{"identifier":"/us/usc/t7/s7442","title":7,"num":"\u00a7\u202f7442.","heading":"Definitions","text":"\u00a7\u202f7442.\nDefinitions\nIn this subchapter (unless the context otherwise requires):\n(1)\nBoard\nThe term \u201cBoard\u201d means the National Canola and Rapeseed Board established under\nsection 7444(b) of this title\n(2)\nCanola; rapeseed\nThe terms \u201ccanola\u201d and \u201crapeseed\u201d mean any brassica plant grown in the United States for the production of an oilseed, the oil of which is used for a food or nonfood use.\n(3)\nCanola or rapeseed product\nThe term \u201ccanola or rapeseed product\u201d means a product produced, in whole or in part, from canola or rapeseed.\n(4)\nCommerce\nThe term \u201ccommerce\u201d includes interstate, foreign, and intrastate commerce.\n(5)\nConflict of interest\nThe term \u201cconflict of interest\u201d means a situation in which a member of the Board has a direct or indirect financial interest in a corporation, partnership, sole proprietorship, joint venture, or other business entity dealing directly or indirectly with the Board.\n(6)\nConsumer information\nThe term \u201cconsumer information\u201d means information that will assist consumers and other persons in making evaluations and decisions regarding the purchase, preparation, and use of canola, rapeseed, or canola or rapeseed products.\n(7)\nDepartment\nThe term \u201cDepartment\u201d means the Department of Agriculture.\n(8)\nFirst purchaser\nThe term \u201cfirst purchaser\u201d means\u2014\n(A) except as provided in subparagraph (B), a person who buys or otherwise acquires canola, rapeseed, or canola or rapeseed products produced by a producer; or\n(B) the Commodity Credit Corporation, in a case in which canola or rapeseed is forfeited to the Commodity Credit Corporation as collateral for a loan issued under a price support loan program administered by the Commodity Credit Corporation.\n(9)\nIndustry information\nThe term \u201cindustry information\u201d means information or a program that will lead to the development of new markets, new marketing strategies, or increased efficiency for the canola and rapeseed industry, or an activity to enhance the image of the canola or rapeseed industry.\n(10)\nIndustry member\nThe term \u201cindustry member\u201d means a member of the canola and rapeseed industry who represents\u2014\n(A) manufacturers of canola or rapeseed products; or\n(B) persons who commercially buy or sell canola or rapeseed.\n(11)\nMarketing\nThe term \u201cmarketing\u201d means the sale or other disposition of canola, rapeseed, or canola or rapeseed products in a channel of commerce.\n(12)\nOrder\nThe term \u201corder\u201d means an order issued under\nsection 7443 of this title\n(13)\nPerson\nThe term \u201cperson\u201d means an individual, partnership, corporation, association, cooperative, or any other legal entity.\n(14)\nProducer\nThe term \u201cproducer\u201d means a person engaged in the growing of canola or rapeseed in the United States who owns, or who shares the ownership and risk of loss of, the canola or rapeseed.\n(15)\nPromotion\nThe term \u201cpromotion\u201d means an action, including paid advertising, technical assistance, or a trade servicing activity, to enhance the image or desirability of canola, rapeseed, or canola or rapeseed products in domestic and foreign markets, or an activity designed to communicate to consumers, processors, wholesalers, retailers, government officials, or other persons information relating to the positive attributes of canola, rapeseed, or canola or rapeseed products or the benefits of use or distribution of canola, rapeseed, or canola or rapeseed products.\n(16)\nResearch\nThe term \u201cresearch\u201d means any type of test, study, or analysis to advance the image, desirability, marketability, production, product development, quality, or functional or nutritional value of canola, rapeseed, or canola or rapeseed products, including research activity designed to identify and analyze barriers to export sales of canola or rapeseed produced in the United States.\n(17)\nSecretary\nThe term \u201cSecretary\u201d means the Secretary of Agriculture.\n(18)\nState\nThe term \u201cState\u201d means any of the 50 States, the District of Columbia and the Commonwealth of Puerto Rico.\n(19)\nUnited States\nThe term \u201cUnited States\u201d means collectively the 50 States, the District of Columbia, and the Commonwealth of Puerto Rico.","url":"https://projectusc.org/usc/t7/s7442.html","content":[{"t":"sec","id":"/us/usc/t7/s7442","children":[{"t":"num","text":"\u00a7\u202f7442."},{"t":"heading","text":"Definitions","tail":"\n"},{"t":"chapeau","text":"In this subchapter (unless the context otherwise requires):"},{"t":"para","id":"/us/usc/t7/s7442/1","children":[{"t":"num","text":"(1)"},{"t":"heading","text":"Board"},{"t":"content","children":[{"t":"p","text":"The term \u201cBoard\u201d means the National Canola and Rapeseed Board established under ","children":[{"t":"ref","text":"section 7444(b) of this title","href":"/us/usc/t7/s7444/b","tail":"."}],"tail":"\n"}],"tail":"\n"}],"tail":"\n"},{"t":"para","id":"/us/usc/t7/s7442/2","children":[{"t":"num","text":"(2)"},{"t":"heading","text":"Canola;
