic-serving institution\u201d has the meaning given the term in\nsection 1101a of title 20\n(12)\nInsular area.\u2014\nThe term \u201cinsular area\u201d means\u2014\n(A) the Commonwealth of Puerto Rico;\n(B) Guam;\n(C) American Samoa;\n(D) the Commonwealth of the Northern Mariana Islands;\n(E) the Federated States of Micronesia;\n(F) the Republic of the Marshall Islands;\n(G) the Republic of Palau; and\n(H) the Virgin Islands of the United States.\n(13) The term \u201cland-grant colleges and universities\u201d means those institutions eligible to receive funds under the Act of\nJuly 2, 1862\n12 Stat. 503\u2013505\n7 U.S.C. 301\u2013305\nAugust 30, 1890\n26 Stat. 417\u2013419\n7 U.S.C. 321\u2013326\n(14)\nNLGCA institution; non-land-grant college of agriculture.\u2014\n(A)\nIn general.\u2014\n(i)\nDefinition.\u2014\nThe terms \u201cNLGCA Institution\u201d and \u201cnon-land-grant college of agriculture\u201d mean a public college or university offering a baccalaureate or higher degree in the study of agricultural sciences, forestry, or both in any area of study specified in clause (ii).\n(ii)\nClarification.\u2014\nFor purposes of clause (i), an area of study specified in this clause is any of the following:\n(I) Agriculture.\n(II) Agricultural business and management.\n(III) Agricultural economics.\n(IV) Agricultural mechanization.\n(V) Agricultural production operations.\n(VI) Aquaculture.\n(VII) Agricultural and food products processing.\n(VIII) Agricultural and domestic animal services.\n(IX) Equestrian or equine studies.\n(X) Applied horticulture or horticulture operations.\n(XI) Ornamental horticulture.\n(XII) Greenhouse operations and management.\n(XIII) Turf and turfgrass management.\n(XIV) Plant nursery operations and management.\n(XV) Floriculture or floristry operations and management.\n(XVI) International agriculture.\n(XVII) Agricultural public services.\n(XVIII) Agricultural and extension education services.\n(XIX) Agricultural communication or agricultural journalism.\n(XX) Animal sciences.\n(XXI) Food science.\n(XXII) Plant sciences.\n(XXIII) Soil sciences.\n(XXIV) Forestry.\n(XXV) Forest sciences and biology.\n(XXVI) Natural resources or conservation.\n(XXVII) Natural resources management and policy.\n(XXVIII) Natural resource economics.\n(XXIX) Urban forestry.\n(XXX) Wood science and wood products or pulp or paper technology.\n(XXXI) Range science and management.\n(XXXII) Agricultural engineering.\n(XXXIII) Any other area, as determined appropriate by the Secretary.\n(B)\nDesignation.\u2014\nNot later than 90 days after\nFeb. 7, 2014\n(C)\nExclusions.\u2014\nThe terms \u201cNLGCA Institution\u201d and \u201cnon-land-grant college of agriculture\u201d do not include any institution designated under\u2014\n(i) the Act of\nJuly 2, 1862\n7 U.S.C. 301\n(ii) the Act of\nAugust 30, 1890\n7 U.S.C. 321\n(iii) the Equity in Educational Land-Grant Status Act of 1994 (\nPublic Law 103\u2013382\n7 U.S.C. 301\n(15) The term \u201cSecretary\u201d means the Secretary of Agriculture of the United States.\n(16)\nState.\u2014\nThe term \u201cState\u201d means\u2014\n(A) a State;\n(B) the District of Columbia; and\n(C) any insular area.\n(17) The term \u201cState agricultural experiment stations\u201d means those institutions eligible to receive funds under the Act of\nMarch 2, 1887\n24 Stat. 440\u2013442\n7 U.S.C. 361a\u2013361i\n(18) The term \u201cState cooperative institutions\u201d or \u201cState cooperative agents\u201d means institutions or agents designated by\u2014\n(A) the Act of\nJuly 2, 1862\n7 U.S.C. 301\n(B) the Act of\nAugust 30, 1890\n7 U.S.C. 321\n(C) the Act of\nMarch 2, 1887\n7 U.S.C. 361a\n(D) the Act of\nMay 8, 1914\n7 U.S.C. 341\n(E) the Act of\nOctober 10, 1962\n16 U.S.C. 582a\n(F) section 3192 of this title\n(G) subchapters VI, XI, and XII of this chapter.\n(19) The term \u201csustainable agriculture\u201d means an integrated system of plant and animal production practices having a site-specific application that will, over the long-term\u2014\n(A) satisfy human food and fiber needs;\n(B) enhance environmental quality and the natural resource base upon which the agriculture economy depends;\n(C) make the most efficient use of nonrenewable resources and on-farm resources and integrate, where appropriate, natural biological cycles and controls;\n(D) sustain the economic viability of farm operations;
